CAMAMajor Permit Application Narrative
October 12, 2022
The Bridge Pointe Harbour Owners (HOA) represents a small 20 home subdivision along the Trent River
in Township 7 in Craven County, North Carolina. Ten properties are waterfront properties, and as such
are able to enjoy all the beauty, natural resources and recreation afforded to waterfront living. The
remaining 10 properties do not have waterfront views or access.
The HOA owns and maintains severalcommon areas in the subdivision to ensure residentsafety and
maintain the landscaping. In addition, the HOA owns a waterfront property (parcel# 7-002-042) which
is adjacentto the Alfred Cunningham Bridge and currently has a paved driveway, cul-du-sac, small
parking area, boat ramp and small wood dock for use bythe non -waterfront propertyowners.
There is an easementfrom the HOAwaterfront propertyto an adjacent community wood dockthat was
built by the original subdivision developerin frontof, and within the riparian zone, of the adjacent
private residence. The wood dock hasfallen in disrepair and needsto be replaced. The HOA desiresto
replace the existingdock, but the current property owner does notwish, and will not approve installing
a new community dock within his riparian area. The HOA and adjacent propertyowner have reached an
agreementto remove the existing dock from his riparian area, and remove the easement across his
propertyfortheexistingdock. In exchange the HOA has decided to build a newcommunity dock within
the property and riparian area owned bythe HOA, and the adjacent property owner will approve and
allow the dockto be built without objection.
We therefore respectfully request approvalfora new, replacement dockto be built on our property and
within our riparian zone. The existing boat ramp and seawall will remain, but the existingsmall wood
dock will be removed. Additionally, the existing large community dock located in frontof the adjacent
propertywill also be removed. The neteffectof these changes will be little to no long-term
environmental impactdue to removing, relocating and building a similarly size d structure. There is also
less impact on navigational channels and recreational boating due to the shorter length dock and being
located closerto the bridge.
This change would also bring an existing non -conforming dock into compliance with the new dock, not
to mention improving community relations with the adjacent propertyowners. This new 10 slip dock
with boat lifts will allow all subdivision residents equal opportunities to enjoy all the beauty, natural
resources and recreation of Eastern North Carolina.

Background
On April 6, 2022, the United States Supreme Court issued an order staying a lower court's vacatur of the
Trump Administration's 2020 "Clean Water Act Section 401 Certification Rule" ("Federal Rule"). As a
result of the United States Supreme Court order, the Trump Administration's Federal Rule has sprung back
into effect.
The Trump Administration's Federal Rule imposes additional procedural requirements on applicants for 401
Certifications and on DWR's processing of those applications. One requirement is that 401 applicants must
request a pre -filing meeting request at least 30 days prior to submitting their 401 application. [40 C.F.R.
§121.4] In turn, the Federal Rule requires that applicants include documentation of their pre -filing meeting
request in their 401 Certification application. [40 C.F.R §121.1; 40 C.F.R. §121.5]. Please refer to
the Federal Rule for more information.
Per 40 CFR §121 and §121.5, a 401 Certification application that does not include the required pre -filing
meeting request documentation does not constitute a "certification request." As a result of the
reinstatement of the Trump Administration's Federal Rule, all 401 applications received after April 6, 2022
that do not have documentation that a pre -filing meeting request was submitted at least 30 days prior to
submittal of a 401 Certification application will be returned as incomplete.

Boat Ramp and the Dock shown and delineated on the
aforesaid map and extending from the 0.36 acre Common Area

2. A non-exclusive, perpetual pedestrian right of way and
easement over the area depicted as "8' Pedestrian Easement" on
the aforesaid map for the purposes of pedestrian only ingress,
egress and regress to and from the 0.36 acre Common Area to
and from the Existing Dock as shown and delineated on the
aforesaid map, reference to said map being hereby made for a
more perfect description of said easement.
3. The Existing Dock extending from the common line between
Lots Nos. 17 and 18 as shown and delineated on the aforesaid
map westwardly into the Trent River.
The Common Area (including the 0.36 acres tract, the 0.56 acres
tract, the Boat Ramp and the Dock), Shoreward Lane, Bridge
Pointe Drive, the 8' Pedestrian Easement and the Existing Dock are
conveyed together with and subject to the provisions and
restrictions of the Declaration of Covenants recorded in

"Declaration") and are Common Area and Limited Use Common

Narrative Description:
The proposal is within the Trent River adjacent to 98 Bridge Pointe Drive in New Bern, Craven
County. This property is currently developed with a boat ramp, staging pier, bulkhead, and asphalt
driveway. This proposal is for private use by the residents of the subdivision. The adjacent property
to the north is NC Hwy 70W and the adjacent property to the south is a private residence. There is an
existing 10-slip docking facility approximately 75' to the southwest that straddles the property line of
two private residential properties.
The elevation of the high ground on the property is approximately 7' above the normal water level.
Vegetation on the property mainly consists of lawn grasses. There is approximately 105' of shoreline
on this 0.36-acre lot.
Water depths in the project area range from —1.5' to —10.0' nwl. The subaqueous substrate is firm
without shell. There is not a Federal Channel in the nearby vicinity of the project area. There is not a
cultural resource in the project area. This waterbody is approximately 2,000' across at this location.
These estuarine waters are not classified as a Primary Nursery Area. Submerged aquatic vegetation
(SAV) was not observed, however historical data indicates the potential for this critical habitat. This
waterbody is closed to shellfish harvest and is classified as SB; Sw, NSW. This proposal is located
within the Neuse River basin.
Proposed Development:
The applicant is proposing to relocate an existing 10-slip docking facility approximately 80' to the
northeast within the Trent River. This proposal would also involve removal of the staging pier
adjacent to the boat ramp. The proposed pier for the 10-slip docking facility would serve as the
staging pier for the ramp. This proposal is located at 98 Bridge Pointe Drive near New Bern, Craven
County. This proposal would be for private/community residential use.
The applicant is proposing to demolish the existing 10-slip docking facility located adjacent to the
shared riparian property lines of 102 & 100 Bridge Pointe Drive and reconstruct this 10-slip
community dock on the north side of the existing boat ramp at 98 Bridge Point Drive. The applicant
is proposing to also remove the existing staging pier on the south side of the boat ramp as a part of
this project.
The proposed fixed pier for the 10-slip docking facility would be 6' wide and 130' long. At the
waterward terminus of the pier would be a 10' wide by 52' long "T" platform. The ten boat slips
would be supported by four 3' by 20' finger piers and twelve tie pilings to be accessed from the fixed
pier. Typical four -piling 14' by 14' boat lifts are proposed within each of the ten boat slips.
Anticipated Impacts:
This proposed 10-slip docking facility would be for private/community residential use. This docking
facility extends approximately 140' waterward. It would not extend beyond the existing 10-slip
docking facility alignment. The Trent River is approximately 2,000' across at this location. The

proposed docking facility would usurp 7,140 square feet of Public Trust waters.
Traditional construction methodology would be utilized during the construction of this project.
Turbidity impacts are not anticipated during the construction activities within the Trent River. This
waterbody is not classified as a Primary Nursery Area. Historical data indicates that there may be
SAV present within the project area. This waterbody is closed to shellfish harvest. There is not a
Federal Channel in the nearby vicinity of the project area.
