Comment As an initial matter, DWR should be advised and aware that the subject Application may not fully or accurately describe the proposed project or its associated impacts in multiple ways. On page three of the Applicant's Pre -Construction Notification Form, in response to question 6(a) in Section B, the Applicant represents that this is NOT a phased project. In addition, on page nine of the Applicant's Pre - Construction Notification Form, in response to question 3(a) in Section F, the Applicant represents that this project (based on past and reasonably anticipated future impacts) will NOT result in additional development which could impact nearby downstream water quality. However, the Applicant is currently seeking re -zoning of additional adjacent parcels, expressly described as Phase 2 of the Apex Gateway project, for additional industrial developments covering an additional 242.94 acres. While the Applicant submitted this Application to NCDENR-DWR on October 27, 2022 with the above -noted representations, the Applicant had previously publicly announced its plans for Phase 2 of the project: On October 10, 2022, the Applicant distributed a Notice of Neighborhood Meeting (see attached) describing the proposed plans; on October 20, 2022, the Applicant held a pre -application meeting with the Town of Apex Environmental Advisory Board regarding Phase 2 of the project; and on October 27, 2022, the Applicant held a neighborhood meeting with adjacent property owners also describing the Phase 2 plans. An image of the concept site plan presented in the neighborhood meeting is also attached for reference. While this Application describes the first phase of this project covering 134.3 acres, when combined with its planned Phase 2, the project will actually impact approximately 376.97 acres. In addition, DWR should be aware of another initial discrepancy in the Application. While the Application describes and depicts a four building project on the site, the Applicant's Major Site Plan submitted to the Town of Apex on October 2, 2022 (see attached), proposes five buildings on the site. Additional comments may follow regarding this Application, however, DWR should be aware of these items as early as possible in the course of its review. Noise• of • • • Police Noise from tree removal, grading, excavating, paving, and building structures is a routine part of the construction process. The Town generally limits construction hours from 7:00 a.m. to 8:30 p.m. so that there are quiet times even during the construction process. Note that construction outside of these hours is allowed with special permission from the Town when it makes more sense to have the construction occur at night, often to avoid traffic issues. In addition, the Town limits hours of blasting rock to Monday through Friday from 8:00 a.m. to 5:00 p.m. Report violations of construction hours and other noise complaints to the Non -Emergency Police phone number at 919-362-8661. Noise & Hours of ■ Police Noise from tree removal, grading, excavating, paving, and building structures is a routine part of the construction process. The Town generally limits construction hours from 7:00 a.m. to 8.30 p.m. so that there are quiet times even during the construction process. Note that construction outside of these hours is allowed with special permission from the Town when it makes more sense to have the construction occur at night, often to avoid traffic issues. In addition, the Town limits hours of blasting rock to Monday through Friday from 8:00 a.m. to 5:00 p.m. Report violations of construction hours and other noise complaints to the Non -Emergency Police phone number at 919-362-8661. Construction truck traffic will be heavy throughout the development process, including but not limited to removal of trees from site, loads of dirt coming in and/or out of the site, construction materials such as brick and wood brought to the site, asphalt and Concrete trucks come in to pave, etc. The Town requires a construction entrance that is graveled to try to prevent as much dirt from leaving the site as possible. If dirt does get into the road, the Town can require they clean the street (see "Dirt in the Road" below). There can be issues with roadway damage, roadway improvements, and traffic control. Potholes, rutting, inadequate lanes/signing/striping, poor traffic control, blocked sidewalks/paths are all common issues that should be reported to Water Resources — Infrastructure inspections at 919-249-3427. The Town will get NCDOT involved if needed. Non-EmergencyParking Violations: Police Unless a neighbor gives permission, there should be no construction parking in neighbors' driveways or on their property. Note that parking in the right-of-way is allowed, but Town regulations prohibit parking within 15 feet of driveways so as not to block sight triangles. Sediment (dirt) can leave the site and get onto adjacent properties or into streams and stream buffers; it is typically transported off -site by rain events.
