.Current DWQ criteria for impacts to stream channels and areas subject to Neuse River ..
Basin Riparian Buffer Rules do not require mitigation for impacts due to road crossings
provided there are no practical alternatives available and no more than 150 linear feet or
1/3 acre of riparian buffer is impacted. Wake County Subdivision Ordinances stipulate
that subdivisions with more than 69 lots must provide two entrances to the development.
Due to the parallel arrangement of the unnamed tributary and Peed Road and the limited
amount of frontage along Highway 98 only one entrance could be located outside the
"buffered" stream channel. Therefore, there are no practical alternatives available to .
provide a second subdivision entrance without crossing the"buffered stream channel..
As the road crossing will impact 146 linear feet of stream and 0.26,acre of riparian buffer,
mitigation for stream and buffer impacts should not be required.

The project consists of construction of a residential subdivision using conventional
methods and equipment. Impacts to jurisdictional areas as a result of the project
consist of one road crossing of a jurisdictional and "buffered" channel.
Jurisdictional wetlands will not be impacted by the project.
13. Purpose of proposed work:
The project will provide approximately 160 new home sites in the North Raleigh
area.
1.4. State reasons why it is believed that this activity must be carried out in wetlands
(include any measures taken to minimize wetland impacts):
Road crossing impacts to one of the jurisdictional channels located within the
proposed subdivision are required to access high ground. Impacts to other
jurisdictional channels and wetlands located within the subdivision have been
avoided through creative site plan development and adherence to Neuse River
Basin and watershed buffers. (See Figure 2 — Preliminary Plan for Ethan's Glen &
Figure 3 — Roadway Plans for Ethan's Glen)

National Marine Fisheries Service (NMFS) (see agency addresses sheet) regarding
the presence of any federally listed or proposed for listing endangered or
