McLawhorn,Chairman The Neuse River Compliance Association PO Box 1410 Clayton,North Carolina 27528-1410 Subject: Modification of Permit No. NCC000001 Neuse River Compliance Association Dear Mr. McLawhom: The Division has reviewed the Association's November 6,2012,letter requesting modification of its NPDES permit and is forwarding herewith the revised pages of the permit(cover sheet and Appendix A).This minor permit modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency,dated October 15,2007. Please insert these revised pages in your current permit and discard the corresponding pages. The revised Appendix A reflects the following changes for calendar year 2013: • Addition of CWS Systems,Inc.,Fairfield Harbour WWTP as a co-permittee member of the NRCA, as requested.The facility brings with it an estuary TN allocation of 11,263 lb/yr and is located in the 100% transport zone. • The transfer of 2,445 lb/yr estuary TN allocation from SGWASA to the City of Raleigh's Neuse River WWTP.The parties' individual permits have been modified to reflect this transfer,effective January 1,2013. • Recalculation of the Association's Estuary TN Allocation and Limit in light of the above changes. With these adjustments,the Association's Estuary TN Allocation and Limit increase from 1,184,165 lb/yr to 1,195,428 lb/yr effective January 1,2013. All other terms and conditions contained in the original permit remain unchanged and in full effect. If any parts of this permit modification are unacceptable to you,you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. (2) In joining the NRCA,CWS Systems,Inc.agreed to lease 1,000 lb/yr estuary TN for 2013 and 2014.The leased amount is part of the 24,400 lb/yr Burlington Industries allocation.Allocation leased to CWS Systems,Inc.and others shall not exceed the Burlington Industries allocation. (3) Progress Energy's Lee Steam Plant is allowed a baseline TN load of 3,260 lb/yr at its Outfall 001(2,282 lb/yr at the estuary).Progress has leased additional allocation from the NRCA to ensure coverage for TN discharges from its new Rotamix system from 2009 through 2013.The allocations listed in this table and the amounts to be reported by Progress under this permit pertain strictly to any load in excess of the baseline allowance.The table does not reflect the lease amount(9,000 lb/yr for 2009),in part because the amount of the lease will vary from year to year.Allocation leased to Progress Energy and others shall not exceed the 24,400 lb/yr available in the Burlington Industries allocation. ATM Fact Sheet - NPDES Permit NCDENR Neuse River Compliance Association NORTH CAROLINA DEPARTMENT OF NPDES No. NCC000001 ENVIRONMENT AND NATURAL RESOURCES Addendum - CY2013 Modification - Final PERMIT ACTION By its letter of November 6,2012,the Neuse River Compliance Association requested modification of its NPDES permit to reflect(1)the addition of one co-permittee member and(2)one transfer of nitrogen allocation between two members.The Division agreed with the request and issued the modification on December 12,2012,to become effective on January 1,2013.The revisions affect only the permit cover page(issuance date)and Appendix A of the permit.The permit's expiration date remains at December 31,2013. SUMMARY OF CHANGES The revised Appendix A reflects the following changes for calendar year 2013: • Addition of the CWS Systems,Inc.,Fairfield Harbour WWTP as a co-permittee member with a base estuary allocation of 11,263 lb/yr and a transport factor of 100%. • The transfer of 2,445 lb/yr TN from SGWASA(NC0026824)to the City of Raleigh Neuse River WWTP(NC0029033). • Recalculation of the Association's Estuary TN Limit in light of the above changes. CWS Systems,Inc.agreed to lease 1,000 lb/yr TN from the NRCA for two years as a condition of its membership.At the Association's request,and consistent with the handling of Progress Energy's lease (up to 9,0001b/yr),the value is entered as zero in Appendix A.The one caveat is that the two leases cannot exceed the 24,400 lb/yr allocation held by the NRCA.Given the surplus allocation generated by the Association,this will have no impact on its compliance with the permit. With these changes,the Association's Estuary TN Allocation increases from 1,184,165 lb/yr to 1,195,428 lb/yr effective January 1,2013. ---end of fact sheet addendum--- 12/23/2010
