JAY ZIMMERMAN Director Based on the reported Monthly Average effluent flow of 21.9 MGD for November 2015 for the subject facility, the Division is notifying you that Effluent Limitations and Monitoring Requirements will transition to the phased Effluent Sheet A (2) with a Monthly Average flow limit of 26.5 MGD, effective February 1, 2016. Please note that the transition language from 24 to 26.5 MGD came directly from WSACC/Van Rowell (see attachment, 2pages). It would be difficult to make a change now and justify that to EPA and potential third parties. I would recommend that WSACC submit a request for Monitoring Frequency Reduction with updated data in accordance with Exceptionally Performing Facilities guidance in 2016. I am sending this email on behalf of Thomas Hahn with the Water and Sewer Authority of Cabarrus County (WSACC) to request a short teleconference call on either the afternoon (after 2:00 pm) of Dec 7th or Dec 8th. As you may recall, Hazen performed a rerating study at the Rocky River Regional WWTP (NPDES Permit No. NC0036263) in July of 2011 in which the plant was rerated from 24 to 26.5 mgd. A letter was prepared by the NPDES Permitting Unit (refer to attached) that approved the rerating study and established a flow trigger (21.6 mgd max month flow) when the limits would change from 24 mgd to 26.5 mgd. During the months of October and November, the Rocky River Regional WWTP received above average rainfall to the extent that the average month flow for November was 21.9 mgd. However, the annual average flow to date to the plant is only 16.4 mgd. WSACC would like to discuss if the flow trigger could be increased so that limits remain at the 24 mgd flow condition. I have discussed this with both Ken Pohlig and Ron Berry, and WSACC has had discussions with the Mooresville Regional Office. Ron did indicate that a change would require a major permit modification and that the effluent limits would have to remain at the 26.5 mgd flow condition due to EPA anti -backsliding regulations. However, I believe there are some additional monitoring requirements that WSACC would like relief from if at all possible. Our review of the 26.5 mgd effluent limitations information that was provided indicated that these limitations would become effective upon formal approval by DWQ Construction Grants and Loans of the re -rating report/technical documentation. Although not provided for, it was our understanding that the 26.5 mgd effluent limitations would be phased in, and the current 24.0 mgd effluent limitations would remain effective for a given period of time based on the current permitted flow of 24.0 mgd. You stated that this would need to be requested, but felt that this could be drafted into the modified permit. Therefore, it is requested that the 26.5 mgd effluent limitations become effective when the plant effluent flow equals 21.6 mgd on a maximum month basis, which represents 90% of the current 24.0 mgd permitted flow. I wanted to verify with you if the 21.6 MGD is a (1) time maximum monthly average or if there is any additional guidance you may provide. I have also provided the previous (2) years of flow data indicating that we have remained well below 21.9 MGD until the highest rainfall to date for November occurred. I have attached the rainfall/monthly flow spreadsheet for your review. Please note the November 2015 rainfall & Flow are based on 11/29/2015 and will change slightly. I really appreciate any input and guidance you may provide. Please review the below email regarding the WSACC Rocky River WWTP. As you can see in their attachment of previous monthly average flows, they have been consistently below the 21.6 MGD flow tier limit in their permit; however, they will be above this average for November due to the above normal rainfall events. Also take a look at the attached permit cover letter page and the actual limitation page and let me know what you think....should they go to the next flow tier due to one monthly average flow being above 21.6 MGD, or should this be based on multiple months? Teresa R. seems to think it only takes a single month. Thanks for any help in this.
