Attached are the updated plan sheets showing the modifications that we discussed. The Construction Sequence has
been modified to indicate the diversion of river flow from the banks where structures are installed, instructions for
installing a pump around system for UT1 and Black Creek have been added and the pump around detail has been added
to the Erosion Control Plan detail section.
Again, thank you for pointing out this needs.

sheets as discussed in your email below. Please also include language / details concerning diverting flows in the
Nantahala River during in -stream structure installation. Addressing these items and including them in the plan set will
satisfy the additional information request.

Cody went on vacation starting today and will be out of town for the next week; he passed your questions on to me. I
agree with all your observations and we will be addressing each one. We will add specific language in the Construction
Sequence that work on UT1 and Black Creek should include having a pump around system installed prior to the
beginning of any construction. That water shall be pumped around any area where construction is being done on these
tributaries. We will also add the pump around detail to the plan set. With regards to work on the Nantahala River we
will be placing boulders immediately upstream of any location where work is being done on the River bank to divert flow
away from or off of the work area and limit movement of water from that area. The river bed is relatively clean with
little silt and the primary fine bed component will be sands. The mobility of these sands will be limited and we feel that
the primary risk for sedimentation will be where structures are tied into the banks. Therefore, we will divert eroding
forces from these banks to mitigate the risk of mobilizing fines. I will add this language to the Construction Sequence to
inform the contractor of this requirement. Please let me know if this email is a satisfactory response to your concerns or
if you desire for us to make these changes and submit a new plan set to you. I need to know what you need so that we
can satisfactorily respond. Again, thank you for bringing these needed modifications of the plans to our attention and
we will address them immediately.

Amy is requesting additional language about utilizing a pump around on the two tribs on Nantahala, and adding a detail.
Additionally, she asked another question about preventing erosion in the Nantahala River.
Can you have Melissa address the item about pumping around the tribs? I am not sure about the latter question, but I
am interested in your thoughts about potential additional measures in the Nantahala River to prevent sedimentation.

Sheet 3 discusses the Construction Sequence and mentions working in the wet for the Nantahala River. I do not see any
language regarding pumping around for work in the 2 tributaries to the Nantahala, nor is a pump around shown/ called
out on the detail sheet or in the notes for the 2 tributaries.

Is it possible to utilize any diversions / isolate flows while installing structures in the Nantahala? The turbidity standard
for all three streams is 10 NTUs and project activities should not contravene the standard.

Please see attached for the plan set. The Construction Sequence details the work in the wet vs in the dry- UT1 and Black
Creek are intended to be done in the dry (using a pump around), but the Nantahla River is too large to pump around,
and will be worked in the wet. The contractor is requested to do as much work from stream banks as possible to
eliminate sediment entering the stream.
How do we pay the fee?

There was no plan set submitted with the PCN application and DWR has not received the required fee. As such, I cannot
proceed with my review. The project will be on hold until you provide an engineered plan set and required fee. Please
upload the plans to Laserfiche if the file is too large to email.
On July 21, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The required fee has not been received yet. Please submit the fee
at your earliest opportunity. The Division has determined that your application is incomplete and cannot be processed.
The application is on -hold until all of the following information is received:
• Please provide an engineered plan set showing all proposed stream and/or wetland impacts. [15A NCAC 02H
0502]

Please discuss if project activities will be performed in the dry. Per Condition 11.8 of GC 4255 (attached), all work
must be done "in the dry". Therefore, dewatering methods will be necessary to temporarily dewater the stream
channel during project activities. Please provide a construction sequence that details the method of dewatering
to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this
condition. In addition, please ensure that the location of the temporary impacts are shown on the construction
drawings and clearly indicated in the revised impact table. [15A NCAC 02H .0506(b), 15A NCAC 02H .0507(c),
and 15A NCAC 02B .0200]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by October 5, 2022. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and the appropriate fee.
