On October 12, 1999 I met with you at the subject property to conduct a site visit for the above referenced
project. This project is referenced by the Raleigh Regional Office as NBRRO 00 -302. It was determined
that there are several features on site that are represented on the Durham County Soils Map present on this
property.
The Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of
Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233) states that water bodies that
are at least intermittent are subject to protection. It was determined that the features represented on the maps
are not present on the ground as streams and therefore are not subject to the Neuse Buffer Rule.
This letter only addresses the applicability of the Riparian Rules. Thank you for your attention to this matter
