Klimek, P.E., Director Division of Water Quality May 10, 2004 NPDES Permit Issuance Permit No. NC0086665 Dynegy/Rockingham Power Combustion Turbine Facility Rockingham County Division staff have reviewed and approved your renewal application for an NPDES discharge permit. Accordingly, the Division is forwarding the subject NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). Based on comments received from the permittee on the Draft permit, the following changes have been incorporated into this Final permit: • Retain the effluent sampling location designated in the previous permit. • Change the semi-annual monitoring for EPA 624/625 parameters to semi-annual monitoring for BTEX only (benzene, toluene, ethylbenzene, xylene). This is based on the fact that there were no detections for Method 625 parameters between 2000-2004, while there were some detections for toluene and xylene. The BTEX effluent data will be reviewed during the next permit renewal in 2007 to determine the need for permit limits. Please note that the state water quality standard for toluene is 11 ug/1 based on chronic aquatic life impacts, and this water quality standard is applicable to the receiving stream (i.e., unnamed tributary to Jacobs Creek, a Class C waterbody). In addition, the following items from the DRAFT permit have been retained in this FINAL permit: • Change acute toxicity monitoring requirement from episodic to annual, based on the satisfactory performance of past tests. • Addition of monthly effluent monitoring for total lead, based on a lead detection of 29 ug/1 in a contact stormwater sample collected 8/7/2001. The chronic instream water quality standard for total lead is 25 ug/1. This additional data will be evaluated during the next permit renewal to determine whether an effluent limit is necessary. • Change the permit expiration date to 4/30/2007. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the N. C. Sample locations: E- Effluent, defined as a point after combination of the evaporative cooling water and the contact stormwater, and prior to discharge to the unnamed tributary to Jacob's Creek. 2. Effluent flow may be monitored by one of the following methods: 1) measure flow continuously; 2) calculate flow based on the area draining to the outfall, the built -upon area, and the total rainfall; 3) estimated by flow measurement at 20 minute intervals during the entire discharge event; or 4) based on pump logs. Where no measurable discharge occurs, "no discharge shall be reported on the monthly discharge monitoring report submission. 3. The effluent temperature shall not cause the temperature of the receiving stream to increase by more than 2.8 degrees C above natural water temperature, and in no case cause the temperature of the receiving stream to exceed 32 degrees C. 4. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. 5. Where possible, the grab sample for oil and grease shall be skimmed from the surface of a quiescent zone. 6. BTEX= benzene. toluene, ethylbenzene, and xylene. 7. Acute Toxicity (Fathead Minnow, 24-hour); refer to Special Condition A (2). There shall be no discharge of floating solids or visible foam in other than trace amounts. No direct discharge of fuel tank solids, tank bottom water, or the rag layer is permitted. Permit No. NC0086665 . SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (2). ACUTE TOXICITY MONITORING (ANNUAL) The permittee shall conduct annual toxicity tests using protocols defined as definitive in E.P.A. Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephnles promelas) 24 hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The permittee will conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of the permit. The annual test requirement must be performed and reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this date. Toxicity testing will be performed on the next discharge event for the annual test requirement. The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. This letter provides Rockingham's comments on the draft permit as follows: • Rockingham requested in the October 16, 2001 renewal application to change the effluent sample location to be after the evaporative cooling water and contact stormwater are combined, but prior to the addition of noncontact stormwater runoff and prior to discharge to the receiving stream. After discussions with Mr. David Russell, Environmental Specialist with NCDENR, Rockingham would like to rescind this request and maintain the current sampling location; at the outfall drainage location on the southeast corner of the facility. This current sampling location includes evaporative cooling water, oil/water separator discharge water and noncontact stormwater. Mr. Russell concurs with this decision. • Special Condition Section A(1). Note 6. of the above reference NPDES Permit, allows Rockingham to opportunity to request that EPA Methods 624/625 monitoring requirement for Outfall 001 be removed from the semi- annual monitoring frequency requirement. Rockingham has established a compliance history associated with nine (9) sampling events for volatile and semi -volatile organics, as shown on the attached table. You will note that there ar'generally no detectable concentrations of volatile and semi-volatiles present in these samples. Of the 9 samples collected since the permit was issued, chloroform was present in one sample (19 ug/l), toluene was present in two samples (10 ug/I and 18 ug/I), and total xylenes were present in three samples (29 ug/I, 14 ug/I, and 20 ug/I). Generally NCDWQ April 13, 2004 Page 2 pollutants were present in samples collected two years or so ago at concentrations only slights greater than the practical quantitation limit. Inasmuch as the State of North Carolina has not, to our knowledge, promulgated effluent standards for any of these parameters, and inasmuch as an "aquatic life" water quality standard has only been promulgated for toluene (11 ug/I) for Class C waters (which apply outside the mixing zone of an effluent with a waterbody), and inasmuch as outfall 001 initially discharges to an unnamed tributary stream before subsequently discharging into Jacob's Creek, we feel that no violation of water quality standards for these parameters in Jacob's Creek is being caused by our discharge. Therefore, we feel justified in requesting the Outfall 001 semi-annual 624/625 (volatile and semi -volatile organics) monitoring required be removed from the permit. Rockingham Power LLC generates electricity by 5 combustion gas turbines using natural gas as a primary fuel and #2 fuel oil as a backup. Natural gas is delivered to the site via pipeline, while fuel oil is stored in two 2.25 MG onsite tanks with secondary containment. NPDES PERMIT FACT SHEET Dynegy, Inc. Page 2 NPDES No. NC0086665 • The permit regulates the discharge of process water (evaporative cooling water) and contact stormwater (from contaminants around oil storage sources). Sanitary wastewater is treated by an onsite subsurface disposal system. The facility employs 12 staff. • This facility discharges intermittently to an unnamed tributary to Jacobs Creek (Class C), which then flows into the Dan River. The intermittent cooling water discharge ranges from 0-7,200 gpd, while the intermittent process water discharge ranges from 0-18,000 gpd. Jacobs Creek is not listed as an impaired waterbody on the 2002 303(d) List. Permit Development • Authorization to Construct Permit. An ATC was issued for the construction of an oil/water separator in 1999, and an Engineer's Certification of Construction Completion was signed 5/17/2000. • Historical NPDES Permitting. This permit was originally issued on 11 / 19/ 1999 and expired 4/30/2002. A renewal application was received on 10/18/2001. A permit modification dated 1/5/2001 changed the toxicity test type from chronic to acute. • Effluent Guidelines. Federal Effluent Guidelines do not apply to this facility, which produces electricity for peak demand via combustion gas turbines. EPA Effluent Guidelines (40 CFR 423) are only applicable to steam turbine facilities. The previous permit regulated parameters typical to cooling water discharges (e.g., turbidity and temperature) as well as parameters associated with bulk oil storage terminals (Acute tox, TSS, Oil&Grease, EPA Method 624/625). This permit renewal maintains the same limits/monitoring, with the addition of lead sampling based on a detection of lead (29 ug/1) in a contact stormwater sample collected 8/7/01. There were no detections of EPA Method 624/625 parameters in samples collected in May 2002 and June 2003. DMR Data. • Effluent Toxicity Data. Facility passed 8 of 8 acute toxicity tests (24-hour, fathead minnow) between 1999-2003. • Compliance Data. The facility received an NOV for exceeding the TRC limit on 8/19/02, which the facility attributed to chlorine being added to the municipal source water. The application consists of one original and two copies of North Carolina's NPDES Permit Application Short Form C and several supporting documents including (a) USGS topographic drawings (Figures 1 through 4), (b) two site drawings (Figures 5 and 6), (c) a water and wastewater flow diagram (Figure 7), (d) discharge sampling analytical data sheets, and (e) a chain of custody form for the wastewater samples collected for this application. Sampling of plant effluents for purposes of renewing the NPDES permit was performed on August 7, 2001 at the Rockingham Unit 1, 2, 3, 4, and 5 oil/water separator discharge point and the Unit 5 evaporative cooling water discharge point (see the enclosed water and wastewater flow diagram; Figure 7). These waste streams are both contributory to Outfall 001.The results of those analyses are tabulated on the enclosed analytical data sheets. Sanitary wastewaters at the plant are treated by a permitted on -lot subsurface disposal system. With this application, Rockingham Power, L.L.C. is requesting that the existing NPDES permit be reissued, but with a different regulated outfall and a revised list of regulated parameters for this outfall. The current permit regulates the final outfall from the plant which includes noncontact stormwater runoff from the plant site. Rockingham Power, L.L.C. is proposing that an internal plant outfall be regulated instead (see Figures 6 and 7). This outfall conveys only process wastewaters and contact stormwaters from the plant. Monitoring at this location is more representative of the process and contact stormwater discharges from the plant, can be more accurately conducted, and can be better controlled. These changes were discussed with Mr. Michael Myers (NCDENR, Water Quality Page 1 Division) on Monday, July 2, 2001 during a telephone call with personnel in our Decatur, IL office. Therefore, four changes in the current permit are being requested, those being: (1) Redesignate the current Outfall 001 as "Process Wastewaters and Contact Stormwaters from Units 1, 2, 3, 4 and 5". Contributory wastewater streams to this outfall consist of the plant oil/water separator discharge and evaporative cooling waters from Unit 5 (see attached water and wastewater flow diagram; Figure 7). The plant oil/water separator discharge consists of contact stormwaters from containments around two no. 2 fuel oil storage tanks and oil -filled electrical equipment, service water system blowdowns, area washdown, and air conditioner condensate discharges from Units 1 through 5, and turbine inlet air evaporative cooling water system blowdowns from Units 1 through 4 (see attached water and wastewater flow diagram; Figure 7). The evaporative cooling water system blowdown from Unit 5 is conveyed directly to Outfall 001 (rather than through the oil/water separator) because Unit 5 was added after the underground construction of Units 1 through 4 had been completed. Evaporative cooling water is raw water that is injected into the turbine inlet air stream to cool the air. Discharges from the outfall will be intermittent in frequency, depending largely on discharges from the oil/water separator. Oil/water separator discharges are influenced primarily by precipitation and plant operations. Design average and design maximum instantaneous discharge flowrates from the separator (and Outfall 001) will be 100 gpm and 200 gpm, respectively. Discharge durations will range from 10 to 30 minutes. (2) Delete "temperature" as a regulated parameter in the 001 discharge. A combustion gas turbine plant differs from a conventional steam -electric fossil -fuel plant in that only the inlet air to the turbine is required to be cooled (to improve turbine efficiency). There is no steam to condense as in a conventional steam -electric plant. Gas turbine power output is directly related to ambient inlet air temperature. Power generation decreases when ambient inlet air temperatures increases. The purpose of the evaporative cooling water system is to offset power loss during high summer inlet air temperatures. Essentially 100 percent of this evaporative cooling system water is evaporated. Any excess cooling waters are collected and periodically blowndown either to the oil/water separator (for Units 1 through 4 or directly to Outfall 001 from Unit 5). The temperature of this blowdown Page 2 would vary with ambient air temperatures; therefore, waters in the separator and the outfall will not be heated. (3) Delete "turbidity" as a regulated parameter in the 001 discharge. Turbidity is closely associated with the presence of total suspended solids (TSS). As TSS concentrations are already limited by the permit in this discharge, the additional limiting of turbidity seem redundant. (4) Delete the "Daily Maximum 17 ug/I Total Residual Chlorine (TRC) Effluent Limitation". Rockingham Power, L.L.C. is requesting the effluent limitation be removed for this parameter for two reasons. First, Rockingham Power, L.L.C. adds no chlorine to the process waters or cooling waters used in the plant. The plant uses chlorinated water supplied by Rockingham County. Any chlorine present in the discharge from the plant is that which remains in the plant's incoming water supply. And second, the current effluent limitation is identical to the TRC water quality standard for Class C trout waters (15A NCAC 02B.0211(I)(iv)). Rockingham Power does not believe that the waters of the unnamed tributary to Jacobs Creek, or the waters of Jacobs Creek itself are designated as "trout" streams. Rockingham Power, L.L.C. is willing to continue monitoring this parameter, however, for the purpose of developing a record of TRC concentrations in the discharge.
