Dear Mr. Funk:
Reference is made to your request for rescission of the subject NPDES permit. Staff of the
Mooresville Regional Office have confirmed that this permit is no longer required. Therefore,
in accordance with your request, NPDES permit NC0046531 is rescinded, effective
immediately.
If in the future you wish to discharge wastewater to the State's surface waters, you must first
apply for and receive a new NPDES permit. Operating a facility without a valid NPDES permit
will subject the responsible party to a civil penalty of up to $25,000 per day. Additionally, if the
facility is in the process of being sold, you will be performing a public service if you would
inform the new or prospective owners of their potential need for NPDES permit coverage.

Mr. Belnick - As a follow up to our telephone conversation, Crown Central
Petroleum Corporation is in the process of shutting down the operation at
our petroleum bulk storage facility located at 7720 Mt. Holly Road,
Charlotte, NC 28214. Work has been undertaken to remove product from all
storage tanks, pipelines, and associated equipment. We expect this work to
be completed on or about May 31, 2004. Accordingly, Crown would like to
request that NPDES Permit NC0046531 be terminated/rescinded to coincide with
the closing of this facility.
Crown has been unsuccessful in our previous attempts to sell this facility
and therefore we intend for this facility to remain inactive with empty
storage tanks/pipelines. It is our understanding that if a sales
transaction would occur subsequent to the termination of this permit, a new
owner/operator would need to submit the proper NPDES permit applications in
order to obtain a new permit. Question - Is it possible to consider the
permit as inactive until which time Crown sells the facility, wherein the
permit could be transferred to a new owner after notice to the Director.
While it is unlikely that a sale will occur, I need to explore this
possibility as it appears to be easier to transfer an existing permit then
it would be to apply for a totally new permit. I will make the assumption
that standard and special conditions would not be applicable as long as the
operation remains inactive.
Please advise if additional information is required and/or if a formal
written request should be submitted. Unless I missed it, the permit dose
not address the process for requesting termination of the permit.
