This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated December 6, 1983. The 30-day public notice and comment period, for the NPDES draft permit NC0056201, has expired. The Division has received no comments regarding the NPDES permit for the subject facility. Part III Condition E of the NPDES permit, issued August 31, 1994, requires the facility to meet a BOD limit of 5.0 mg/L, NH3-N limit of 2 mg/L, and a chlorine limit of 17 µg/L by September 1, 1999, unless another alternative is found to be feasible. The Division has had no correspondence indicating that another alternative is being implemented. Therefore, these limits have been incorporated into this permit. Please take notice that this permit is not transferable. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirement to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local government permit that may be required. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming to chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. It is not recommended to phase these limits into the permit because the permittee was notified that these limitations were going to be implemented in 1994 and has had plenty of time to complete the necessary upgrades to the plant. The reach in question has received a `support threatened' rating which is no longer used by the division and during the next basin plan cycle could possibly be placed on the 303(d) list. The basin plan recommends that alternatives to discharge be examined and that if no feasible alternative exist that the facility receive tertiary limits according to the zero flow policy. General Comments 12/8/99 — Phone conversation with Corey Basinger, Winston-Salem Regional Office. The facility has recently been granted a waiver for an ATC for the installation of an equalization basin. Owner has been very uncooperative in implementation of treatment plant improvements and attendance at meetings. If phase limits are implemented, it is suggested that the time period as short as possible. The region would also like to see the backup power requirement be implemented into the permit. The general feeling is that even with tertiary filters that this facility will not be able to the more stringent limits limits. 12/8/99 — Conversation with Dave Goodrich. The facility has had ample time to improve their facility knowing that the more stringent limits were going to be implemented into their permit. The owners seem unwilling to even discuss the facility with the Division.
