On October 17, 2000 I met with you onsite to perform an evaluation of the stream features on the
subject property. The plat map and other information was provided to allow a determination to be
made as to whether or not the site would require compliance with the Neuse Buffer Rule. This
project is referenced by the Raleigh Regional Office as NBRRO 00 -305.
The features represented on the Wake and Johnston County Soils and the USGS Angier Quad maps
were evaluated to determine their subjectivity to the Neuse Buffer Rule. The feature depicted on the
soils map is a stream and therefore is subject to protection under the Neuse River Basin: Nutrient
Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas,
Administrative Code T15A:02B.0233 (NCAC 0233). This subjectivity begins at a point marked
as NBR 01 on the map.
This letter only addresses the applicability of the Neuse Buffer Rules. Thank you for your attention

Dear Mr. N itchell,
I am writing you on behalf of my client,Mr. Douglas Ball."Hle as requested that I
receive written confirmation that for one channel on the Messer Drive Tract that is `^
subject to the Neuse Basin Rules(see attached sketch map). The delineation was
completed on October 17a', 2000 which is the same day we met to review the top of
channel location. The stream in question meets the requirements for intermittent or
greater stream classification. As you will note, I have attached copies of the soil survey,
USGS topo quad(Angier,NC)and a sketch map.
The top of the channel or NBR point is noted in the field using S&EC pink logo flagging.
Flag#01 denotes the top of channel for the feature in question. If you have any questions
