Per the project engineer: Shifting Preston Trace, the road in question, further east to avoid Impact C (i.e. feature F and the linear wetland) is not feasible for a few reasons. Shifting the road east to completely clear feature F and the linear wetland would shift the bulb of the cul-de-sac to the middle of the only septic suitable soils space/lot for Lot 54 (see sheet Impact C Justification Exhibit). There is not any additional available space with suitable soils within the project boundaries or offsite to provide septic service to lot 54 if we lose that dedicated space/lot (see sheet C-20). Additionally shifting the road east would necessitate moving the large stormwater basin currently at the corner of lot 56 to the west side of the road (see sheet C-29 Partial Grading IX-C-29). Pushing the stormwater basin any further east isn't feasible due to Town of Pittsboro park/open space commitments and offsite septic lot access requirements. The option of moving the pond to the west side of the road significantly complicates stormwater management design for this area due to the topography and the need to preserve the downstream sections of streams F and F2. By shifting the stormwater pond to the west side of the road, feature F2 would need to be crossed, the feature that runs parallel to Preston Trace (along the front of Lot 50) with a pipe/ditch to pick up the stormwater runoff. This option is impractical and adds additional stream impacts which we were trying to avoid. In other words, relocating the stormwater basin does not allow runoff to enter the stormwater system from the upstream lots because the basin would need to be located upgradient from the surrounding area. The topography dips down through a low spot near feature F2 and then goes back up into upland areas. It would be difficult or impractical to get water upgradient and into the relocated stormwater basin for treatment (the grades just don't work to get water in and then discharge it in a safe way). If the runoff cannot be directed into the stormwater basin for treatment, it would then have to "bypass" the stormwater system. Additional runoff bypassing the stormwater basin would not comply with NCDEQ and Town of Pittsboro Stormwater regulations that dictate treatment for the 1st inch of runoff AND control peak flow rates for the 1-year design storm. Please address the below items so that we may be able to continue our review of the proposed activity/PCN: 1. Under general condition 23a. Mitigation, the activity must be designed and constructed to avoid and minimize adverse effects, both temporary and permanent, to waters of the United States to the maximum extent practicable at the project site (i.e., on site). After review of the proposed plans it appears that further avoidance of waters of the US could occur, specifically at impact area C (Streams F and F2) by located the proposed road/cul-de-sac further east. Please provide further justification for this proposed impacts in this location or revised plans demonstrating further avoidance and minimization. 2. On May 27, 2022 it came to our attention through an NOV from the town of Pittsboro that unauthorized activities may have occurred on the site through mechanized land clearing within jurisdictional areas without a permit verification. (number 4 on the attached NOV). To date this has been unresolved. Please verify that no unauthorized activities have occurred within potential waters of the US. Until an appropriate resolution occurs either through voluntary restoration or ATF permitting or it has been verified that no unauthorized activities have occurred, your PCN will not be processed.
