Reference is made to your rescission request for the subject closed -loop recycle permit. Staff
from the Asheville Regional Office has confirmed that the subject permit is no longer required.
Therefore, in accordance with your request, Permit No. WQ0004541 is rescinded, effective immediately.
If in the future you wish again to operate the subject non -discharge system, you must first apply
for and receive a new closed -loop recycle permit. Please be advised that construction and/or operation of
the subject facilities without a valid permit is a violation of North Carolina General Statute §143-215.1
and may subject the owner/operator to appropriate enforcement actions in accordance with North
Carolina General Statute § 143-215.6A-6C. Civil penalties of up to $25,000 per day per violation may be
assessed for failure to secure a permit required by North Carolina General Statute § 143-215.1.

From the note below sent earlier this year I am trying to determine if this permit can be rescinded. After checking with
storm water section the current storm water permit does not cover the recycle system, as previous permits did. It
sounds as if there is no process water to recycle. I have attached a form for the regional comment on rescinding this
permit. Complete and submit to my attention.
Mr. Hardee,
As per our phone conversation today, our Mission Quarry Crusher does not discharge process water. For the last
2-3 years the site has been inactive and the "Closed loop" process/wash water system was eliminated several years ago.
Also the request to rescind Permit # WQ0004541. was sent in approximately 2010. We are going to crush aggregate on
this site on a limited/as needed -basis for the short term using a portable crusher that does not have stone washing
capabilities therefore has no process water. The only discharge on this site is storm water covered under Permit
