Preliminary Determination X There are waters, including wetlands, on the above described project area, that may be subject to Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). The waters, including wetlands, have been delineated, and the delineation has been verified by the Corps to be sufficiently accurate and reliable. Therefore this preliminary jurisdiction determination may be used in the permit evaluation process, including determining compensatory mitigation. For purposes of computation of impacts, compensatory mitigation requirements, and other resource protection measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands that would be affected in any way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331). However, you may request an approved JD, which is an appealable action, by contacting the Corps district for further instruction. B. Approved Determination There are waters of the U.S., including wetlands, on the above described project area subject to the permit requirements of Section 404 of the Clean Water Act (CWA) (33 USC § 1344). Unless there is a change in the law or our published regulations, this determination may be relied upon for a period not to exceed five years from the date of this notification. We recommend you have the waters of the U.S., including wetlands, on your project area delineated. As the Corps may not be able to accomplish this wetland delineation in a timely manner, you may wish to obtain a consultant to conduct a delineation that can be verified by the Corps. The waters of the U.S., including wetlands, on your project area have been delineated and the delineation has been verified by the Corps. If you wish to have the delineation surveyed, the Corps can review and verify the survey upon completion. Once verified, this survey will provide an accurate depiction of all areas subject to CWA and/or RHA jurisdiction on your property which, provided there is no change in the law or our published regulations, may be relied upon for a period not to exceed five years. Basis For Determination: The project study area contains jurisdictional waters of the US, Buffalo Creek, with ordinary high water marks, and adjacent wetlands. Buffalo Creek is a tributary of the Little River and the Neuse River. The Neuse River is a Section 10 Water. D. Remarks: This JD was confirmed by field inspection on 5/3/2017. The drawings on the attached Figure 4, ” JURISDICTIONAL FEATURES, BRIDGE REPLACEMENT, BRIDGE NO. 216 ON SR 2366, OVER BUFFALO CREEK”, dated August 2017, generally depict the approximate boundaries and locations of potential jurisdictional waters of the US within the subject study area. Project Description: The North Carolina Department of Transportation (NCDOT) proposes bridge replacement of Bridge No. 216 on SR 2366 (Old Battle Bridge Road) over Buffalo Creek in Wake County. The purpose of the proposed project is to replace a structurally deficient bridge. Bridge No. 216 was constructed in 1957. The two-span bridge is 51 feet long with a deck width of 25 feet. The structure type is timber floor on salvaged I-Beams. NCDOT Bridge Management Unit records indicate Bridge No. 216 has a sufficiency rating of 26.64 as of February 22, 2021. Bridge No. 216 will be replaced in-place. The bridge is currently closed (closed in 2010); local traffic is diverted to an off-site detour. The proposed structure would be an 87.38-foot long two- span cored slab bridge. The bridge typical section is two 11-foot lanes with a 10-foot center turn lane, approximately four-foot bridge offset, and an eight-foot wide accommodation for future multi-use path on the south side of the bridge. The proposed design speed is 40 mph. The project length is approximately 600 feet. Northern long-eared bat The United States Fish and Wildlife Service (USFWS) has revised the previous programmatic biological opinion (PBO) in conjunction with the Federal Highway Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT fo r the northern long-eared bat (NLEB) (Myotis septentrionalis) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. Although this programmatic covers Divisions 1-8, NLEBs are currently only known to occur in 30 counties within Divisions 1-8. NCDOT, FHWA, and USACE have agreed to two conservation measures which will avoid/minimize mortality of NLEBs. These conservation measures only apply to the 30 current known/potential counties sh own on Figure 2 of the PBO at this time. The programmatic determination for NLEB for the NCDOT program is May Affect, Likely to Adversely Affect. The PBO provides incidental take coverage for NLEB and will ensure compliance with Section 7 of the Endangered Species Act for ten years for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Wake County, where 17BP.5.R.79 is located. Currently the 30 counties where NLEBs are known to occur does not include Wake County; accordingly, environmental commitments (i.e. Measures to Avoid/Minimize Mortality) for this species are not required for this project. This level of incidental take is authorized from the effective date of a final listing determination through December 31, 2030. Cultural Resources: The State Historic Preservation Office (SHPO) provided an updated Assessment of Effects form dated March 12, 2019 (attached) verifying that the National Register listed Hood-Anderson Farm property is still the only property in the project area eligible for the National Register listing. The following project commitments are still required: 2-bar rail, limited tree clearing, replacement of crane outside of historic boundary. Catawba Indian Nation: NCDOT submitted a letter on September 19, 2019 to the Catawba Nation (CIN) informing them of the project and results of the archaeological study report. The CIN responded on October 22, 2019 and indicated no immediate concerns with regard to traditional cultural properties, sacred sites, or Native American archaeological sites within the boundaries of the proposed project area ; CIN is to be notified if “Native American artifacts and/or human remains are located during the ground disturbance phase of this project.” Complete Streets: NCDOT’s Division 5 submitted a Phase 3 Complete Streets review request to the Integrated Mobility Division (IMD) on November 4, 2021. The IMD group concluded their review on December 20, 2021 and provided a complete streets project scoping recommendation letter and the signed complete streets project sheet. IMD concurs that an 8-foot sidewalk should be built in conjunction with this project along with 4 - foot paved shoulders on both sides of the roadway. The accommodations will complement 4 Updated 1/20/22 the planning efforts and local plans that call for greenways and multimodal connections, while also balancing environmental and design constraints. Proper transitions and signage announcing to users that the path narrows on the bridge were recommended by IMD. E. Conclusion: The above NEPA/SEPA documentation has been reevaluated (as required by either 23 CFR 771 or by NC General Statute Chapter 113A Article 1). It has been determined that the current proposed action is essentially the same as the original proposed action. Proposed changes, if any, are noted in Section D.
