Following up on Kenzie’s emails – we were notified by the mitigation provider that due to credit demand they had to adjust credit sources. They provided an updated SOA, which is attached
for your reference. Hopefully this catches you with enough time to review and include in the approval letter accordingly.

On that note – we are getting a lot of pressure due to the schedule on this one and the lengthy review. Can you provide any sort of update on where we are in your queue?

I have attached the SOA from the mitigation banker that was included in the ePCN permit submittal to this email for your reference. The project proposes to provide compensatory mitigation
credits at a 2:1 ratio for the 0.341 acre of permanent impacts to wetland W1, W3, W4, and W6. To offset these losses, wetland and stream credits have been reserved through payment to
the EBX-Neuse I, LLC sponsored Neu-Con Wetland & Stream Mitigation Bank. Specifically, wetland credits will be provided from the Arrington Bridge III Site.

2. Can you please provide a brief explanation/more detail concerning why the road crossing could not be shifted slightly to the north to reduce or avoid impacts to the wetland?

Impacts to streams, wetlands, and riparian buffer zones have been avoided and minimized to the extent practical throughout the design of the project. The proposed collector road crossing
was designed to be near perpendicular to reduce impact lengths to stream S2 and fillslopes within wetlands W3 and W4 have been tightened to 2:1 and winged headwalls are proposed on each
culvert to further reduce impacts to the extent practicable. Additionally, the road was strategically designed in the proposed location utilizing the minimum horizontal curve ratio to
meet the horizontal curve requirements of the Town of Morrisville, while still maintaining a perpendicular crossing over stream S2 to minimize impacts. As a result, the ability for the
roadway and fillslopes to be shifted to cross stream S2 safely is limited. Shifting the road further north in an attempt to minimize or avoid impacts to wetlands W3 and W4 would not
allow for the horizontal curve requirements to be met (resulting in an unsafe roadway) and the roadway stream crossing would be substantially less perpendicular, resulting in larger
impacts to stream S2. Therefore, the current design for the proposed roadway crossing of stream S2 was minimized to the extent practicable to limit the cumulative impacts to stream S2
and wetlands W3 and W4.

This document confirms that Spark Infrastructure Property Owner, L.P. (Applicant) for the SPARK -
McCrimmon Parkway and Airport Boulevard Site (Project) has expressed an interest to utilize 214.00
Stream Mitigation Credits from the EBX-Neuse sponsored Neu-Con Wetland & Stream Umbrella
Mitigation Bank, specifically 156.43 stream credits from the Meadow Spring Site and 57.57 stream
credits from the Blackbird site, in the Neuse HUC 03020201. As the official Bank Sponsor, EBX-Neuse
I, LLC, attests to the fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
