Division of Water Resources' Central and Regional staff has reviewed the application package
received May 5, 2022, and additional information received August 8, 2022. However, additional
information is required before the review may be completed. Please address the items on the attached pages
no later than the close of business on November 30, 2022.

rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items

A. Property Ownership Documentation:
1. As stated in the previous additional information request, this project includes reclaimed water
distribution lines connecting the treatment plant on parcel 3792-58-8548 to the irrigation field on
parcel 3792-69-5506, both owned by the Town of Macclesfield. However, these parcels are not
contiguous, meaning the reclaimed water distribution lines in the permit description would need to
cross property lines onto land not owned by the Permittee, though it is not clear exactly where these
lines are located. In the first additional information response, the consent judgement was provided
for the parcel for the irrigation field, but the location of the distribution line was not specified.
Based on the facility description, our office suspects that the distribution lines follow the right of
way to South Foundation Street to Highway 124, and then cross parcels 3793-60-7332 and 3793-
60-3339. It appears that these two parcels of land that were sold by the Town of Macclesfield to
the Macclesfield Rural Volunteer Fire Department since the last renewal cycle. However, it is
unclear whether the town has an easement or encroachment agreement in accordance with NCAC
02T .0116(c) for installation, operation and maintenance of the system shall be provided. Please
provide any necessary utility easements needed for the operations and maintenance of these
facilities on land not owned by the Permittee.
