The Division of Water Quality (the Division) hereby transmits the approved final NPDES permit for the
subject site. We issue this permit pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental
Protection Agency dated May 9, 1994, or as subsequently amended.
The Division acknowledges your purchase of the subject site (documents received December 21,
2006), and your authorization of Tracy B. Robinson, site Production Manager, to provide information
and sign reports, as required under this permit.
Concerning Total Residual Chlorine (TRC). In compliance with the statewide standard for chlorine,
the Division must deny your request to remove the TRC limit (17 ug/L) and Monthly monitoring from
the permit. However, footnotes have been added to the effluent -monitoring table to explain that
monitoring and limits apply only if chlorine is used by the' facility [See permit Section A. (1.)].
Receiving -Stream Flow Conditions. Please be reminded that subject site discharges under "zero -flow"
stream conditions (dry ditch), i.e., your discharge constitutes effectively 100% of local surface waters.
This means that your effluent enters the surface environment with little or no benefit from dilution.
Changes to your Previous Permit — Oil & Grease, Lead, and Naphthalene. As part of renewal, the
Division conducted a Reasonable Potential Analyses (RPA) on your analytical data for lead, as required
by the NPDES Program. Based on this analysis, the Division finds no reasonable potential to exceed the
instream water -quality Standard for lead. Therefore, monitoring for Total Lead has been removed from
your permit. Similarly, and for the same reason, Oil & Grease monitoring has been discontinued.
However, to better evaluate the potential loss to the environment of #2 diesel (your preferred back-up
fuel source at this facility), the Division has added the parameter Naphthalene [See permit Section A.
(1.)]. There are no other changes to your previous permit.

If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing upon written request within thirty (30) days
after receiving this letter. Your request must be in the form of a written petition conforming to Chapter
150B of the North Carolina General Statutes, and must be filed with the office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is
made, this permit shall be final and binding.
This permit is not transferable except after notifying the Division of Water Quality. The Division may
require modification, or revocation and re -issuance of this permit. Please notice that this permit does not
affect your legal obligation to obtain other permits required by the Division of Water Quality, the
Division of Land Resources, the Coastal Area Management Act, or other federal or local governments.

revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.

Flow — During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring Report
(DMR) indicating "No discharge." Flow shall be monitored with each discharge event and may be
monitored in one of four ways:
• measure flow continuously;
• calculate flow based on total rainfall per area draining to the outfall; exclude built -upon area
(best methofi forfaeilities with large runoff -collection ponds); - _ -
• estimate flow at 20-minute intervals during the entire discharge event; or
• report flow based on discharge pump logs.
2. Total Residual Chlorine (TRC) — limit and monitoring apply only if chlorine is used by the facility.

The Permittee shall discharge no floating solids or foam visible in other than trace amounts.
The Permittee shall discharge no tank solids, tank bottom water, or the tank rag layer.
Following hydrostatic testing, the Permittee shall discharge no tank (or pipe) contents unless discharge
analyses show benzene concentration below 1.19 µg/L and toluene concentration below 11 µg/L.

A. (2.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)
24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste
treatment. The Permittee will conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit. The annual test requirement must be performed and
reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results, required as part of this permit
condition, will be entered on the Effluent Discharge Form (MR-1) for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened
and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an invalid test
and will require immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

RENEWAL NOTES
Summary
• Rockingham County Combustion Turbine Facility is a minor industrial facility generating 900 MW
of electricity to support peak power demands. The facility generates electricity using 5 combustion
gas turbines fueled by natural gas (primary fuel) and #2 fuel oil as a backup (secondary fuel). Natural
gas is delivered to the site via pipeline, while fuel oil is stored in two large surface tanks (2.25 MG
with secondary containment).
• This permit regulates a Water Pollution Prevention System discharge of process -contact water
(evaporative cooling water) and process -contact stormwater (from behind secondary containment for
bulk -storage fuel tanks and appurtenant piping). This facility employs a staff of 12 and sanitary
sewer is treated onsite by a conventional subsurface septic system.
• This facility discharges intermittently to an unnamed tributary to Little Jacobs Creek (corrected
location), thereby flowing to Jacobs Creek, hence to the Dan River (Class C).
• Intermittent cooling water flow ranges from 0-7,200 gpd, while the intermittent process flow ranges
from 0-18,000 gpd.
• Jacobs Creek is not listed as "impaired" on the Divisions list of impaired waterbodies [303(d) List,
2006] .
Permit Development
• Receiving Stream. Historical•data indicates this discharge occurs under zero -flow Conditions.
• Historical NPDES Permitting. This permit was originally issued in November 1999 and reissued in
January 2001. The Division received a renewal application from the Previous owner (Dynegy Inc.)
on September 8, 2006 and Duke Energy (upon purchase of the property) did not alter the application.
• Effluent Guidelines. EPA Effluent Guidelines (40 CFR 423) apply only to steam turbine facilities,
therefore these guidelines do not apply to this facility (peak demand via combustion gas turbines).
• The previous permit regulated parameters typical to cooling water discharges (e.g., turbidity and
temperature) and parameters associated with bulk oil storage terminals (Acute toxicity, TSS, Oil &
Grease, EPA Method 624/625). This renewal maintains the same limits and monitoring, with the
exception of minor changes see (Table 2).
Permit Compliance
• Effluent Toxicity. Facility passed 5 of 5 annual acute toxicity tests (24-hour, fathead minnow) from
2003 to 2007.
• Effluent Parameter Monitoring. O&G max predicted = 19.9 mg/L No RP assuming allowable at 30
mg/L (BPJ). Lead not detected in —30 samples (Jan04 to Ju107). Flow reported — monthly; range
0.004 to 0.092 MGD (Jan04 to Ju107).
• Monitoring for BTEX. BINS recorded four frequency violations (not tested) for BTEX (benzene,
toluene, Ethylbenzene, and Xylene) — required semi-annual testing not reported in Dec 2005, Jun
2006, Dec 2006, Jun 2007. However, with the change in ownership from Dynegy to Duke Power
(December 2006), BTEX was sampled and reported in January 2007. DMR results show "not
detected." Therefore, DWQ will take no assessment action [previous owner's violations (BPJ)].

In response to your August 28, 2006 renewal reminder letter and in accordance with the
provisions of 15A NCAC 2H .0106(b) and your administrative procedures, Rockingham
Power, LLC respectfully re -submits this permit renewal application and enclosures.
Rockingham's original application was previous submitted on July 5, 2006 and returned
by your NPDES Unit on July 11, 2006. With receipt of your August 28, 2006 letter,
Rockingham is now resubmitting the application. The application consists of one
original and two copies of the Application Short Form C and supporting information
including site location map, site layout drawings, and water/ wastewater flow diagram,
and recent monitored data. The effluent data provided in Item 15 of the Short Form C
are based on the April 2005 through May 2006 reports. We understand that there is no
application fee for the filing of this renewal application.
With this application, Rockingham Power, LLC also requests the following changes to
the permit:
1) Removal of TRC sampling and limit. Rockingham Power, LLC does not use
or add chlorine at the plant. Any residual chlorine would originate from the
water supply. Since August 19, 2002 no excursions of the TRC limit have
occurred at the discharge location (Outfall 001). Based on the distance from
the discharge location to the receiving stream (approximately 1,500 feet), the
discharge would have no impact. The discharge flows overland through a dry
drainage way into a small detention pond which upon overflow runs into the
un-named tributary to Jacob's Creek (the receiving stream).

Additionally, on June 8, 2006, three samples were collected at the detention
pond and three were collected at the un-named tributary. Tests results on
these samples did not detect TRC (lab reports enclosed).
The removal of this limit has been discussed with Mr. David Russell of your
office. He has visited the site and agreed that TRC should not be considered
an issue or limit, and should not continue to be monitored at the Rockingham
Power, LLC site.
2) Removal of the limit and monthly monitoring requirement for lead. For the
last three years, Rockingham Power, LLC has collected data showing levels
much less than the chronic in stream water quality standard of 25 pg/l. The
necessity of this effluent limit in the permit was noted for possible removal in
the prior permit renewal dated May 10, 2004.
3) Removal of the semi-annual monitoring for BTEX. Toluene has been well
below the state water quality standard of 11 pg/I during the past sampling
periods (0.0054 mg/L on 1/18/2005 and below quantification limits for
previous more recently). The necessity of this effluent limit in the permit was
noted for possible removal in the prior permit renewal dated May 10, 2004

Oil -water separator and coalescing filter with a capacity of 11,600 gallons receives
contact stormwater (from around oil storage sources), service water system blowdowns,
area washdown, and air conditioner condensate discharges associated with Combustion
Turbine Units 1 through 5, and turbine inlet cooling water system blowdowns from Units
1 through 4.
The oil -water separator discharges are primarily influenced by precipitation and plant
operations. Design average and design maximum instantaneous discharge flowrates from
the separator (and Outfall 001) will be 100 gpm and 200 gpm, respectively. Discharge
durations will range from 10 to 30 minutes.
The collected oil and solids at the separator are pumped out by a contractor (e.g., Noble
Oil) and taken offsite for recycling or disposal. The need for cleaning is fairly infrequent
with the most recent occurring in June 2003.

Charles -- thanks for the information. The coordinates the permittee
gave (see below e-mail), appear to be the outfall and "land" almost
directly on a UT Little Jacobs Creek in Subbasin 030202; just off NC
65.

However, the actual outfall location is in 030203....
Permitted flow is not limited - this is a power plant and flow
limits are not required.
Finally, the Permittee lists a lat/long of 36219'52" / 79249'40" in
their renewal application...but they don't say whether that's for
the facility or for the outfall.
