Dear Mr. Gilmore:
The purpose of this letter is to modify the February 12, 2007 request that the North Carolina
Ecosystem Enhancement Program (EEP) provide mitigation for unavoidable impacts to
jurisdictional waters of the U.S. The EEP accepted mitigation in a letter dated February 13,
2007. Impacts requiring mitigation to jurisdictional resources within CU 03010205 have
changed and are as follows:
Coastal Marsh Wetlands 0.18 acres
Riverine Wetlands 0.06 acre
Please send the letter of confirmation to our office confirming the receipt of this amended
mitigation request. In order to satisfy regulatory assurances that mitigation will be
performed; the NCDWQ requires a formal letter from EEP indicating their willingness and
ability to provide the mitigation work requested by NCDOT. The NCDOT requests such a
letter of confirmation be addressed to Mr. John Hennessy of NCDWQ, with copies
submitted to NCDOT.

Subject: EEP Mitigation Acceptance Letter:
B-2950, Replace Bridge Number 4 over Tull Creek on SR 1222,
Currituck County
The purpose of this letter is to notify you that the Ecosystem Enhancement Program
(EEP) will provide the compensatory coastal marsh wetland mitigation for the subject project.
Based on the information supplied by you in a letter dated February 12, 2007, the impacts are
located in CU 03010205 of the Pasquotank River Basin in the Northern. Outer Coastal Plain
(NOCP) Eco-Region, and are as follows:
Coastal Marsh Wetland:
0.16 acre
EEP commits to implementing sufficient compensatory wetland mitigation to offset the
impacts associated with this project by the end of the MOA Year in which this project is
permitted, in accordance with Section X of the Memorandum of Agreement between the North
Carolina Department of Environment and Natural Resources, the North Carolina Department of
Transportation, and the U. S. Army Corps of Engineers, signed on July 22, 2003. If the above
referenced impact amounts are revised, then this mitigation acceptance letter will no longer be
valid and a new mitigation acceptance letter will be required from EEP.
