Home Park WWTP Haywood County Dear Mr. Francis: 15A NCAC 02T .0118, "Demonstration of Future Wastewater Treatment Capacities," was adopted by the Environmental Management Commission to ensure that wastewater. treatment systems owned or operated by municipalities, counties, sanitary districts or public utilities do not exceed their hydraulic treatment capacities. This Rule specifies that no permits for sewer line extensions will be issued by. the. Division of Water Quality to facilities exceeding 80% of their hydraulic treatment capacity unless specific evaluations of future wastewater treatment needs have been completed. A review of your self monitoring reports has indicated flow at the subject facility exceeded the 80% threshold for calendar year 2011. 'The average flow calculated for this period was 0.00724 MGD, and represented 80.44% of the current treatment capacity. Therefore,we will be unable to approve any further sewer line extensions for this facility until such time as you have complied with the requirements contained in the Rule. In order to attain compliance with the Rule, you must submit an approvable engineering evaluation of future wastewater treatment needs. This evaluation must outline specific plans for system expansion and include the sources of funding for the expansion. NCO030422 I11 12I 10/02/25 117 18I CI Section D: Summary of Finding/Comments (Attach additional sheets of narrative and checklists as necessary) FACILITY DESCRIPTION: The Green Valley MHP WWTP is a Class II facility rated as a 0.009 MGD extended aeration package plant with: bar screen; aeration basin with blowers providing diffused air; clarifier with sludge return; an aerobic digestor; fine solids settling basin; tablet chlorinator; and tablet dechlorinator. An Authorization to Construct (ATC No. 030422A01) was issued on 1-16-2008, for the construction of a new 3,000 flow equalization tank with 15 cfm blower and diffuser assembly; duplex 27 gpm submersible grinder pumps; manual bar screen; and a 359 gallon chlorine contact chamber. There have been recent efforts to excavate and install the trench box for the equalization basin, however problems with high groundwater levels have hindered those efforts. PERMIT / INSPECTION / LOG: A review of the files indicates that the last compliance evaluation inspection was conducted on 4-28-2009 by Wanda Frazier. The permit expires on 1-31-2011. Please request a permit renewal 6 months prior to expiration. A renewal notice will be mailed as a reminder. A'copy of the permit was on -site. The daily operator log was present on -site and had good notation of daily events, process control and field testing data. TREATMENT UNITS / PROCESS CONTROL TESTING DATA: The activated sludge aeration basin process control data was as follows: Temperature = 6.6 degrees Celsius pH = 6.9 units Dissolved Oxygen = 3.2 mg/I Settleable Solids = 900 ml/I = 90% --- due to hydraulic surges & young sludge age EFFLUENT: The effluent data was as follows: Temperature = 5.9 degrees Celsius pH = 7.2 units Page # 2 Permit: NCO030422 Inspection Date: 02/25/2010 Dissolved Oxygen = 5.2 mg/I Chlorine = 22 ug/I Owner - Facility: Green Valley Mobile Home Park Inspection Type: Compliance Evaluation OPERATIONS AND MAINTENANCE / EFFLUENT / SUMMARY: Mr. JoeDavid Hall, ORC, assisted in the inspection and appears to be operating and maintaining the facility very well. The effluent appeared to be in compliance with permit limits. SYSTEM PERFORMANCE ANNUAL REPORT: The System Performance Annual Performance Report had been filed for the 2008-2009 fiscal year by Env. Inc. Note: According to the Clean Water Act of 1999 (House Bill 1160), the legal requirement for submittal of the System Performance Annual Report is as follows: The owner or operator of any wastewater treatment works or wastewater collection systems that treats or collects primarily domestic or municipal waste, must provide an Annual Report to its users or customers and to the Department of Environment and Natural Resources that summarizes the treatment works' and collection system's performance over a 12 month period.) Report Format: The following is provided as guidance to assist you in meeting this aspect of the new reporting requirements. In order to comply with the regulation the following specific criteria is required by 15 A NCAC 02T .0403: The sewer system is effectively maintained and operated at all times to prevent discharge to land or surface waters, and to prevent any contravention of groundwater standards or surface water standards. For privately owned collection systems, the Grease Control Program shall include at least biannual distribution of grease education materials to users of the collection system by the permittee or its representative. Grease education materials shall be distributed more often than required if necessary to prevent grease -related sanitary sewer overflows. The residents need to be informed about the proper disposal of fats, oils and grease (FOGs), using educational handouts/newsletters/door hangers. The proper disposal of baby wipes and diapers would be appropriate to address at that time, as well. Operation and The plant needs an equalization basin. Due to hydraulic surges in flow, the Maintenance plant is unable to maintain the proper level of mixed liquor suspended solids in the plant. Operation and The influent bar screen needs a screening grate to allow removed solids to Maintenance drain and dry. Operation and The clarifier surface skimmer needs to be repaired. Due to hydraulic surges to Maintenance the plant, the sludge is young and does not settle well. There is a layer of sludge on the surface of the clarifier. Operation and A motor and blower are needed. There is only one working motor and blower. Maintenance This violation was cited on the previous DWQ inspection on 8-15-2008. Operation and The settling basin needs to be pump due to carryover of solids throughout the Maintenance plant. There are suspended solids floating in the effluent. Leaves and debris . need to be removed, prior to discharge. Effluent Pipe The stream bank area is grown up in vegetation, making the effluent pipe and inaccessible. The area around the plant (inside and outside of the fence) needs Housekeeping to be cleaned up and maintained. Site Review and The ground around the plant, especially the washed-out area caused by a _ Housekeeping previous leak in the polishing basin wall, needs to be leveled to allow safe Access. You should address the causes of noncompliance and all actions taken to prevent the recurrence of similar situations. DWQ understands and appreciates that you and Ms. Gwen Nicholson have been working diligently to obtain funding and to minimize the costs involved in making much needed improvements to the wastewater treatment plant. This Notice of Violation is legally necessary and supports the need for and urgency of making the recommended improvements to the plant. Please authorize the contract operator to address these items, as soon as possible. Failure to initiate repairs / replacement / improvements will be cited as "failure to properly operate and maintain" the plant and will be cause for assessing civil penalties. To prevent further action, carefully review these violations and deficiencies and please respond in writing to this office within fifteen (15) working days of receipt of this letter with a Plan of Action and Timetable for implementation. Gray Wilke, ORC, and John Francis, Green Valley MHP manager partner, assisted in the inspection. Mr. Francis stated that he is working on purchasing an equalization basin. Mr. Wilke stated that he will realign one of the blowers next week and is in the process of getting the second blower fixed. He will also fix the leak in the airline pipe and surface skimmer. On April 28, 2009, the following observations were made. The plants needs an equalization basin. Due to hydraulic surges in flow, the plant is unable to maintain the proper,level of mixed liquor suspended solids in the plant. The influent bar screen needs a screening grate to allow removed solids to drain and dry. The plant needs pumping due to carryover of solids throughout the plant. The clarifier surface skimmer needs to be repaired. A motor and blower are needed. There is only one working motor and blower. The residents need to be informed about the proper disposal of fats, oils and greases (FOGs), via educational handouts / newsletters. Addressing the proper disposal of baby wipes and diapers would be appropriate to address at that time, as well. The plant is receiving an excess amount FOGs and debris, interferring with proper operation and maintenance. The area around the plant (inside and outside of the fence) needs to be cleaned up. The ground around the plant needs to be leveled to allow safe access, especially the washed-out area, from a repaired leak in the polishing basin wall. A copy of the current permit needs to be given to the contract ORC. Please authorize the contract operator to make these needed repairs / replacements / improvements, as soon as possible. This is a small WWTP which does not have a glowing compliance history but not a bad actor either. The monies will be better used for upgrades at the facility that paid in civil penalties. As I stated, this is a small WWTP that has a contract operator and the previous permittee did not have the abilities to communicate properly information to the operator. The permittee has been changed and the enforcement actions have done what we wanted in having more attention focused on: the WWTP. I have numerous e-mails correspondents regarding the operation and management of the WWTP since the enforcement actions were received by co -owners. Different avenues are being investigated for the WWTP discharge, but elimination of the discharge does not seem possible at this time. Haywood Waterways Association is involved with the permittee and things are much improved in the operations and management of the WWTP. ARO recommends the remission of the civil penalties to the maximum your are comfortable with since_ the payment will only hamper the improvements to the WWTP. See you in Lake Lure on Thursday. Since they were aware of the issue, it seems dechlor should have been installed before the TRC limits went into effect. Let me know what you think. The address is now correct for the paperwork to come to, so this is why I think these violations were not taken care of in a timely manner but not ignored. It will be mailed out 11-17-2008 long with legal documentation of the deed of the ownership which is Mr. William (Bill Freeman) and John Carr Francis, and James Henry Francis. There is now a copy of the permit #NC0030422 posted at the Green Valley Mobile Home Park at the waste treatment plant. Mark Teague with Environmental Inc, Cullowhee, N.C. is the person that takes care of this waste treatment facility five days a week and not sure why Mr. Teague did not take corrective action to the. new regulations.. He has said he was not aware of anything regarding the new regulations which were regulations pertaining to a daily maximum 28 uGu/L which was to be effective June1, 2008- a daily maximum TRC limit of 281I uGu/L which was effective June 1, 2008 time period is allowed in order for the 'facility to budget and design/construct de - chlorination system or alternative disinfection systems. The other owners Mr. William Freeman and Mr. James H. Francis was not aware of the new regulations so therefore they would have not been ignored if they had known about the new regulations -the permit was just in the wrong hands. Mr. John Carr Francis had been under stress regarding financial issues -he had lost the family farm- Francis Mi11 and Francis farm that had been in the family for a century. He had been on mental health medication for sometime (Lithium) and sometimes on this medication a person is not aware of what is going on in the everyday world. Mr. Francis is manic depressed and has been diagnosed with this disease. A depressive disorder is an illness that involves the body, mood, and thoughts. It affects the way �a person eats, and sleeps, the way one feels about oneself, and the way one thinks about things. A depressive disorder is not the same as a passing blue mood. It is not a sign of personal weakness or a condition that can be willed or washed away. People with a depressive illness cannot merely "pull themselves together and get better. Lithium is the chemical medication that is the most common element used for stabilizing mood swings and mania and depression. Signs of depression are: Feeling of worthlessness, loss of interest, difficulty concentrating, remembering, and making decisions. There are many more but this has been the state of mind that Mr. John C. Francis has been in. He has a wife that will not let him do anything without her permission. His mother has given him generous amounts of money -to find it spent on other things than what it was intended for. We think that Mr. John C. Francis really didn't care if he lived or died. We are just now finding this out about his mental state when he was asked about these violations -his answer was I didn't know about these. What can we say after the fact? Mr. Teague will be notified as of this date when any mail comes in from the Division of Water Quality and a copy will be mailed back to him by Mr James H. Francis on the same day it is received. Payment of the civil penalty, ill not prevent Green Valley Mobile Home Park from Performing the activities necessary to achieve compliance. We are in compliance now and will not be in violation again. We are trying to make sure that everyone is on the same page when the paperwork comes from the Division of Water Quality -Raleigh, N.C. I have been working with the Environmental Inc. -Mark Teague and Mr. Roger Edwards on these violations :and we all feel that if everyone is aware of the changes there will be no more problems along with us changing the legal and responsible person being James H. Francis. He has been made aware that he will call Mr. Mark Teague and keep him informed with any changes that come his way and will send any reports that need to go monthly or semi annually to Raleigh. Francis. This assessment is based upon the following facts: a review has been conducted of the discharge monitoring report (DMR) submitted by John C. Francis for the month of August 2008. This review has shown the subject facility to be in violation of the discharge limitations and/or monitoring requirements found in NPDES Permit NC0030422. The violations which occurred in August 2008 are summarized in Attachment A to this letter. Based upon the above facts, I conclude as a matter of law that John C. Francis violated the terms, conditions or requirements of NPDES Permit NCO030422 and G.S. 143-215.1(a)(6) in the manner and extent shown in Attachment A. In accordance with the maximums established by G.S. 1.43- 215.6A(a)(2), a civil penalty may be assessed against any person who violates the terms, conditions or requirements of a permit required by G.S. 143-215.1(a). Based upon the above findings of fact and conclusions of law, and in accordance with authority provided by the Secretary of the Department of Environment and Natural Resources and the Director of the Division of Water Quality, I, Roger C. The Total Residual Chlorine limit effective date was mentioned in an NPDES Compliance Evaluation Inspection on 5/22/2007 to Mr. Francis. The paperwork contains paperwork that we have been trying to get from John but he said he could not find. Eric and I talked also about doing a survey and going door to door in. the Hyatt Creek area to see how many people would be interested in maybe getting Town of Waynesville water and sewer: We (my brother) is real good friends with the Mayor Gavin. Brown and asked him about doing this and he said that the town has already sent out a survey and no one is interested. I told Eric I don't buy this because Robert Hyatt who lives on Hyatt Creek and works for Fred Baker the Town of Waynesville engineer is totally against this idea. He said he would. NEVER give Green Valley Mobile Home Park any easement or right of ways for the Town of Waynesville to go through his property so you see he will never want this project for water and sewer to go to Hyatt Creek. If we did get Town water and sewer we would have to go behind his property someway. I guess when John Francis and my father Bill Freeman met with Fred Baker some years ago they really didn't want to talk about the Town of Waynesville water and sewer so Eric and I came up with a great idea. I told him I would like to have some kind of paper work and we go door to door and just see what the residents of Hyatt Creek would want and do our own survey, then we would know; skipping the Hyatt's on Hyatt Creek because we know their opinion. Just maybe there would be enough people that the Town would do water and sewer for the Hyatt Creek residents. I will keep you posted. Eric is also going to let me know how and when we can do the survey. I feel people just don't try hard enough for anything!! I got on the phone and I found 3000 gallon concrete tanks at a good price and one is a flow through tank. We would have to purchase the pump and other necessary materials in order to install. I gave this paperwork to James Francis. I got with Mark Teague also on this and he still wants us to look into getting the tanks in Cashiers, N.C. which will have everything that we need in order for improvements. The cost before was going to be so high to. move them but I have the resources to have them moved at a much lesser cost -I have a friend that does this sort of thing -he installs septic tanks in the Graham and Swain county areas and has been doing this for many'years,. He said he would move these tanks for us in his dump truck and trailer that he owns. This would save us a lot of money. Mark and James are going to get the measurements on the tanks in Cashiers and let me know so I see if the truck and trailer would be big enough. We also would do the electrical work ourselves. So when I get the measurements on the tanks we will go forward to make some decisions. We would like to know if we are going to have to pay the violations because we would like to use that money also in order to help with this expense. Eric has given us $13985.41. We would have had more but John Francis did not get back in touch with Eric. if I appreciate your patience and I want to keep you updated on everything we are trying to accomplish. Section D: Summary of Finding/Comments (Attach additional sheets of narrative and checklists as necessary) A Technical Assistance visit was condudted at the subject facility at the request of the consulting engineer, McGill and Associates. Staff time and assistance in conducting the Technical Assistance is appreciated. The current facility is a conventional package WWTP with effluent chlorination and a "polishing pond/lagoon". Operations are somewhat limited due to the maintenance needs of the plant. The plant has experienced solids wash out of the aeration basin and secondary clarifier as evidenced by the sludge accumulation in the "polishing pond/lagoon". One way to address this wash out condition is to time the plant operation to be operating just prior to major flows entering the plant. This time may be early morning between 5 and 7 am, and afternoons between 4:30 and 6:30 pm. It is suggested facility staff review flows and time of blower operation to run 30 min. prior to maximum flows at both morning and afternoon. Facility staff should also review clarifier maintenance to manually scrape and dip out clarifier scum baffle once per week. These operations should occur at the same time as a weekly plant wash down. These operations combined will also help prevent the solids accumulation in the polishing pond/lagoon. Facility staff and on -site observers commenting on adding a flow equalization aspect to the existing system. Prior to adding flow equalization all other alternatives should be reviewed. This should include installing a subsurface system on available land, to tying into the city of Waynesville's sewer collection system. These alternatives can be reviewed by the systems consultant. The facility needs to also submit an application for permit renewal, if the system is going to continue to operate. At the time of the Technical Assistance, file review indicated the facility had not applied for renewal. At the time of the Technical Assistance, sludge was measured in the 3 lagoon compartments. 1st compartment was 1 foot deep with a 1 foot accumulation of sludge, the 2nd compartment was 1 & 1/2 feet deep with a 1 & 1/2 foot accumulation of sludge, the 3rd compartment was 2 feet deep with a 6 inch accumulation of sludge in the first section. The entire polishing pond needs to be pumped out and the baffles and walls repaired and lined. A crack was noted on the effluent side of the 3rd lagoon cell and was leaking. Staff time and assistance in conducting the Technical Assistance is appreciated. The current facility is a conventional package WWTP with effluent chlorination and a "polishing pond/lagoon". Operations are somewhat limited due to the maintenance needs of the plant. The plant has experienced solids wash out of the aeration basin and secondary clarifier as evidenced by the sludge accumulation in the "polishing pond/lagoon". One way to address this wash out condition is to time the plant operation to be operating just prior to major flows entering the plant. This time may be eary morning between 5 and 7 am, and afternoons between 4:30 and 6:30 pm. It is suggested facility staff review flows and time of blower operation to run 30 min. prior tomaximum flows at both morning and afternoon. Facility staff should also review clarifier maintenance to manually scrape and dip out clarifier scum baffle once per week. These operations should occur at the same time as a weekly plant wash down. These operations combined will also help prevent the solids accumulation in the polishing pond/lagoon. Facility staff and on -site observers commenting on adding a flow equalization aspect to the existing system. Prior to adding flow equalization all other alternatives should be reviewed. This should include installing a subsurface system on available land, to tying into the city of Waynesville's sewer collection system. These alternatives can be reviewed by the systems consultant. At the time of the Technical Assistance, sludge was measured in the 3 lagoon compartments. 1 st compartment was 1 foot deep with 1 foot accumulation of sludge, the 2nd compartment was 1 and 1/2 foot deep with 1 and 1/2 foot of sludge accumulation, the 3rd compartment was 2 feet deep with a 6 inch accumulation of sludge in the first section. The entire polishing pond needs to pumped out and the baffles and walls repaired and lined. A crack was noted on the effluent side of the 3rd cell and was leaking. This needs to be repaired immediately.
