Hi Adam, It was great speaking with you today regarding the subject proposed project. As mentioned in our meeting, your application will be withdrawn as it does not meet Nationwide Permit 39 terms and conditions. You will submit a new Standard Permit application using the form here: https://www.saw.usace.army.mil/Portals/59/docs/regulatory/regdocs/Permits/Eng Form 4345 2012OCT.pdf and you will include an alternatives analysis for the proposed landfill. You may reference the attached document for additional discussions/examples regarding the alternatives analysis. We also discussed purpose and need, siting criteria, and avoidance and minimization. Additionally, you will follow up with mitigation banks regarding compensatory mitigation and provide NCWAM and NCSAM forms for the resources with a proposed mitigation ratio that is less than 2:1. Further, you will follow up with your client regarding a potential cost -benefit analysis to see if they would like to move forward considering the amount of mitigation that may be required.
