Dear Mr. Ellis:
I have reviewed the information that you have submitted to determine if this timber operation is subject
to the requirements of the 15A NCAC 213 .0259 Tar - Pamlico River Basin: Nutrient Sensitive Waters
Management Strategy: Protection and Maintenance of Existing Riparian Buffers) on the above
referenced property. The property and date of timber sale are as follows:
Approximately 58.75 acres of the 105.3 acres recorded in the Nash County Registry was sold at
sealed bid on September 2, 1999 and closed on September 30, 1999.
Based on the materials provided, the Raleigh Regional Office of the Division of Water Quality believes
that the proposed logging activities are not required to comply with the requirements of the temporary
riparian rule as long as the timber deed listed above remains valid and Forest Practice Guidelines are
followed in conjunction with Best Management Practices.

Per the discussion that took place at the Tar - Pamlico River rule meeting that took place in.

Nashville on February 11, 2000, in
which you were both involved.
I submit to each of you, copies of timber sale maps on tracts that 1 sold and closed prior to
January 1, 2000. These tracts will be administered under the "old" Best Management Practices
guidelines that were in effect when the tracts were sold and closed. All intermittent and perennial
streams have been flagged with orange flagging which reads "streamside management zone ".
None of these tracts have to this date been logged.

special features.
Lola Murray Bass, Nash County, NC, negotiated and sold 10/12/99 to Toney Lumber Company,
P. O. Box 447, Louisburg, NC 27549, 3 year timber deed. Note: Streams shown on the timber
sale map are protected according to BMPs with flagged Streamside Management Zones as
these streams do not show on either the quad map nor the soils map!

On May 18, 2000, I met with you at the subject property. An evaluation of the stream features were
performed to determine whether the site would require compliance with the Neuse Buffer Rule. This
specific project is referenced by the Raleigh Regional Office as NBRRO -00 -146.
The features represented on the Wake County Soils and the USGS Garner quad maps were
evaluated to determine their subjectivity to the Neuse Buffer Rule. It was determined that there are
three features located on the property that are subject to the Neuse River Basin: Nutrient Sensitive
Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative
Code T15A:02B.0233 (NCAC 0233). These features and the required buffer are depicted on the plat
map received by this Office on May 18, 2000.
This letter addresses only those issues involving the riparian area. For information relative to the
Wetlands 401/404 issues, please contact Mr. John Dorney at 919- 733 -1786. Thank you for your
attention to this matter and if this Office can be of any assistance or if you have additional questions,

Dear Mr. Floyd:
On April 4, 2000 I met with you at the subject property to conduct a site visit for the above referenced
project. This project is referenced by the Raleigh Regional Office as NBRRO 00 -086. It was determined
that there are three features on site that are at least intermittent streams. Three are represented on the Wake
County Soils Map and two are shown on the Garner USGS Map.
The Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of
Existing. Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233) states that water bodies that
are at least intermittent are subject to protection. Therefore, these three features are subject to buffer
protection.
Please be reminded that a PreConstruction Notification and the appropriate fee must be transmitted and
approved prior to any impacts to the buffer. Thank you for your attention to this matter and if this Office
