Good afternoon Colleen,
In regards to your previous request for additional information. Please see our responses below:
1. Please provide a copy of the overlay of the cleared areas on top of the PJD as requested by the USACE on June 10, 2022. I see it referenced several times (including
the email between James Lastinger and Zak Shipman dated July 21, 2022, that you attached to your Additional Information Response dated July 25, 2022) , but I do not see a copy of the
overlay map. [15A NCAC 02H .0502(c)] Please see attached overlay map (C-02) depicting the cleared areas.
2. Impact amounts for Wetland Impacts C & D appear to be rounded down instead of up. For instance, Sheet WI-09 shows 0.0019 acres of permanent wetlands impacts . The
revised PCN dated 7/20/22 says 0.001 ac, when this should be 0.002 ac. Please provide an updated wetlands impact table. [15A NCAC 02H .0502(c)]. These have been updated, please see attached
revised PCN
3. I want to make sure I’m understanding the dashed line that I’ve highlighted in yellow in the below snip from Sheet WI-06. Is this a parcel boundary? [15A NCAC 02H
.0502(a)(9)] Per the project engineer, The dashed line is the legal recorded maintenance easement for the offsite septic lot Lot 48A as shown on the attached (C-03). Lot 48A is offsite
septic lot for Lot 48, which is located immediately adjacent to the north west. We are required to have legal deeded access for the offsite lot to the public right-of-way for the offsite
septic lot, however in this case all maintenance traffic for Lot 48A can access the offsite lot from the back of Lot 48 via a small easement across the bottom of Lot 49. Therefore we
do not anticipate any maintenance traffic using the legal maintenance easement to access Lot 48A.
4. Please confirm that there are no wetlands impacts in the area that I’ve highlighted yellow from Sheet WI-01. It looks like there is something very close to the wetlands,
and I can’t tell that it is outside the wetlands area on my screen. [15A NCAC 02H .0502(a)(9)] Per the project engineer, there are no proposed wetland impacts for the highlighted area.
Please let me know if this information will suffice.

1. Impact area C has been minimized further with a shift of roadway design, please see attached revised impact maps as well as updated PCN above.
2. I believe Zak Shipman has taken care of this issue and provided you with a response. I have attached email correspondence above.

Camden,
After review of the above referenced PCN received on 6-3-22, it has been considered incomplete. Please address the below items so that we may be able to continue our review of the proposed
activity/PCN:
1. Under general condition 23a. Mitigation, the activity must be designed and constructed to avoid and minimize adverse effects, both temporary and permanent, to waters of the United
States to the maximum extent practicable at the project site (i.e., on site). After review of the proposed plans it appears that further avoidance of waters of the US could occur, specifically
at impact area C (Streams F and F2) by located the proposed road/cul-de-sac further east. Please provide further justification for this proposed impacts in this location or revised
plans demonstrating further avoidance and minimization.
2. On May 27, 2022 it came to our attention through an NOV from the town of Pittsboro that unauthorized activities may have occurred on the site through mechanized land clearing within
jurisdictional areas without a permit verification. (number 4 on the attached NOV). To date this has been unresolved. Please verify that no unauthorized activities have occurred within
potential waters of the US. Until an appropriate resolution occurs either through voluntary restoration or ATF permitting or it has been verified that no unauthorized activities have
occurred, your PCN will not be processed.
Please let me know if you have any questions or concerns regarding any of the above.
