Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant has designed the proposed school, parking areas, athletic fields and stormwater ponds to avoid other impact to streams, wetlands and open water ponds. The applicant has selected the proposed stream crossing in a location of an existing stream crossing and culvert, thus avoiding additional net loss of stream than a new proposed crossing location. The applicant is utilizing head/end walls and minimizing road shoulder side slopes to minimize the impact to the stream and wetlands. The remaining 0.609 acres of wetlands, 1,346 linear feet of stream channel and 0.22 acres of open water ponds are being avoided. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The clearing limits will be staked and sediment/erosion control devices will be used. Temporary coffer dams will be installed upgradient of the proposed culvert replacement. During construction, water will be pumped around the construction footprint. Appropriate stream bank protection will be provided in the channel during culvert replacement and all excess excavated material will be immediately removed from the stream bank and wetlands within the road crossing area. Upon completion of the culvert installation, the temporary sand bag coffer dam will be removed and flow will be diverted through the culvert. Following culvert installation, disturbed banks will be restored to similar pre -construction grade, matted and seeded/live staked. 2. The attached IPac dated 11.2.22 identifies Tri colored bat (Proposed Endangered) and Schweinitz's sunflower (Endangered) as potentially occurring within the project area. The project area contains an existing road and sanitary sewer crossings that have become overgrown with dense mid and understory vegetation. Based on our observations, the project area does not contain suitable habitat for the Tri colored bat or Schweinitz's sunflower. Therefore, we have made the determination the proposed project would have no effect to federally protected species. 6. Essential Fish Habitat (Corps Requirement) 6a. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area, there may be nests present at some point within the timeframe specified. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3.
