Dear Mr. Currey,
Please accept this letter as an application for renewal of the Agitation Dredging permit for
Colonial Terminals Inc. ("CTINC"), physically located at 1002 South Front Street, Wilmington, NC
28401, on the Cape Fear River.
The Agitation Dredging permit, Permit Number 106-74, previously authorized CTINC to
maintain the depth of its berth on the Cape Fear River to a depth of -44 feet below the normal
low water level using I-beam agitation dredging methodology. We are requesting renewal of
this permit and will require no modification to berth depth or footprint. Recent drawings are
attached along with a brief document history.
As per our phone call on Friday, August 19, CTINC would like to request that Clam Bucket to
Barge be included in the permit renewal as an approved methodology. However, if this
modification will cause a delay in the issuance of the permit, we can discuss it at a later date.

This permit, issued on November 10, 2020 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) This renewal shall be attached to the Permit No. 106-74, which was transferred to the permittee on
4/30/02, as well as all subsequent renewals, and modifications, and copies of all documents shall be
readily available on site when a Division representative inspects the project for compliance.
2) All conditions and stipulations of the active permit remain in force under this renewal.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No.
1989-0286v2.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No.
2017-00182.
NOTE: A permit renewal application processing fee of $100 was received by DCM for this project.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31 2022
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

'I) The permittee is only authorized to use agitation dredging in the identified berth/slip for the removal of
accumulated sediments to maintain the facility at its authorized depth by dragging an I-beam or other
similar device for the purpose of resuspending accumulated sediment. Re -suspended sediment is
removed from the berth/slip by the ebb tide. Hydraulic dredging into the Federal channel or adjacent
waters will not be authorized.
