Good afternoon Mr. Pitner,
I'm reaching out to you based on the instruction provided on Doug Perez's voicemail. We received the attached 401, on
April 1, 2022; however, the City of Charlotte has since requested a road realignment. The original and newly proposed
road alignments are reflected in the drawings below.
I'm wondering if you're able to provide some insight as to whether or not we can submit for a 401 Modification as opposed
to reapplying and going through the 30-day prefile again, as our Client has indicated that having the 404 permit by the
end of the year is critical and cannot be issued without the 401. Steve Kichefski (the USACE PM working on this with us)
and I recently discussed the new alignment/project modifications and he indicated that he would be willing to move
forward with the 404, but was not sure about the States process when it comes to 401 modifications. At your convenience,
I was hoping you would be willing to provide some direction on what needs to be done to satisfy the NC DWR and 401
requirements.
Former road alignment (NCDWR# 22-0207): ^'0.001 acre of proposed permanent wetland impact and^'110 LF of proposed
permanent stream impact.
