Yes, B2, B8, B10, B12, and B13 require mitigation. My interpretation of B8 is that only the Zone 1 impacts need mitigation. In my official response to your three items, I will send an updated SOA. I’m trying to get an answer to #2 from the engineer because I agree, it looks like that sewer line could be adjusted. There is likely an engineering reason why they designed it the way it is but at this time I am not sure. This project appears to be in the Upper Falls Lake Watershed. The Statement of Availability for Buffer Mitigation provided stated that it was for outside the Falls Lake Basin. Buffer mitigation for impacts within the Falls Lake Watershed should be performed within the same watershed as the impact is located. Please provide an updated SOA. [15A NCAC 02B .0295(g)(1)(A)]. 2. Please provide additional information on why the non-perpendicular sewer crossing shown in Impact B8 could not be moved to further avoid impacts to Zone 1 of the riparian buffer. [15A NCAC 02B .0611(b)(2)] 3. In Section E1-Avoidance and Mitigation, it states that there are two buffer impacts that require mitigation: B8 (non-perpendicular sewer crossing that impacts >2,500 sq ft of Zone 1) and B10 & B12 (SCM outlets that result in the removal of vegetation in Zone 1 – does not mention B13). It does not mention the Perpendicular Road Crossing impact >0.3 acres of buffer (B2). In the Cover Letter, buffer mitigation for the perpendicular road crossing >0.3 acres (B2) and the SCM conveyances (B10, B12, B13), but not the non-perpendicular sewer crossing (B8). Please provide additional information regarding impacts requiring buffer mitigation. This may include an updated Buffer Mitigation Table and an updated SOA and/or additional clarity on these impacts.
