SUBJECT: Secondary Road Paving/Pipe replacement, SR 1365 (Hunter Rhyne Road), Lincoln
County
Dear Mr. Hennessy:
The North Carolina Department of Transportation proposes to replace a pipe in conjunction with a
secondary road paving project on SR 1365 (Hunter Rhyne Road) in Lincoln County. The existing 37.4-
foot, 42" CMP will be replaced with an 80-foot, 48" CMP with inlet headwall. The new pipe will be
placed on a skew to better align the upstream and downstream sections, which will result in the loss of
~50 linear feet of stream length. The new pipe will also buried one foot below the existing streambed
elevation as required. Upslope of the proposed pipe replacement a seep originates beside the existing
ditchline and flows down the ditchline for approximately 120 feet. A french drain will be constructed to
"capture" the seep flow and redirect the flow to the proposed new ditchline, which will be constructed on
new location on the same profile grade as the existing ditchline. Erosion control matting will be utilized
in the new ditchline as necessary.
Temporary cofferdams and bypass pumping will be utilized, as needed, to manage the stream during
construction. Upon project completion, the channel disturbed by the temporary cofferdams will be
restored to pre-project conditions and the area seeded and stabilized. The total scope of the work will
result in 170 feet of permanent impacts to two unnamed tributaries to Ballard Creek, which is classified as
a Class C waters by the Division of Water Quality.
The project is not located within '/~ mile of any critical watershed area nor is SR 1385 a rural or urban
arterial; therefore, hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist.
Based upon correspondence with the State Historic Preservation Office (SHPO), dated June 2004, the
proposed project area has been reviewed and SHPO has determined that no historic properties will be
affected (ER Number 04-1568).
This office has conducted a GIS and field survey for the project threatened/endangered species. The
federally listed species for Lincoln County (USFWS listed dated March 8, 2006) include Michaux's
sumac (Rhus michauxii) and the dwarf-flowered heartleaf (Hexastylis narr~ora).

Natural Heritage Program records document the nearest Michaux's sumac location approximately 15
miles southeast (in Mecklenburg County) of the proposed project area. There are no known sites of
Michaux's sumac in Lincoln County. The sumac is typically found in sandy or rocky, open woods and
appears to survive best in areas with some disturbance, such as artificially or naturally maintained
clearings. Michaux's sumac was not observed in the project. Natural Heritage Program records document
the nearest dwarf-flowered heartleaf location approximately 3.5 miles northwest of the proposed project
area. The heartleaf is usually found on dry to moist ravine slopes (usually north facing and of the oak-
hickory-pine forest type) and in boggy areas near springheads. The proposed project site is comprised
mostly of maintained DOT right of way and open agricultural fields. There did not appear to be suitable
habitat within the proposed project area and no species were observed. NCDOT is recommending a
finding of "no effect" for T&E species.

maps relative to the project.

Replacement of a 42", 37.4-foot CMP with a 48", 80-foot CMP with inlet headwall placed on

IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this

VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from
riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,
permanent and temporary, must be listed, and must be labeled and clearly identifiable on an
accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should be shown on a delineation map, whether or not impacts are proposed to these systems.
Wetland and stream evaluation and delineation forms should be included as appropriate.
Photographs may be included at the applicant's discretion. If this proposed impact is strictly for

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts. The road is being paved on the
existing roadway footprint. The increase in pipe length is due to the proposed skew_ to better
ali ng the upstream and downstream sections. Erosion control matting will be utilized on the
embankment at the inlet and outlet of the main stream pipe. The ditch/stream will be
reconstructed in a new location on a similar profile grade and matting will be utilized as needed
for stabilization.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors

aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h?o.enr.state.nc.us/ncwetlands/stnn;~ide.html.

The existing unpaved roadway is 20 feet wide and the proposed paved section will be 20 feet
wide with ~6 ft shoulder; therefore, there will be a minimal increase in impervious surface.

CONSTRUCTION SEQUENCE
1. Grading to be started by state forces. Install all necessary silt fences, sediment basins, and check dams
and begin clearing construction area.
2. Rough grade the construction area and begin installing any storm drainage and/or cross lines. Install
inlet and outlet protection as storm drainage is being installed.
3. As an area is brought to finish grade and the black base is placed for the road, and the shoulder
finished, then seed, mulch and tack should be provided for denuded areas.
4. Leave all erosion control devices in place until vegetation has been established sufficiently to
withstand erosion. DO NOT remove any erosion control devices until directed by the County
Engineer.
MAINTENANCE PLAN
1. All erosion and sediment control practices will be checked for stability and operation following every
runoff producing rainfall but in no case less than once every week. Any repairs will be made
immediately to maintain all practices as designed.
2. Sediment will be removed from behind the sediment fence when it becomes about 0.5 feet deep at the
fence. The sediment fence will be repaired as necessary to maintain a barrier.
3. All seeded areas will be fertilized, reseeded as necessary and mulched according to the instruction in
the seeded specifications to maintain a vigorous, dense vegetative cover.
4. Outlet protection will be installed when outlets are installed. Filter fabric will be placed under the
entire stone section and will be repaired and replaced if damaged during any phase of construction.
5. Sediment will be removed from the basin when it reaches 1.0 foot below the emergency spillway. The
filter stone is to be cleaned or replaced when basin no longer drains properly.
GROUND COVER FOR SLOPES, FILLS AND OTHER GRADED AREAS
The angles for graded slopes and fills shall be no greater than the angle which can be retained by vegetative
cover or other adequate erosion control devices or structures.
Seeding should be done in accordance with the specifications for that season of the year.
Additional erosion control measures may be required depending on the actual field conditions.
PROJECT
DESCRIPTION
SR 1365 (HUNTER RHYNE) from its intersection with SR
1362 (AMITY CHURCH) approximately 0.44 miles to where it
intersects with SR 1349 (KING WILKINSON). No problem
areas are anticipated. The work will be completed during the 2007
construction season.
