This permit modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994. The Division received no public comments the draft modification during the 30-day public review period and is issuing the modification as drafted. The affected pages of the permit are enclosed. Please insert these in your existing permit and discard the replaced pages. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division of Water Quality. The Division may require modification or revocation and reissuance of the permit. Haven't reached anyone at the City yet, but did look at the monitoring data more closely and thought you might be interested in what they showed. Check out Chart 1 in the attached spreadsheet. It seems to show that the instream color since late last year (and June '03, in particular) is independent of effluent color. Although it doesn't tell us what *is* causing the instream color to vary so widely, I suspect it's related to elevated turbidities - sections of the creek upstream are channelized, and that part of the state has had an unusually wet year. PROPOSED ACTION The Division proposes to modify NPDES permit NC0074268 for the Crowder Creek WWTP in order to reclassify the facility to Tier 1 under the Division's Color Policy. SUMMARY The Crowders Creek WWTP is a 6.0 MGD wastewater treatment plant, one of two operated by the City of Gastonia. In its 2002 permit renewal, the plant was classified as a Tier 3 facility under the Division's Color Permitting Requirements Policy. In May 2003, the dye house that had been the primary source of color in the plant's discharge ceased operations. Color levels in the creek dropped significantly and have remained at near -background levels (<50 ADMI units) since that time. The City has requested that the Crowder Creek WW 1'1' be reclassified from a Tier 3 to a Tier 1. The change would have no effect on the effluent limitations and monitoring requirements in the existing permit. It would, however, eliminate the requirement for the City to prepare a Pollution Prevention/ Best Management Practices report and to conduct a Color Reduction Study. In light of these changes, the Division holds that reclassifying the facility to Tier 1 is consistent with its Color Policy and proposes to modify the facility's permit accordingly. If color levels in the discharge and the creek increase significantly, the Division may re-evaluate the classification under the Color Policy and again modify this permit. PUBLIC COMMENT ON DRAFT PERMIT A public notice soliciting comments on the draft permit was published in The Gaston Gazette on July 26, 2003, and comments were accepted until August 25. No comments were received during that time. The Division will issue the permit modification as drafted and with an effective date of October 1, 2003. The permit's expiration date, August 31, 2005, is not affected. The p posed change will reclassify 1 facility from a Tier # to a Tie facility in regards to` color c charge requirements and, have no effect on the efflu limitations or monitoring quirements in the existing p mit. yf 1 C-July 26, 2003 For over three years, the City of Gastonia has been monitoring for ADMI color at its treatment plant and at industries that feed into the plant to determine the sources of color at the plant (data is included as attachment A). Anvil Knitwear was determined to be the significant contributor to color at the Crowders Treatment Plant. Anvil Knitwear had a dye -house facility located in the City of Kings Mountain, which previously discharged almost one million gallons per day of wastewater to the Crowders Treatment Plant. This discharge contained significant color in the waste dyes, which were not removed through the biological process at the Crowders Creek Plant. On September 13, 2002, the majority of Anvil's discharge was diverted away from the Crowders facility and began being discharged to a City of Kings Mountain treatment plant. Anvil closed its dye house in Kings Mountain in May 2003, and the inter -city agreement between Gastonia and Kings Mountain, as well as King Mountain's significant industrial user permit, prevent Anvil's flow from being diverted back to the Crowders Plant. Soon after Anvil's departure from the Crowders Treatment Plant's flow, the wastewater being treated at the plant, and the discharge from it, visibly cleared up. Color in the plant effluent dropped from an average of 220 ADMI units to an average of 32 ADMI units, which is comparable to color readings in Crowders Creek upstream of the treatment plant's discharge. Monitoring of the plant effluent has occurred at least monthly with no excessive color detected. A Tier III facility is required to perform two studies: one investigating the sources of color, and another one investigating ways to remove at least 90% of the color from the influent. These studies would have little value and be difficult for the City of Gastonia to perform since there are no significant sources of color into the Crowders Treatment Plant at this time. Currently, the facility is receiving no significant amounts of textile dyes or other source of color, and has no significant color in its effluent. Furthermore, the City is prepared to restrict the type of new discharges it receives to prevent significant color discharge in the future (one industry discharging into Gastonia's Long Creek WWTP has already been restricted for ADMI color in its discharge). For these reasons, the City feels that a Tier I rating would be more appropriate for the facility at this time. Numerous aquatic life (fish) were observed both at the effluent and downstream of this discharge. Therefore, based on the recent visit of this facility by MRO staff, we are able to verify that effluent color has, for all intents and purposes, been eliminated in the receiving stream. At the time of the permit issue, the Crowders Treatment Plant was discharging a dark reddish -brown effluent due to wastewater the plant was receiving from a textile dye -house. When the permit was issued, the City of Gastonia did not dispute this classification. Since receiving the permit, the characteristics of Crowders Treatment Plant's discharge have changed significantly, and color is no longer visible in the plant effluent. Because of these changed circumstances, the City of Gastonia is requesting a modification to NPDES Permit (NPDES #NC0074268) to reclassify the plant as a Tier I facility. Color at the downstream stations tracks well with the effluent values - about what we would expect given the low dilution (41 % IWC). From Oct'02 to present, effluent values are consistently lower, similar to background levels. For a few months, downstream values mimic the effluent. Beginning about Dec'02, downstream values vary independent of effluent values.
