Kinder Morgan and Crown Central Petroleum Corporation mailed to your office a joint letter,
dated January 30, 2003, notifying you of plans for Kinder Morgan Southeast Terminals LLC to
acquire the above -referenced Crown Central Petroleum facility by the end of February. This
letter is to inform you that the proposed acquisition of the above -referenced facility by Kinder
Morgan Southeast Terminals LLC from Crown Central Petroleum Corporation will not take
place. Therefore, Kinder Morgan Southwest Terminals LLC will not be assuming owner or
operator responsibility for the referenced facility. Consequently, all permits associated with this
facility should remain in the name of Crown Central Petroleum Corporation and all mailings
should remain as currently listed with your agency.

As a follow up to the Crown and Kinder Morgan letter dated January 30, 2003 regarding
a potential acquisition and ownership change, this letter will serve to inform the agency
that the transaction has been put on hold for now and that the referenced facility
remains a Crown Central Petroleum Corporation owned and operated facility. Therefore
any request made by Crown Central Petroleum Corporation of the Division to transfer
the permit is rescinded. If it is determined that this transaction will again move forward,
the agency will be given proper notice.
Please advise if you have any questions and/or if additional information is required. We
thank you for the cooperation extended by the agency in this matter and look forward to
working with you in the future.
