To recap our conversation: * The USACE agrees that the project may be separated into two parts and permitted under an NWP 14 for the Northern Durham Parkway and an NWP 39 for Welcome Venture Park. North Durham Parkway is part of Durham’s Comprehensive Transportation Plan as a boulevard and not specifically an access road for the development, and therefore could be permitted separately. Permitting the Northern Durham Parkway and Welcome Venture Park project under two NWP’s is similar to the Ferrell and Junction Road Project (SAW-2021-00350)/Northern Durham Parkway-Phase I (SAW-2021-02593) project. Regarding the Junction and Ferrell Road project, during preapplication consultation, the agent presented various layouts to ensure that the least environmentally damaging practical alternative would fulfill the project purpose and need. A private road was proposed, with winding alignment to avoid impacts and a 25-mph speed entirely within the proposed project boundary. However, the City of Durham required that the NDP be constructed though the entire parcel. The Corps determined that the road extension and improvements could be permitted as a separate, single, and complete project, with independent utility. It was determined that the Developer would have a difficult time demonstrating project purpose and need for the portion of NDP when an alternative was provided. * The USACE agrees that the applicant for the Northern Durham Parkway portion of the project should be Durham or NCDOT. The Developer could apply for a permit for the industrial development and NDP; however, similar projects in the past have not received a favorable review. * The USACE agrees that all impacts requiring mitigation will be the result of the North Durham Parkway portion of the project. Impacts within the Welcome Venture Park portion of the project are only those proposed to impact a pond and therefore, mitigation is not required. The Corps would only be able to make that determination after reviewing the preconstruction notification and final plan sheets.
