Dear Mr. Jelenevsky:
This letter will serve as confirmation of the buffer determinations made March 9, 2000, when I met
with you at the subject property. This project is referenced by the Raleigh Regional Office as
NBRRO 00 -070.
The features represented on the Wake County Soils and the USGS Lake Apex maps were evaluated
to determine their subjectivity to the Neuse Buffer Rule. Only one feature is depicted on the soil
map. A point was flagged as the origin of the stream feature and above that point, the feature is not
subject although it is a wetland. This feature is a stream and as such is subject to protection under
the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and
Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233).
The unnamed tributary is delineated on the map received by this Office on March 15, 2000. This
letter only addresses the applicability of the Neuse Buffer Rules. Thank you for your attention to

Re: Tucker Development, Gabriel and Chris Chav Property, Wake County, North Carolina. S &EC Project No. 99-

Dear Steve,
I am requesting written confirmation of Neuse Buffer and channel determinations that you made within the Gabriel and
Chris Chav Property on 9 March 2000. The subject property consists of approximately 25 acres and is located
approximately 1 mile south of the 1010 and Smith Road (SR 1302) intersection. The property is located adjacent to the
west of Stephenson Road.
During the field meeting one individual stream feature was examined and buffer calls completed by S &EC were
evaluated. The origin point as determined and flagged by S&&EC was accepted by you and the feature as mapped on the
soil survey above this point was determined not subject to the buffer rule. Please note that the area above the stream
origination point was delineated as a linear wetland.
Only one channel feature is depicted on the soil survey map and no feature within the site is identified on the USGS
map. The Wake County soil survey map sheet 75 and the Apex, N.C. Quadrangle depicting the site location have been
enclosed.
