Dear Mr. Byers:
On January 1, 2001, a final permit for the subject facility became effective. It has since been brought
to our attention by the Point Source Compliance and Enforcement Unit that errors in the monitoring
frequencies for fecal coliform and pH appear on your effluent limits page. You are now required to monitor
for pH and effluent fecal coliform on a daily basis.
Please find enclosed the revised permit pages. The revised pages should be inserted into your permit.
The old pages may then be discarded. All other terms and conditions contained in the original permit remain
unchanged and in full effect. This permit modification is issued under the requirements of North Carolina
General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S.
Environmental Protection Agency.
If any parts, measurement frequencies or sampling requirements contained in this permit
modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be a written petition conforming to
Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714
Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be
final and binding.

During the period beginning on the effective date of the permit, the Permittee is authorized to
discharge from outfall 001. Such discharges shall be limited and monitored by the Permittee as

1. The monthly average effluent BOD5 and Total Suspended Residue shall not exceed 15% of the
respective influent value (85% removal)
2. Monitoring of fecal coliform should be performed three times a week during the months of June,
July, August and September. Weekly monitoring should be done at all other times during the
year (Administrative Code 2B.0508).
3. Whole effluent toxicity shall be measured using the chronic toxicity (Ceriodaphnia) P/F test at
2.4%. Tests should be performed in January, April, July and October.
4. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be
monitored daily at the effluent by grab sample
There shall be no discharge of floating solids or visible foam in other than trace amounts.
The daily average dissolved oxygen effluent concentration shall not be less than 5.0 mg/1.

The City of Brevard was issued a new permit (NC0060534) on 11/29/00,
effective 1/1/01. The effluent monitoring frequencies were incorrectly
listed for fecal coliform (listed as weekly) and pH (listed as 3/week).
The effluent should be monitored daily for both of these parameters.
Natalie Sierra/NPDES Unit will issue a permit modification for this
matter that will probably become effective May 1. I'll update the
correct limits on CMS when the mod goes out. Thanks.
