Dear Mr. Cummings:
Division personnel have reviewed and approved your application for minor modification of the subject permit.
Accordingly we are forwarding the attached modified permit page. Please remove the existing "Effluent
Limitations And Monitoring Requirements" page and replace it with the one attached to this letter.
This modification removes the effluent monitoring requirement for cadmium. The modification was based upon
the following factors: 1) your statement that the flow to the WWTP is 100% domestic, with no contributions
from industrial discharges, and 2) a reasonable potential analysis based upon effluent data submitted by the
facility was conducted, which showed the discharge exhibited no reasonable potential to cause the water quality
standard for cadmium to be exceeded in the receiving stream.
This modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated
October 15, 2007 (or as subsequently amended).
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by the Division
of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that

2. The monthly average effluent BOD5 and Total Suspended Solids concentrations shall not exceed 15 percent of
the respective monthly average influent value (85% removal).
3. Total Residual Chlorine compliance is required for chlorine or chlorine derivative used for disinfection. The
Division shall consider all effluent TRC values reported below 50 ug/l to be in compliance with the permit.
However, the Permittee shall continue to record and submit all values reported by a North Carolina certified
laboratory (including field certified), even if these values fall below 50 ug/l.
4. Chronic Toxicity (Ceriodaphnia) P/F at 1.7%; January, April, July, and October. See Special Condition A.(2.) of
this permit. Quarterly sampling shall be conducted at the same time as metal and other effluent parameters
sampling is conducted.
5. See Condition A. (3.) of this permit.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

The Town of Pembroke is requesting a minor permit modification of NPDES Permit NC0027103. The Town
of Pembroke wishes to remove cadmium as a monthly monitoring requirement.
The current permit went into effect October, 2009. Since that time Pembroke has performed 14cadmium
analyses that were all less than the detection level. In fact all cadmium analyses dating back to 2005 have been
below detection. Our waste stream is 100% domestic and we have no industrial dischargers.
In light of the above data we are requesting that the cadmium monitoring be removed. Over the life of the
permit approximately $3400 could be allocated to maintenance or the purchase of new equipment, which is vital
to daily wastewater treatment, especially small systems. The current economy has forced Pembroke to search
all avenues for efficiency and still fulfill all obligations.
