This project is referenced by the Raleigh Regional Office as NBRRO 00 -100. At your request, an evaluation was performed to determine if the features depicted on the USGS and the Johnston County Soils Maps would require compliance with the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). As a result, it was determined that the feature delineated on the maps was not present on the ground as a stream and therefore not subject to the Neuse Buffer Rules. Our on -site meeting is scheduled for April 18, 2000 at 8:30 am. The USGS quad indicates that a stream is coming out of an excavated agriculture pond. ESI biologists and Corps of Engineers staff have inspected the area, and we believe the map to be incorrect. No channel of any type appears to be outfalling from the pond. We wish to have our findings verified so that the agriculture pond will not be subject to the Neuse Buffer Rule. CP &L is proposing to construct a 230kV sub - station in an upland field and run a tap line across a jurisdictional wetland in order to connect to an existing transmission line. The tap line will likely pass near the pond, and CP &L wishes for DWQ to determine the applicability of the Rule to the subject pond. I will be in contact with you closer to our meeting date.
