In accordance with your application for discharge permit modification received on August 2, 1993, we
are forwarding herewith the subject State - NPDES permit. This permit is issued pursuant to the requirements
of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the US Environmental Protection Agency dated December 6, 1983. In response to your letter of February 1,
1994, regarding your draft permit, the following NPDES permit comments are for your clarification. They
are in the same order as the February letter.
a.) The general comments of the mailing address and the three sources of outfall 002 have been noted and
changes have been made accordingly. The sources have been added to the effluent page for outfall 002 for
further clarification.
b.) According to the Division's Certification and Training unit, a groundwater remediation unit is
automatically considered a class I facility. However, at this time, groundwater remediation facilities do not
need to have a certified operator. This is because the Division is in the process of developing a training class
for this type of facility. This class will certify operators for groundwater remediation systems. Until the
development process is complete, no certified operator is required.
c.) Outfall 001 requests - Oil and grease and settleable solids have been reviewed for the reduction of the
monitoring requirements. Due to the state requirements and the sensitivity of the area, the frequencies will
remain the same. Also, the request for toxicity testing elimination will not be granted. However, because
previous required episodic tests have been passed, the previous testing requirement has been removed and
replaced with an annual acute toxicity test.
d.) Outfall 002 requests - Oil and grease and pH are monitored at the twice per month frequency. This is
the standard frequency for this type of discharge and will remain.
The state standard for benzene in a water supply waters is 1.19 µg/1 as is the limit which was given to
this facility. This limit was established to protect human health. Therefore, the limit will remain at 1.19 µg/l.
The Division will agree to review the permit requirement for the whole -effluent toxicity test upon permit
renewal in 1996.
e.) With this NPDES application, an authorization to construct (ATC) request was also included. It was for
the new groundwater remediation system which included an air stripper and activated carbon system. Is this
system still the intended system? If not please submit the correct system with all the necessary plans and

specifications with PE stamps if individually designed. Also, in a previous letter, DEM stated that the ATC
will be retained in house and be issued with the NPDES permit providing the ATC application fee of $150.00
was sent in. As of February 21, 1994 the fee had not been sent in. DEM will keep the ATC request in-house
for two weeks from the date of this letter. If no fee is sent in with a letter confirming what was requested,
then the package will be returned.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicative hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer
27447, Raleigh, North Carolina 27611 -7447. Unless such demand is made, this decision shall be final and
binding.
Please take notice this permit is not transferable. Part II, E.4. addresses the requirements to be followed
in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Environmental Management or permits required
by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local governmental
permit that may be required.

Parts I, II, and III hereof.
This permit shall become effective April 1, 1994
This permit and the authorization to discharge shall expire at midnight on August 31, 1996

SUPPLEMENT TO PERMIT COVER SHEET
Shell Oil Company
is hereby authorized to:
1. Continue to discharge stormwater from outfall 001 at an oil terminal facility located at Charlotte
Terminal, NC Highway 27, Thrift Community, Mecklenburg County (See Part III of this
Permit), and
2. After receiving an Authorization to Construct from the Division of Environmental Management,
construct a groundwater remediation system and discharge from outfall 002 treated groundwater,
tank condensate, and hydrocarbon contaminated stormwater from the truck loading rack, and
3. Discharge from said treatment works at the location specified on the attached map into an unnamed
tributary to Long Creek which is classified Class WS-IV waters in the Catawba River Basin.

During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is authorized to discharge from

Samples taken in compliance with the monitoring requirement specified above shall be taken at the following location(s): the nearest accessible point after
final treatment but prior to actual discharge to or mixing with the receiving waters.
Monitoring will be conducted during normal work hours. The facility shall record the appropriate time the discharge begins and stops during a discharge
period.
This Permit imposes no limitation of the discharge of storm water runoff uncontaminated by any industrial or commercial activity and not discharged
through any oil/water separator or other treatment equipment or facility.
** The discharger shall record the approximate times that discharge began and ended, along with the instantaneous flow at the times of effluent sampling.

The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored 2/month at the effluent by grab samples.

BTEX parameters should be monitored using an EPA -approved method to a detection level of 1 ppb. The monitoring for the above listed parameters
should coincide with all whole -effluent toxicity monitoring.
