This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on June 23, 2003. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. Stream samples shall be collected three times per week during June, July, August, and September and once per week during the remaining months of the year. 2. The monthly average effluent BOD; and Total Suspended Solids concentrations shall not exceed 15 percent of the respective monthly average influent value (85% removal). 3. The daily average dissolved oxygen concentration in the effluent shall not fall below 5.0 mg/L. 4. TRC monitoring and effluent limitations apply only if chlorine is added to disinfect. 5. Effluent samples collected for mercury must be analyzed by EPA Method 1631 beginning December 1, 2004. 6. Chronic Toxicity (Ceriodaphnia) P/F at 1.7%; January, April, July, and October. See Special Condition A.(2.) of the Supplement to Effluent Limitations. Quarterly sampling shall be conducted at the same time as metals sampling. 7. See Condition A.(4.) of this permit. There shall be no discharge of floating solids or .visible foam in other than trace amounts. A (2). CHRONIC TOXICITY PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 1.7%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple - concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A (3). MERCURY REOPENER The Division may re -open this permit to require mercury load limitations, mercury minimization plans, and/or source water characterization following completion of the Phase 2 Mercury 2 TMDLs for the Lumber and Waccamaw River watersheds. A. (4.) EFFLUENT POLLUTANT SCAN The Perrnittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the attached table. The analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria. Samples shall represent seasonal variations. Unless otherwise indicated, metals shall be analyzed as "total recoverable." Pembroke receives 100% domestic waste and has no pretreatment program. The Permittee has submitted a request for renewal of its permit and has completed the required pollutant analysis and toxicity testing. No changes to the permit are requested with the renewal. This facility discharges to the Lumber River in subbasin 03-07-51. The receiving waters are classified WS-IV B SW HQW at this point, and are listed as impaired on the 2003 303d list based on a fish advisory for mercury. DMR Data Review DMR data from January 2002 through December 2003 were reviewed. These data are summarized in Table 1. NC0027103 DMR Data (January 2002-December 2003) Compliance The facility received one NOV for exceeding permit limits since its last renewal; the weekly average for fecal coliform was exceeded in September 2003. The facility has been in compliance with its toxicity limit for this entire permit term. Fact Sheet NPDES NC0027103 Renewal Page 1 Correspondence The Fayetteville Regional Office (FRO) conducted several site visits during this permit term to evaluate compliance. A Staff Report was also prepared in conjunction with the permit renewal. FRO finds the facility to be in compliance with the NPDES permit and recommends renewal. Instream Data The facility performs instream monitoring for temperature and dissolved oxygen. Recorded values for the last two years show that at no time was the downstream DO level less than the upstream level by 10% or greater. Temperature levels downstream varied by greater than 10% only one time in the past two years. PERMITTING STRATEGY Waste Load Allocation (WLA) The Division prepared the last WLA in 1994. The previous and current effluent limits were based on guidelines and water quality standards. The Division has judged previous parameters and limits to be appropriate for renewal with some exceptions. Changes to toxicant monitoring are discussed in the Reasonable Potential Analysis section. Weekly average ammonia limits based on a 3:1 ratio with the monthly average will be implemented in this permit. This is a new statewide policy that resulted from EPA requirements. The resulting weekly average limit will be 35.0 mg/L. In addition, an annual pollutant scan will be added such that the Permittee can collect the necessary data required by EPA Form 2A throughout the permit teniu. This condition is now standard on all major municipal permits in North Carolina. Reasonable Potential Analysis (RPA) Mercury is the only metal considered a parameter of concern for this facility. All reported values (2002-3002) for mercury were <0.0002 mg/1. However, mercury will remain as a requirement (monitoring only) due to the impaired status of the receiving waters. Sludge values for mercury were recorded in 2002 as 1.1 mg/kg and in 2003 as 2.6 mg/kg and 1.2 mg/kg. These low sludge values confirm that mercury is not present in the facility's wastewater in significant amounts. They are not marked as-builts but they do show that the 100 year elevation at the Lumber River is 155.00 and that all the treatment units are above this elevation by at least 5 feet. The lowest unit is the cascade aerator with a top of wall of 160.5 at the low end. The invert into the cascade is shown as 159.09 so the water level should not surcharge any of the treatment units during the 100 year flood. DIAL The facility has a 500,000gallon digester and an 80,000gallon sludge holding basin for sludge management. Sludge is aerobically digested to meet vector and pathogen reduction. Once the digester is full, decanting is complete; testing begins for class B Sludge. After testing, sludge is land applied under permit WQ0013729. This is normally a six-month process.
