That being the case, I'm not sure why your clients were unable to work with Mr. Connor to get his acceptance.
However, as that is the case, I'll ask that Ted Alexander share the plan with Mr. Connor and that your client work on the
agreement outlined in my earlier e-mail to arrange for entry into the property for installation and 3 year maintenance.
Our goal has always been to provide a substantial buffer to shield the historic house from the development and future
development that your client originally proposed, was part of the USACE permit and agreed upon as a condition to that
application.

Gentlemen —
Following the issuance of the Notice of Violation (NOV) to PCD LLC for non-compliance with special conditions stated in
your existing Department of Army authorization referenced above, the State Historic Preservation Office (SHPO) in
conjunction with Preservation North Carolina (PNC) provided an alternative solution for resolving this situation.
Mr. Ted Alexander, PNC, has spoken with Mr. Connor about installing and monitoring the vegetative screen within the
limits of the historical structure. According to Mr. Alexander, Mr. Connor is amenable to PCD installing a vegetative
buffer within the limits of the historic parcel as he wants protection for the structure. Mr. Connor does not want to give
up the 25' of land on the three sides of the historic tract, which he will someday sell or transfer to another entity. This
proposed new location will require revision of the planting plan; but, also means that the initial planting cost and 3-year
maintenance / monitoring will be less expensive.
An agreement that can be signed by the Connor House owner, PNC, and PDC allowing the PDC contractor to enter the
property, install, and maintain the plantings is also needed. SHPO and the Corps assume that this instrument is
something that PDC would want and need to prepare.
This alternative appears to address the ongoing non-compliance, ensure the mitigation is carried out, and provides
protection for the historic property that was originally intended. Should you have specific questions about this proposal,
please reach out to Mr. Alexander and/or Ms. Gledhill -Early. Both are copied on this message.
The Corps' NOV requires a response from your group on or before October 14, 2022. Please consider this option when
providing your response.
