Paul Wilms Director In response to your permit application for plant expansion received on July 24, 1987, an application review was started by the Division of Environmental Management. Since the proposed discharge is into waters classified as drinking water supply, this Division requires the approval of the Division.of Health Services before we can issue a permit. This is in accordance with North Carolina General Statute 143-215.1(a) (copy attached). In response to your application, the Division of Health Services has informed this Division (copy attached) that they cannot concur with the issuance of this permit for the plant expansion. Therefore, please be advised that we are required to deny your application for plant expansion. If this decision is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statues, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604.
