In response to your Notice of Violation (NOV-2022-PC-0423) of September 22, 2022, for JROCK 1&2
(9-75) we submit the following:
Violation 1: Vegetative cover: Permit Condition 11.2.
The farmer that leases my spray fields was unable to plant millet and planted another grass. I did not
notify my technical specialist to change my CAWMP to reflect the different crop that was planted. My
summer crop has been harvested and my winter annual overseed was planted on October 12, 2022. See
the crop yield records enclosed regarding harvest and yield. My technical specialist, Curtis Barwick, has
confirmed the suitability for a millet/rye rotation as I had previously planned. In the event anything
changes my planting plans in the future I will make certain to have an amendment made to my CAWMP.
Violation 2: Failure to install a rain -breaker on my irrigation pumps. Permit condition 11.24.
I forgot to have a rain -breaker installed on my irrigation pumps. My technical specialist's staff installed
these devices immediately after the inspection in August (see attached bill). As an aside, we are present
almost always when we are irrigating but I realize I confirmed I would install these devices. It was an
oversite on my part.
We regret that this incident took place and we will be much more attentive to crop condition and viability. If
