Ron Boone, of the North Carolina Division of Water Resources (NCDWR), Winston-Salem Regional
Office (WSRO), conducted a compliance evaluation inspection of Carolina Biological Supply
Company's NCG5300000 permit on September 7th, 2022. Michael Richardson, EHS Manager, was
present for the inspection. Inspection findings are detailed in the attached Water Compliance
Inspection Report.
Please be aware that the Division may take enforcement action against any individual who fails
to comply with the requirements of all applicable permits, regulations, and/or statutes. Pursuant
to NC General Statute (NCGS) 143-215.6A, a civil penalty of not more than twenty-five thousand
dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance
with the terms, conditions, or requirements of any permit, or applicable regulations, issued
pursuant to G.S. 143-215.1.

Ron Boone, of the NC Division of Water Resources (DWR), Winston-Salem Regional Office (WSRO),
conducted a compliance evaluation inspection of Carolina Biological Supply (CBS) Company's
NCG530000 permit on September 7th, 2022. Michael Richardson, EHS Manager, was present for the
inspection.
Analytical records were evaluated along with other documentation. It was noted that no dissolved
oxygen or turbidity analyses have been done as required by the permit.
It was noted that this permit may not be a proper fit for this specific discharge. The discharge consists
of water that can come from three separate sources as follows:
1. The primary process consists of taking water from an onsite natural spring and using it as a
growing medium in a concrete canal system to grow and harvest the aquatic plants Duckweed and
Elodea. The canal system is partly indoors and partly outdoors. The spring water flows through the
canal system where the Duckweed and Elodea grow and then overflows and discharges from the site
at the end of the canal system. The permit currently shows the discharge goes to an unnamed
tributary of the Haw River. This is incorrect. It eventually goes to the Haw River, but it is initially
discharged to an unnamed tributary of Dry Creek.
2. A secondary process involves growing and harvesting lily pads in an onsite pond, which is also fed
by a second onsite natural spring. Under heavy rain conditions the pond will overflow and discharge
at the same location where the primary process discharges.
3. Onsite stormwater sheetflow runoff is the third source of discharge at the outfall.
No fish are raised at the site, which is the only process specifically regulated under this permit.
CBS may consider requesting rescission of the permit. It is our best professional judgment that the
waters discharged from the site do NOT constitute a wastewater that is properly regulated under this
permit. If you do wish to request rescission, please do so in writing via postal mail or email to Mr.
Boone.
