and Maintenance of Existing Riparian Buffer Rule (15ANCAC2B.O25O)
Dear Mr. May:
On December 11, 2014, at your request, Sue Homewood of the Division of Water Resources (DWR)
conducted on on-site determination to review one feature located on the subject site for
applicability to the Randleman Lake Buffer Rules (15ANCAC 2B .0250). The feature is labeled as
drainage VV|-Q0on the attached map. City of High Point staff has previously conducted anon-site
determination of this feature. |n your letter to the Director dated November lCi3O14,you
requested an appeal of their determination as provided within the City's Ordinance.
Ms. Homewood conducted an appeal of the original City ofHigh Point determination as stated
above. During the review, Ms. Homewood evaluated drainage VV|-OQ using the [)VVRStream
Classification Form. Ms. Homewood evaluated drainage VV|-O8 and received a score of19.5onthe
DVVRforno. The form states that if the score is "greater than or equal to 19 points the stream is
intermittent". However, Ms. Homewood determined the feature to be ephemeral. The form is
attached |o this letter.

The DWR has determined that the feature labeled as "WI-08" on the attached map is an
ephemeral channel that is not subject to the Randleman Lake Buffer Rule above the large
headcut identified as the E/I point by Carolina Ecosystems, Inc.
This determination shall replace the determination originally performed by the City of High
Point and shall expire five years from the date of this letter.
You can contest the Director's decision as provided in Articles 3 and 4 of G.S. 150B. To contest the
Director's decision you must file a petition for an administrative hearing. You may obtain the
petition form from the office of Administrative hearings. You must file the petition with the office
of Administrative
Hearings within sixty (60) days of receipt of this notice. A petition is considered filed when it is
received in the office of Administrative Hearings during normal office hours. The Office of
Administrative Hearings accepts filings Monday through Friday between the hours of 8:00am and
5:00pm, except for official state holidays. The original and one (1) copy of the petition must be
filed with the Office of Administrative Hearings.
The petition may be faxed-provided the original and one copy of the document is received by the
Office of Administrative Hearings within five (5) business days following the faxed transmission.
