Eric and Rob,

The contractor has recently conducted clearing operations on the project. A recent post-clearing review of the project
revealed significant bank instability along most of the west stream bank. I have attached a photograph that depicts an
area along the west bank. It appears that this bank scour/failure must have happened at the site within the last year
and is completely not associated with our project.

An on-site meeting was held on December 8, 2014 with members of the Design Build team (including the hydro
engineer) to evaluate the area and determine how to properly stabilize the bank to provide long-term stability. The DB
team has proposed to re-grade these unstable areas and stabilize with Class II rip rap. Revised stream/wetland permit
drawing package is attached to this email.

This will result in an additional 56 linear feet of permanent stream impact. It appears that this activity can be permitted
without further notification using Section 404 Nationwide Permit 13 and Section 401 WQC 3885. Please advise if you
agree with this assessment.
