This office has reviewed the information submitted on November 9, 2000
concerning whether the Neuse River Buffer rules (15A NCAC 2B .0233) apply to
development on lots 42, 43 and 44 in Glenmitt Stone Subdivision off of Aurthur Pierce
Road in Wake County. Based on a site visit on November 11, 2000, no stream was
present on these lots although a stream is depicted on the Wake County Soil Survey.
Therefore the Neuse River Buffer rules do not apply to development on these lots.
