DWR has reviewed the LIBR application you submitted on January 9, 2014 in reference
to BD- 5103X; replacement of Bridge No. 202 over Sills Creek (C Sw) on SR 1325 in
Pender County. DWR has determined that the proposed impacts are eligible for
authorization under WQC 3883, which correspond to the Nationwide Permit 3 issued by
the Corps of Engineers. Based on the proposal submitted by NCDOT this project does
not meet any of the thresholds listed in this certification and therefore does not
require written authorization'from DWR. However, you should acquire any other
federal, state or local permits before you proceed with your project including (but
not limited to) Sediment and Erosion Control, Non - Discharge and Water Supply
Watershed regulations. This approval will expire with the accompanying 404 permit.
For this approval to remain valid, you must adhere to all conditions listed in the
attached certification. Furthermore, the project must be constructed in accordance
with the provisions of the NCDOT's National Pollutant Discharge Elimination (NPDES)
Stormwater Permit NCS000250, including the applicable requirements of the NCGO1000.
Should your project change or if you determine that you cannot meet one of the
conditions of this certification, you must notify the DWR and acquire approval
before work begins.
