ADDITIONAL INFORMATION — REQUST FOR REVISION TO EXISTING PERNIT AUTHROIZATION DENC Person County Pipeline — NWP-12 SAW-2022-00518 DWR # 22-0345 Note that DENC is requesting approval of additional impacts resulting from a proposed revised alignment on a particular parcel. The alignment adjustments will impact another stream (SK/OW1) and riparian buffer and will require buffer mitigation. Accordingly, a credit availability letter from a private bank in the watershed has also been attached. The stream impacts are temporary. This submittal includes: • Responses to DWR Request for Additional Information • Revised Exhibits • Revised Impact Tables • Buffer Mitigation Credit Availability Letter Responses to DWR Request for Additional Information DWR: No modifications to stream or buffer impacts are requested, correct? Please provide a copy of the final stream and buffer impact tables for verification. [15A NCAC 02H .0502(c)] Response: As indicated above, the requested revision will result in additional stream and buffer impacts. Unlike the previously -permitted buffer impacts, the crossing of SK/OW1 cannot be accomplished in a near -perpendicular manner due the proximity of a property line. The appropriate Buffer Impact Exhibit is also attached. The proposed easement at this location was re-routed from its original location in order to accommodate the property owner and help avoid condemnation of the tract. DWR: Can you please provide a revised Site Vicinity Exhibit with something to help call out where the new changes are proposed in relation to the project as a whole? [15A NCAC 02H .0502(c)] Response: See Figure 1, attached. Revisions to the proposed original alignment are indicated by a call - out. DWR: Am I understanding that the easements where modified impacts are occurring have not been obtained yet? [15A NCAC 02H .0502(c)] Response: DENC's attempt to secure an easement on the property subject to this revision for the additional stream/buffer impacts has been referred to their legal team to acquire by their right to acquire via a condemnation as allowed for by the State of North Carolina for a natural gas utility operator. DENC remains hopeful the settlement of the tract can occur outside of a court hearing and the alternate alignment that is depicted on the drawings is a real possibility if this becomes the case. Rather than wait for the process to completely play out, we are seeking approval of additional impacts created by this alternate alignment that's agreeable to the landowner as part of this application.
