The Division of Water Quality (the Division) hereby issues the attached NPDES permit for the
subject facility. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated May 9, 1994, or as subsequently amended.
RENEWAL SUMMARY
The Division's renewal evaluation includes a reasonable potential analysis (RPA), in
accordance with permitting guidance provided by the EPA. The Division has made the
following decisions based on current information and data from your discharge Monitoring
Report (DMRs) submitted over the last permit cycle:
• Turbidity — Outfall 001 added limit of 50 NTU; Outfall 002, continue
monitoring, no limit.
• Benzene — Outfall 001: retained permit limit (1.19 µg/L) and monthly
monitoring; Outfall 002: continue monthly monitoring, no limit.
• Toluene — Outfall 001: added permit limit (11 µg/L) and monthly monitoring.
Outfall 002: continue monthly monitoring, no limit.
• Phenol — Outfall 001: revised limit to 91 µg/L. Outfall 002: deleted limit;
continue monitoring (see note).
• MTBE — Outfall 001: retained monthly monitoring. Outfall 002: relax
monitoring to quarterly.
• Naphthalene — Outfalls 001 and 002, added monthly monitoring (see note).
• EPA Method 625 — Outfalls 001 and 002, deleted from permit (see note).

Changes to the Draft Permit - Naphthalene and Laboratory Method EPA 625. Because
monitoring by EPA Method 625 detected no parameters, the Division has removed this
monitoring from the permit, in accordance with SOP 2005. Instead, the Division has added the
single parameter, Naphthalene with monthly monitoring to detect heavier fuels such as diesel.
These changes were inadvertently omitted from the draft permit.
Revised Phenol Limit and Minimum Detection Levels. The Division acknowledges Motiva's
request (17Apr06) to reconsider the phenol contribution of Outfall 002 to be zero, and to
recalculate the permit limit at 001 using the full site allocation. Because data showed no
reasonable potential at Outfall 002, the Division has no objection to this request. Therefore,
using 0.48 lbs./day, the Outfall 001 limit has been revised to 91µg/L. It follows then, that the
previously submitted laboratory minimum -detection level of 50 µg/L is sufficiently sensitive to
accommodate this limit. The Division therefore retracts its request for a more sensitive test
procedure (see draft -permit cover letter).
_If any parts, monitoring frequencies, or sampling requirements contained in this permit are --
unacceptable to you, you have the right to an adjudicatory hearing, upon written request, within
thirty (30) days following receipt of this letter. You must submit this request in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and file it
with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina
27699-6714. Unless such a demand is made, this permit shall be final and binding.
Please notice that this permit is not transferable except after notifying the Division of Water
Quality. The Division of Water Quality may modify, or revoke and reissue this permit. This
permit does not affect your legal requirements to obtain other permits required by the Division of
Water Quality, the Division of Land Resources, the Coastal Area Management Act, or other
federal or local governments.

accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
II, III and IV hereof.
This permit shall become effective June 1, 2006.
This permit and authorization to discharge shall expire at midnight on June 30, 2010.

Therefore, the exclusive authority to operate and discharge from this facility arises under the permit

1. 1. Flow — During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring
Report (DMR) indicating "No discharge." The Permittee shall monitor each discharge event in
one of four ways:
a) measure flow continuously;
b) calculate flow based on total rainfall per area draining to the outfall; (this method of flow
measurement should not be used for facilities with large runoff -collection ponds);
c) estimate flow at 20-minute intervals during the entire discharge event; or
d) report flow based on discharge pump logs.
2. Turbidity — Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving
stream background turbidity exceeds 50 NTU, effluent shall not cause this background value to
increase.
3. Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed from
the surface of a quiescent (calm water) zone.
4. MTBE — Please see Part A.(4.) for other MTBE requirements.
5. Acute Toxicity (Fathead Minnow, 24-hour), Annual [see Special Condition A.(3)]. Samples
for Acute Toxicity shall be collected concurrent with BTEX sampling.
> The Permittee shall discharge no floating solids or foam visible in other than trace amounts.
> The Permittee shall discharge directly no tank solids, no tank bottom water, or tank rag layer.
Following hydrostatic testing, the Permittee shall discharge no tank (or pipe) wastes containing benzene
concentrations exceeding 1.19 µg/L, or toluene concentrations exceeding 11 µg/L.

EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A. (3.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)
24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste
treatment. The Permittee will conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit. The annual test requirement must be performed and
reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the-Etiluent Discharge Form—(MR-1)-fof the month in whichit was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

SPECIAL CONDITIONS
A. (3.) MTBE MONITORING - SPECIAL CONDITION
For the protection of public health, oil terminal Permittees that discharge to waters classified as
water supply (WS waters) shall monitor MTBE for the duration of this permit. Based on data
submitted by the Permittee, the Division has reduced Monthly monitoring to Quarterly. If MTBE is
detected during this permit cycle, the Permittee shall immediately resume Monthly monitoring for
MTBE.

Phenol Calculation. T e ivision evaluated the need for permit limits for phenol by
dividing the "per dis ar er" allocation (0.48 lbs./per day) equally by Permittee's total

Revised At the Permittee's Request. Because data showed no reasonable potential at
Outfall 002, the Permittee requested that the Division consider the contribution of 002 to
be zero, and that the Division recalculate the permit limit for 001 considering the full site
allocation. The Division agrees that this is reasonable.
Therefore, the draft phenol limit at Outfall 001 (40 µg/L) has been recalculated for the
final permit using the "per site" allocation (0.48 lbs./per day):

Considering this revised phenol limit of 91 µg/L, the Division will retract the request for

revised limit, a lab method detection level of 50 µg/L is sufficient for effluent
monitoring.

Waste Load Allocation (WLA) and Bulk -Storage SOP. A Waste Load Allocation was last conducted in
April 1993, when the receiving stream, Long Creek [11-210-(2.5)], was classified WS-IV waters. {BIMS:
This discharge location is mis-located as receiving -stream segment [11-210-(0.5)] and should be
corrected.} The WLA recommended monitoring for benzene, toluene, ethylbenzene, xylene, lead, 1,2,
Dichloroethane, and MTBE including permit limits. The Division established new effluent limits and
monitoring requirements for the previous permit following Requirements for Discharges from Oil and
Petroleum Storage Facilities (SOP 2001, version 30Ju101).
PERMITTING STRATEGY
New SOP for Oil Terminals. The Division established renewal criteria for this permit according to the
NPDES Permitting Requirements for Petroleum Bulk -Storage 2005 Permitting Strategy, version September 9,
2005 (2005 SOP). This document recommends 12 criteria for renewal including reasonable potential analyses
(see Renewal Summary). Database for this RPA is attached to this document.
Reasonable Potential Analysis (RPA): The Division conducted a reasonable potential analysis according to
EPA guidelines in order to establish potential for a given parameter to exceed its water quality stream
standard. The Division established a list of parameters of concern (POCs) based on the previous permit. These
parameters include benzene, toluene, turbidity, and MTBE. In addition, the Division calculated phenol limits
appropriate for a discharge to water supply (WS-IV) waters considering a total of eight discharges to this
water shed (see 2005 SOP, item 11).

Concerning Benzene and Toluene. The Division considered the standards for benzene (1.19 µg/L) and
toluene (11 µg/L) in its evaluation of reasonable potential (RP). The Permittee reported benzene at Outfall
001 in excess of the standard twice during the permit cycle (1.8 µg/L in Dec02, and 3.4 µg/L in Aug04),
clearly indicating RP. Therefore a permit limit for benzene (1.19 µg/L) will be added to Outfall 001. Similarly,
toluene was detected in Dec02 (99 AWL) and again in Aug04 (3.4 µg/L) at Outfall 001 and will therefore
require a permit limit. Neither benzene nor toluene was detected at Outfall 002.
Phenol Calculation. The phenol limits calculation considers the phenol allowable mass loading (0.48
lbs/day) for all terminals discharging to WS waters in the Paw Creek area. This allowable wasteload is further
divided herein by 2 (the number of outfalls, per SOP 2005). For this permit, therefore:
Outfall 001 Highest flow = 0.630 MGD (May03)
Outfall 002 Highest flow = 0.312 MGD (Sep03)
001 = 0.24 lbs./day x 1
8.34 0.63 MGD
002 = 0.24 lbs./day x 1
8.34 0.31 MGD
0.04 mg/L = 40 µg/L
0.09 mg/L = 90 µg/L
The Division used the above loadings (in AWL) to evaluate reasonable potential at Outfalls 001 (40 µg/L) an
002 (90 µg/L). However, since the Permittee reported phenol at a level of 72 µg/L (Nov04) at Outfall 001,
reasonable potential is clearly present. Because phenol was not detected during the entire permit cycle at
Outfall 002, there is no reasonable potential at this outfall (method detection level 50 AWL). Therefore, the
Division will retain a limit at Outfall 001 (40 µg/L), but continue with monitoring only at Outfall 002 (no
permit limit).
Concerning MTBE. The Permittee detected MTBE at a level of 74 µg/L (Dec02) at Outfall 001, but not at
Outfall 002. Therefore, monthly monitoring will continue at 001 but will be relaxed at 002 to Quarterly, in
accordance with SOP 2005.
Concerning Whole Effluent Toxicity (WET) Testing. This facility has "passed" annual toxicity testing for
the last five years (LC-50 >100). No changes to the permit recommended.
RENEWAL SUMMARY
• Turbidity (Outfall 001: RP = Yes; max predicted 231.50 NTU; n = 19); add permit limit of
50 NTU. Outfall 002: RP = No; continue monitoring, no limit.
• Benzene — (Outfall 001: RP = yes) retain permit limit (1.19 µg/L) and monthly monitoring.
Outfall 002: RP = no; continue monthly monitoring, no limit.
• Toluene - (Outfall 001: RP = yes) add permit limit (11 µg/L), monthly monitoring. Outfall

appreciate the opportunity to review the Fact Sheets and to comment on the draft NPDES permits for
Motiva's Charlotte North Terminal (NC0022187) and Charlotte South Terminal (NC0046892): The
comments below regard the Charlotte South permit. I have no comments for Charlotte North.
1. On the Facility Location Map, Outfall 002 should be spotted at the Northwest corner of the facility,
adjacent to Outfall 001.
2. Motiva respectfully requests the DWQ to reconsider the basis of the proposed phenol limit for Outfall
001, which represents a 55% reduction from the current limit. The Fact Sheet indicates that the proposed
limit is based on the allowable (phenol) wasteload divided by the number of outfalls. The Fact Sheet goes
on to state that phenol was not detected during the entire permit cycle at Outfall 002, therefore there is no
reasonable potential (of phenol) at this outfall.
Since there is no reasonable potential of Outfall 002 exhibiting phenol, Motiva requests that its contribution
to the facility phenol wasteload be considered as zero. Motiva believes that such an approach is also
consistent with guidance previously provided by DWQ regarding the completion of DMRs. Such guidance
has instructed operators to consider analytical results that are less than the detectable limit to be
considered zero for calculation purposes.
Should the DWQ accept Motiva's proposed methodology, the phenol limit would remain unchanged at 90
ug/I.

SUBJECT: Revised Guidance to Permit Writers — Allowable Phenol Loads for Bulk
Oil Terminals in the Paw Creek Area, Catawba River Basin.
As part of the newly revised Standard Operating Procedures — Permit Requirements for
Discharges from Oil and Petroleum Storage Facilities (SOP-2001), the Division has
recalculated the allowable load for phenol. New numbers are appropriate for bulk oil
distribution terminals discharging to an unnamed tributary of Gum Branch (WS-IV) and an
unnamed tributary of Long Creek (WS-IV CA), both within subbasin 030834. This document
affects eight (8) permitted facilities discharging to WS waters (see Table 1).
I have made these calculations considering the following background and assumptions:
1. The water quality stream standard comes from the EPA Document Ambient Water
Quality Criteria for Chlorinated Phenols. This standard has been included in the North
Carolina 2B .0200 Rules and has been applied to Water Supply (WS) waters since 1990.
2. The standard for chlorinated phenolic compounds is 1.0 µg/L. Although it is unlikely
that petroleum bulk storage facilities would discharge chlorinated phenolic compounds,
they may discharge phenol. Therefore, the Division is concerned that phenol (at levels of
1 µg/L or greater) has potential to create "daughter compounds" at downstream water
intakes where water is drawn from the river and chlorinated. It is therefore appropriate to
calculate allowable phenol load near the closest water intake downstream of these bulk
storage facilities.
3. I have applied the 30Q2 flow because the standard is based on potential aesthetic
concerns (taste and odor associated with chlorinated phenols in fish and drinking water).
I have applied the standard (1.0 µg/L) near the confluence of Long Creek and the
Catawba River (approximately 1,000 feet upstream) where the Division calculated 30Q2
flow at 716 cfs (based on Clariant Corporation's 1996 WLA, NC0004375). Therefore,
the allowable wasteload for each of nine (9) dischargers is calculated:
716 cfs x 0.001 mg/L x 8.34 = 3.851bs./day total phenol

Highway 27 (Freedom Drive) approximately three (3) miles to Old Mt. Holly Road.
Motiva Enterprises is located on the left at the intersection of Old Mt. Holly Road and
Freedom Drive.

PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS

Stormwater discharge from the tank farm area is intermittent depending on rainfall.
The permitted discharge from the Groundwater remediation system and the truck
loading rack stormwater is 0.058 MGD.

treatment facilities: The existing groundwater treatment facilities consist of an
oil/water separator, an air stripper, two flocculation tanks, a clarifying basin,
carbon filtration and a holding tank. The wastewater treatment at the
loading/unloading area consists of an oil/water separator and a holding tank.
Wastewater from the holding tank is routed through the groundwater remediation
system. There are two outfalls from the facility. Outfall 001 consists of
stormwater discharges from the tank farm area and outfall 002 consists of treated
groundwater and stormwater discharges from the loading rack area. Outfall 001
and 002 are situated within a couple of feet of each other.

exists at the site. Hazardous material stored at the site may be a constant threat to the
groundwater. Air Quality Permits are issued by Mecklenburg County.
PART IV - EVALUATION AND RECOMMENDATIONS
The Permittee, Motiva Enterprises, is requesting NPDES Permit renewal for the discharge
of treated groundwater and stormwater. A review of the past hear's self -monitoring data, from
02/04 through 01/2005, revealed no violations.
It is recommended that the NPDES permit for this facility be renewed pending review by the
Groundwater section.

Motiva Enterprises LLC — Charlotte South Terminal is hereby requesting renewal of NPDES Permit
NC0046892. The subject permit expires on June 30, 2005. Some enhancements have been made to
the groundwater recovery system since the last permit that have increased water flow to Outfall 002;
however, no physical changes were made to the wastewater treatment components at the facility.
The Charlotte -South Terminal does not generate sludge as part of wastewater discharge; therefore no
sludge management plan is necessary for this facility.
As requested please find enclosed the following items:
• Cover letter requesting renewal of permit and documenting any changes at the facility since
issuance of the last permit including a narrative description of the sludge management plan if
applicable. (One signed original and two copies);
• Completed NPDES Permit Application — Short Form C, included as Attachment A (One signed
