Dear Mr. Roberts:
On June 15, 1998, I met with you at a proposed development near the junction of New
Hope Road and South Hall Road in Wake County. At your request, an evaluation was
performed to determine whether three (3) features as indicated by a green high lighter
on the attached map would require compliance with the Neuse River Buffer
requirements. (Please note: these are the only features that I reviewed). Feature # 1, as
indicated on the attached map is not a stream and is not subject to the Riparian Buffer
Rule. Feature # 2, as indicated on the attached map is a stream and is subject to the
Neuse Buffer Rule. Feature # 3, as indicated on the attached map, while it is a stream it
is devoid of forest vegetation. Accordingly, feature #3 is not subject to Neuse Buffer
Rule.

k _FpW7 On October 10, 2000 I met with you at the subject site and conducted an evaluation of the features
ti represented on the Wake County Soils and the USGS Raleigh West Quad maps were evaluated to
.; determine their subjectivity to the Neuse Buffer Rule. One feature is depicted on both of the maps.
'''"'*:' This project is referenced by the Raleigh Regional Office as NBRRO 00 -301.
It was determined that the feature represented on the maps in the area of the road realignment is not
present on the ground and therefore, is no subject to protection under the Neuse River Basin:
Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian
Areas, Administrative Code T15A:02B.0233 (NCAC 0233). This letter only addresses the
applicability of the Neuse Buffer Rules. Thank you for your attention to this matter and if this
