Failure to establish an adequate system for collecting and maintaining the required operational information shall result in future compliance problems. Note that the setback requirement to surface waters of 50 feet has been waived for the existing upper sediment pond (actual distanve to Burningtown Creek is approximately 41 feet) based primarily on the historical operation of the recycle system dating back to 1942; the lack of an impoundment fdilure risk due to elevation of the ponds to the creek, respectively; and statement that no chemicals are used in the recycle process. Groundwater or surface water monitoring is not required at this time but may be required in the future if compliance issues arise with the operation. Additionally, note the requirements of Condition 111.8. to establish and maintain a protective vegetative cover on all earthen embankments, berms, pipe runs, erosion control areas, and surface water diversions surrounding the sediment ponds. Currently these areas appear to be unvegetated. If any parts, requirements or limitations contained in this permit are unacceptable, the Permittee has the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. No later than six months prior to the expiration of this permit, the Permittee shall request renewal of this permit on official Division forms. PERFORMANCE STANDARDS 1. The subject non -discharge facilities shall be effectively maintained and operated at all times so there is no discharge to the surface waters, nor any contravention of groundwater or surface water standards. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, the Permittee shall take immediate correctives„actions including Division required actions, such as the construction of additional or replacement wastewater treatment or recycle facilities. 2. This potmit shall not relieve the Permittee of their responsibility for damages to groundwater or surface water resulting from the operation of this facility. 3. The facilities permitted herein shall be constructed according to the following setbacks: a. The setbacks for storage and treatment units permitted under 15A NCAC 02T .1000 shall be as follows (all distances in feet): i. Upon the Water Pollution Control System Opergors Certification Commission's (WPCSOCC) classification of the subject non -discharge facilities, in accordance with 15A NCAC 08G .0200 the Permittee shall designate and employ a certified operator in responsible charge (ORC) and one or more certified operator(s) as back-up ORC(s). The ORC or their back-up shall visit the facilities in accordance with 15A NCAC 08G .0200, and shall comply with all other conditions specified in the previously cited rules. 3. The residuals generated from the wastewater treatment facilities shall be disposed or utilized in accordance with 15A NCAC 02T .1100. Trees, shrubs, and other woody vegetation shall not be allowed to grow on the earthen dikes or embankments. Earthen embankment areas shall be kept mowed or otherwise controlled and accessible. IV. MONITORING AND REPORTING REQUIREMENTS 1. Any Division required monitoring (including groundwater, plant tissue, soil and surface water analyses) necessary to ensure groundwater and surface water protection shall be established, and an acceptable sampling reporting schedule shall be followed. 2. Per 15A NCAC 02H .0800, a Division certified laboratory shall conduct all laboratory analyses for the required effluent, groundwater or surface water parameters. 3. VI. GENERAL CONDI3LIONS I. Failure to comply with the conditions and limitations contained herein may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes 143- 215.6A to 143-215.6C. 2. This permit shall become voidable if the permitted facilities are not constructed in accordance with the conditions of this permit, the Division approved plans and specifications, and other supporting documentation. 3. This permit is effective only with respect to the nature and volume of wastes described in the permit application, Division approved plans and specifications, and other supporting documentation. No variances to applicable rules governing the construction or operation of the permitted facilities are granted, unless specifically requested and approved in this permit pursuant to 15A NCAC 02T .0105(n). 4. The issuance of this permit does not exempt the. Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies (e.g., local, state, and federal). Of particular concern to the Division are applicable river buffer rules in 15A NCAC 02B .0200; erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCGO 10000; any requirements pertaining to wetlands under 15A NCAAC 02B .0200 and 02H .0500; and documentation of compliance with Article 21 Part 6 of Chapter 143 of the General Statutes. In the event the permitted facilities change ownership or the Permittee changes their name, a formal permit modification request shall be submitted to the Division. This request shall be made on official Division forms, and shall include appropriate property ownership documentation and other supporting documentation as necessary. The Permittee of record shall remain fully responsible for maintaining and operating the facilities permitted herein until a permit is issued to the new owner. 6. The Permittee shall retain a set of Division approved plans and specifications for the life of the facilities permitted herein. 7. The Permittee shall maintain this permit until all permitted facilities herein are properly closed or permitted under another permit issued by the appropriate permitting authority pursuant to 15A NCAC 02T .01050). 8. In order to more easily correlate the responses to your requests, we have first restated each information request in italics, followed by the response. Request 1. Application item V.5. indicates that the proposed storage/recycling ponds are not capable of holding the 25-yr, 24-hr storm. Further, no water balance was submitted to verify this information. Note that containment of the water from the 25-yr storm plus one foot of freeboard is required for all closed loop storage units as described in the design criteria in 15A NCAC 02T.1005. Please discuss what modifications to the system and timeframe would be necessary to meet this requirement. Response. As was stated briefly on page one of the original permit application letter: "The ponds are situated in a generally flat area with berms such that any stormwater runoff draining into the ponds is minimal." Because the ponds were constructed at ground level and bermed to prevent the capture of stormwater runoff from the adjacent area (see Photo 1), hydrologic calculations were performed for the 25-year, 24-hour point rainfall event, with the drainage area estimated to be equivalent to the surface area of the ponds themselves (i.e. only the rainfall falling directly into the ponds is captured by the ponds). A point rainfall total of 7.01 inches was obtained from National Weather Service (NWS) statistical data for the 25-year, 24-hour storm at the location of Mason's Mine (Attachment A). Table 1 below shows the volume of stormwater generated for the event, assuming no rainfall losses. Therefore, the pond capacity will be sufficient to contain the 25-year, 24-hour stormwater volume while maintaining at least one foot of freeboard. which prevent additional runoff capture. Request 2. Application item V11.3. is marked NIA for all field -observed setback distances indicating greater than 500 ft. However, Burningtown Creek appears to be less than 50 feet from the upper sedimentation pond. 15A CAC 02T. 1006(a) requires a minimum 50 foot setback to surface waters for all treatment/storage units. Please provide the actual distance to Burningtown Creek and discuss what would be necessary to meet the rule requirement. Response. In the original permit application, the intent of the N/A response was to indicate that there are no treatment units or any chemicals used as part of the Mason's Mine recycled water system. However, regarding the proximity of the storage (sediment ponds) to Burningtown Creek, the best available GIS data from Macon County indicates a distance of approximately 41 feet from the center line of Burningtown Creek to the nearest edge of the sediment pond (Attachment B). Although this distance is not within the 50-ft setback requirement, an exemption from this requirement is requested, based on the following considerations. Page 2 Mason's Ruby and Sapphire Mine, Closed Loop Recycle System Permit Application, WQ0036755 Response to Additional Information Request December 24, 2013 1) As previously stated, there are no chemicals used in the recycled water operations. The system conveys only water and sediment from the tourist flume wash water. Therefore, chemical hazards are not present. 2) The sediment pond was constructed below grade, to a depth of approximately six feet, and there is no constructed impoundment which retains water, such as an earthen dam, at risk of failure or breach. 3) Burningtown Creek in this vicinity is a narrow mountain stream with a limited floodplain, which has not been observed to encroach into the area where the upper sediment pond was constructed. 4) The flatter area where these ponds were constructed is limited, and based on the property space constraints including the need to accommodate the flume area and buildings, it would not be feasible to relocate these ponds further from Burningtown Creek. Having to relocate these facilities would likely require substantial reconfiguration of the entire operation, including the buildings and flumes. Such an endeavor would create an extreme financial hardship and likely require Mason's Mine to cease operating entirely. 5) Mason's Mine has been in operation since 1942 as a tourist gem mine, with no known record of a system failure contributing to the release sediment into Burningtown Creek. Since the Klatt family purchased the mine in 2011, there have been no changes made to the recycled water system. Given the long history of the mine, it is therefore expected that any risk of sediment release due to a major flooding event is minimal. In view of these considerations, an exemption from the 50-ft setback requirement is requested for the recycled water system. Request 3. Please provide a FEMA floodplain map for Burningtown Creek in the vicinity of the facility to verify application item IV. S indicating no treatment, storage or disposal facilities located in the 100-yr floodplain. Response. In the vicinity of Mason's Mine, Burningtown Creek is not a FEMA studied or mapped stream. The upstream limits of the detailed study for Burningtown Creek end approximately 5.2 miles downstream of Mason's Mine, as shown in the map generated from the North Carolina Floodplain Mapping Program website in Attachment C. Request 4. Please provide a site plan in accordance with 15A NCAC 02T.1004(c). The provided mining permit survey may be revised to include missing components listed in the above rule and must be provided in the original document's intended size. Response.
