Mr. Syster,
On April 23, 2021 , the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application isincomplete
and cannot be processed. The application is on -hold until all of the following information is received:
* You have proposed to offset impacts to open waters (Pond 1) through restoration of 456' of Unnamed Tributary
1 (UTI). Please provide a complete Permittee Responsible Mitigation Plan (PRIVIP) to address how the mitigation
will be implemented. Please describe at minimum: how the mitigation will be constructed, monitored,
adaptivek/managed, protected inperpetuity, and reported tothe Division [l54NCA[02H.0SO6(c)].You
indicated in correspondence dated April 5, 2021 you the PRIVIP was attached to the permit submittal. The PRIVIP
cannot belocated within the submitted documents.
* Please inform this office ifthe U.S. Army Corps nfEngineers has authorized use ofNationwide Permit 29for the

proper consideration ofthe application. Please respond in writing within 30 calendar days of receipt of this letter by
sending one (1) copy of all of the above requested information in response to this email OR by submitting all of the

if all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be
unable toapprove the application and itwill bedenied asincomplete. The denial ofthis project will necessitate
reapplication to the Division for approval, including a complete application package and the appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any
work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
