This rulemaking effort is to clarify and correct these issues for stakeholders. I. Executive Summary The purpose of this document is to provide a regulatory impact analysis addressing the fiscal impacts associated with the readoption cleanup amendments to this set of rules. These rules either contained an error introduced to the rule during the readoption process or carried forward by mistake due to the volume of rules undergoing readoption review. None of the proposed amendments result in a substantial economic impact. No monetary impact is expected from this rule package as the amendments neither increase nor decrease the burden to stakeholders. These amendments are solely for improving clarity to stakeholders and do not encompass changes to the implementation of the rule. 2 Because there are no anticipated state government, local government, or substantial impacts from the proposed rule revisions, a fiscal and regulatory impact analysis (RIA) is not required. An RIA is also not required for the proposed repeal of Rule 15A NCAC 02D .09601; however, it is the practice of the Department to submit an RIA along with the amended rules when taking revisions out to public comment such as with this package of rules. A public comment period will be planned for 60 days with a public hearing, as required by 40 CFR Part 51, as some of these rules are part of the State Implementation Plan (SIP), and ultimately require approval by the Environmental Protection Agency (EPA). The proposed revisions consist of clarifying administrative updates with no impact to the State or local government, and do not rise to the level of substantial impact to the regulated community. II. Background N.C. Gen. Stat. §150B-21.3A, adopted in 2013, requires state agencies to review existing rules every 10 years. Following an initial review, rules will then be periodically assessed on a 10-year review cycle. The Division of Air Quality (DAQ) had several hundred rules to process through a multi-year readoption effort. This effort comprised of separating the rules into six groups to better manage the quantity and scope of the rule readoption requirement placed on the Division. Despite best efforts, some errors were introduced or carried forward during the readoption process which was completed as statutorily required by the December 2020 deadline. In January of 2022 a cleanup effort was initiated to identify errors and any necessary clarifications arising since the rules were adopted into the code. A stakeholder request was sent out for help identifying any potential rules with errors following the readoption effort. This resulted in over thirty rules being identified as requiring further attention and investigation. Upon receiving comments from stakeholders, it was determined the rules could be organized into two rulemaking packages known as Part A and Part B. Part A of the Rule Readoption Cleanup effort included ten rules which could be described as technical corrections without the requirement of approval by the Rules Review Commission (RRC).2 Part A rules were incorporated into the North Carolina Administrative Code (NCAC) as of October 1, 2022. Part B package consists of rules that require more than a technical change but are not substantive enough of a revision to require separate rulemaking attention. See Table 1 below for the complete list of Rules included in this Part B package of the Rule Readoption Cleanup effort. An example of an amended error is a missing word or part of a sentence which was inadvertently deleted at some point in the readoption process resulting in stakeholder confusion. In such a circumstance, the Division continues to apply the rule as it was prior to the readoption effort, therefore restoring the full sentence for stakeholder clarity. Proposed Rule Changes Section .0100-General Provisions 15A NCAC 02Q .0102 Activities Exempted from Permit Requirements Internal Stakeholders provided comment on the rule regarding the beginning sentence of paragraph (g)(13) which was inadvertently cutoff as it had been both underlined and strikethrough during editing. This change introduced during the readoption amendment process caused an error requiring clarification. The Division agrees with the comment and has revised the sentence to revert to the original language at the beginning of paragraph (g)(13) for clarity. This change makes the purpose of the rule clearer as to the intention to exempt landfills from permitting if they are not large enough in size and volume to qualify as a Title V facility in accordance with the New Standard Source Performance Standard (NSPS). Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of this rule change. Section .0500-Emission Control Standards 15A NCAC 02D .0503 Particulates from Fuel Burning Indirect Heat Exchangers 4 The EPA commented that the definition of “plant site” includes some ambiguity for common legal control and requests the word “under” to replace “in” for this requirement in Subparagraph (a)(3). The Division agrees with the comment and revises the term “in” for ownership to “under” removing any ambiguity. This definition is now consistent among rules .0503 and .0504. Additionally, a typographical error was discovered and resolved for the units in the table while working on the rule. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. 15A NCAC 02D .0506 Particulates from Hot Mix Asphalt Plants The EPA commented on a concern regarding changes to Paragraph (e) introduced during the RRC process after the public comment period ended and requested the language reflect the rule as it was for the public comment period. The Division agrees. The Division will revise the language to the way it was written as it went for notice to public comment. Additionally, a typographical error was discovered and resolved for the equation spacing to make the rule easier to read. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. 15A NCAC 02D .0532 Sources Contributing to an Ambient Violation The EPA commented on a clarification correction in Paragraph (c). The Division agrees to revise the list of pollutants in Subparagraph (c)(3) to match with the ambient pollutants listed in Subparagraph (c)(4). During the readoption process the phrase “particulate matter” was removed with the intention to replace it with the more accurate pollutant terms “PM2.5” and “PM10” as is reflected in the current Subparagraph (c)(4) list. With this correction Paragraph (c) in the rule becomes clear for stakeholders to read. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of this rule change. Section .0600-Monitoring: Recordkeeping: Reporting 15A NCAC 02D .0613 Quality Assurance Program Internal Stakeholders provided comment for Paragraph (e). The Division agrees to amend the typo “systems” to singular “system” in Paragraph (e) of the rule. Additionally, in Paragraph (c) the proposed 57 FR 46114 from 10/07/1992 is outdated and should have been updated during the rule readoption process. Historically there was a follow-up rule proposal 68 FR 24692 on 05/08/2003 and the EPA finalized this method in October 2004. Therefore, the quality assurance Method 203 is no longer a proposal but finalized by the EPA so the language describing it as a “proposal” is removed.3 Upon consultation and 3 Link: https://www.reginfo.gov/public/do/eAgendaViewRule?pubId=200404&RIN=2060-AH23 this link leads to the “Amendments to the Standard of Performance for New Stationary Sources; Monitoring Requirements (40 CFR 5 review within the department, no change in application for permitting or compliance was identified as a result of this rule change. 15A NCAC 02D .0614 Compliance Assurance Program The EPA commented on an administrative style update be corrected in Subparagraph (a)(3) to specify this language applies to the whole Rule. An internal stakeholder also commented on Subparagraph (a)(3) concerned about the reference which pointed to the definition for “potential to emit” where instead, the definition for “potential emissions” currently exists in Rule 15A NCAC 02Q .0103. For clarification, as part of this rulemaking cleanup process Rule 15A NCAC 02Q .0103 was kept intact and continues to apply to an entire permitted facility. Rule .0614 was revised to resolve the error by defining “potential to emit” as found in 40 CFR 64.1 and applies to each specific emission source within a facility. Paragraph (c) in the Rule already indicated definitions for terms should be as found in 40 CFR 64.1. Therefore, the error of citation to the 02Q definition was overlooked during readoption as the Division staff has historically applied the EPA’s definition for “potential to emit” when implementing this Rule. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. Section .0700-Toxic Air Pollution Procedures 15A NCAC 02Q .0706 Modification The Division agrees to amend the error which occurred during the readoption process. The missing phrase “or .0500” is added back at the end of the sentence for Paragraph (a)(1). During the readoption preplanning period it was decided for Paragraph (a) to be parsed into parts for added stakeholder clarity. The fiscal note associated with the Group three readoption package describes the changes to rule 02Q .0706 as being for clarity only. Additionally other rules in the Toxic Air Pollutant Procedures added the phrase “15A NCAC 02Q .0300 or .0500” as a means for adding specificity for the phrase “applicable rules”. Rule 02Q .0704 is an example. Therefore, it is clear the missing “or .0500” was a mistake introduced during the readoption process and will be corrected to eliminate any potential for stakeholder confusion. There is no potential for stakeholder impact as the rule continues to be implemented the same as always and will continue the same manner of application after this clarification amendment is adopted. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. Section .0900-Volatile Organic Compounds 15A NCAC 02D .0918 Can Coating Part 60, Appendix F, Procedure 3)” RIN: 2060-AH23 Publication Spring 2004 found on the Office of Information and Regulatory Affairs website. 6 Internal Stakeholders commented concerning language in Subparagraph (c)(3) as an error in the sentence where a phrase was inadvertently repeated. The Division addressed the grammatical issues in the rule, rewording Subparagraph (c)(3) to read “from either a three-piece applicator or a three-piece can side-seam spray.” These different types of coating sprayers are two separate devices, and it was confusing to have them identified as a singular device. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. 15A NCAC 02D .0926 Bulk Gasoline Plants The EPA submitted a comment on rule .0960 to be repealed and remove the related references to the repealed rule. The Division agrees to amend the reference to the repealed rule, and it is updated where applicable. The reference to rule 15A NCAC .2615 was also deleted as duplicative because rule .0932 references .2615 for acceptable test methodology. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. 15A NCAC 02D .0927 Bulk Gasoline Terminals The EPA submitted a comment on rule .0960 to be repealed and remove the related references to the repealed rule. The Division agrees to amend the reference to the repealed rule, and it is updated where applicable. The reference to rule 15A NCAC .2615 was also deleted as duplicative because rule .0932 references .2615 for acceptable test methodology. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. 15A NCAC 02D .0928 Gasoline Service Stations Stage 1 Internal Stakeholders requested for a definition to be added for “motor vehicle” to align with the statutory definition the Department of Motor Vehicles utilizes. Because the compliance group which utilizes this rule regularly receives questions from stakeholders about “motor vehicle” for stage one vapor recovery at refueling stations, the group believed it would be a service to the regulated community to make it easier for them to find the pertinent definition within the rule. This was a suggestion made during the readoption process but was not completed due to the large number of rules being processed and was erroneously left out of the draft versions of the rule. Now is the best opportunity to incorporate this clarifying amendment. The Division agrees to add the new definition based on the statutory language in N.C. Gen. Stat. 20-4.01 and renumber the list of definitions. While amending the Rule two grammatical changes were identified and corrected in Paragraph (d). Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. 15A NCAC 02D .0932 Gasoline Cargo Tanks and Vapor Collection Systems 7 The EPA submitted a comment on rule .0960 to be repealed and remove the related references to the repealed rule. The Division agrees to amend the reference to the repealed rule if found and updated where applicable; Rule .0932 was reviewed as part of this comment, but only administrative updates were identified for correction. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. 15A NCAC 02D .0960 Cargo Tank Leak Tester Report The EPA sent a comment believing NC should repeal this rule from the NCAC as it is redundant. The EPA also recommended removing references to Rule .0960 where applicable. The Division is proposing to repeal this rule to address the EPA comment. The requirements in this rule are duplicative of the record keeping requirements on the cargo tank owner in Rule .0932 and are no longer necessary due to the rule readoption changes to the statewide sticker inspection program for cargo tanks approved in 2020. Previously under the state managed sticker program the Rule .0932 language for record keeping applied to inspection facilities, but during the rule readoption process the rule was revamped to focus on the cargo tank owners and their obligations regarding vapor leak inspections. This obligation included the record keeping requirement from Rule .0960, and so the exact language was incorporated into Rule .0932 verbatim. Therefore, the entirety of Rule .0960 is now redundant. Because the rule package for Group 6 included over 100 rules and the comments were unpredictable, both Rules .0932 and .0960 were included to ensure the record keeping requirements for cargo tank owners were retained. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of this repeal. 15A NCAC 02D .0961 Offset Lithographic Printing and Letterpress Printing Internal Stakeholders provided a clarification correction. The Division addressed the issues in the rule by revising (l)(4) for clarification and removing the ambiguous “that” in the sentence. While amending the rule administrative changes were identified and corrected in Paragraphs (j) and (k). Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. 15A NCAC 02D .0964 Miscellaneous Industrial Adhesives Internal Stakeholders provided a clarification correction. The Division addressed the issue of concern in the definition for “airless spray” and used the EPA 453/R-08-005 September 2008 Control Techniques Guidelines for Miscellaneous Industrial Adhesives as the basis for correction. While amending the rule, grammatical changes were identified and corrected including a typographical error “1” incorporated by mistake during previous amendment process. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. 8 Section .1400-Nitrogen Oxides 15A NCAC 02D .1403 Compliance Schedules Internal Stakeholders provided a clarification correction. The Division addressed the issue of concern to Paragraph (d)(1) for improved clarity and less ambiguity. While amending the rule administrative changes were identified and corrected. Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. Section .1700-Municipal Solid Waste Landfills 15A NCAC 02D .1708 Reporting Requirements Internal Stakeholders provided a clarification correction. The Division addressed the issue of concern regarding the phrase “has already” which seemed ambiguous to stakeholders and proposes to replace it with the term “previously” as the solution for Paragraph (e). While amending the rule administrative and grammatical changes were identified and corrected such as amending a semicolon to a comma in Paragraph (k). Upon consultation and review within the department, no change in application for permitting or compliance was identified as a result of these rule changes. IV. Fiscal Impact Summary There are sixteen rules proposed for amendment and one rule proposed for repeal pursuant to the requirements of G.S. 150-B. All rules listed in Table 1 as described in Section III are being proposed as administrative changes for clarity. None of the proposed changes will result in requirements being added or removed. As such, there will be no economic impacts to the regulated community or DEQ. The majority of rule amendment proposals correct inadvertent mistakes introduced during the readoption process. Other administrative clarifications were also addressed as a way to maximize efficiency of the rule cleanup effort. It is possible the improved readability of the rules with save applicants time in applying for permits and save DEQ time in reviewing permits and conducting compliance tasks. The amount of time saved would be negligible and any potential impacts would be de minimis. V. Conclusion The proposed amendments are administrative in nature to clean up and clarify issues resulting from the first readoption effort ending December 2020. Stakeholders will be given an opportunity to comment on the proposed rule changes and this RIA during the comment period and public hearing. The proposed amendments and proposed repeal do not result in a State or local government fiscal impact or substantial economic impact to the regulated community or other parties. 1 of 2 15A NCAC 02D .0503 is proposed for amendment as follows: 1 2 15A NCAC 02D .0503 PARTICULATES FROM FUEL BURNING INDIRECT HEAT EXCHANGERS 3 (a) For the purpose of this Rule, the following definitions shall apply: 4 (1) "Functionally dependent" means that structures, buildings, or equipment are interconnected through 5 common process streams, supply lines, flues, or stacks. 6 (2) "Indirect heat exchanger" means any equipment used for the alteration of the temperature of one 7 fluid by the use of another fluid in which the two fluids are separated by an impervious surface such 8 that there is no mixing of the two fluids. 9 (3) "Plant site" means any single or collection of structures, buildings, facilities, equipment, 10 installations, or operations that: 11 (A) are located on one or more adjacent properties; 12 (B) are inunder common legal control; and 13 (C) are functionally dependent in their operations. 14 (b) The definition contained in Subparagraph (a)(3) of this Rule does not affect the calculation of the allowable 15 emission rate of any indirect heat exchanger permitted prior to April 1, 1999. 16 (c) The emissions of particulate matter from the combustion of a fuel that are discharged from any stack or chimney 17 into the atmosphere shall not exceed: 18 19 Allowable Emission Limit 20 Maximum Heat Input In For Particulate Matter In 21 Million Btu/Hour In Lb/Millionlb/Million Btu 22 23 Up to and Including 10 0.60 24 100 0.33 25 1,000 0.18 26 10,000 and Greater 0.10 27 28 For a heat input between any two consecutive heat inputs stated in the table set forth in this Paragraph, the allowable 29 emissions of particulate matter shall be calculated by the equation E= 1.090*Q-0.2594. "E" equals the allowable emission 30 limit for particulate matter in lb/million Btu. "Q" equals the maximum heat input in million Btu/hour. 31 (d) This Rule applies to installations in which fuel is burned for the purpose of producing heat or power by indirect 32 heat transfer. Fuels include those such as coal, coke, lignite, peat, natural gas, and fuel oils, but exclude wood and 33 refuse not burned as a fuel. When any refuse, products, or by-products of a manufacturing process are burned as a fuel 34 rather than refuse, or in conjunction with any fuel, this allowable emission limit shall apply. 35 (e) For the purpose of this Rule, the maximum heat input shall be the total heat content of all fuels which are burned 36 in a fuel burning indirect heat exchanger, of which the combustion products are emitted through a stack or stacks. The 37 2 of 2 sum of maximum heat input of all fuel burning indirect heat exchangers at a plant site which are in operation, under 1 construction, or permitted pursuant to 15A NCAC 02Q, shall be considered as the total heat input for the purpose of 2 determining the allowable emission limit for particulate matter for each fuel burning indirect heat exchanger. Fuel 3 burning indirect heat exchangers constructed or permitted after February 1, 1983, shall not change the allowable 4 emission limit of any fuel burning indirect heat exchanger whose allowable emission limit has previously been set. 5 The removal of a fuel burning indirect heat exchanger shall not change the allowable emission limit of any fuel burning 6 indirect heat exchanger whose allowable emission limit has previously been established. However, for any fuel 7 burning indirect heat exchanger constructed after, or in conjunction with, the removal of another fuel burning indirect 8 heat exchanger at the plant site, the maximum heat input of the removed fuel burning indirect heat exchanger shall no 9 longer be considered in the determination of the allowable emission limit of any fuel burning indirect heat exchanger 10 constructed after or in conjunction with the removal. For the purposes of this Paragraph, refuse not burned as a fuel 11 and wood shall not be considered a fuel. For residential facilities or institutions, such as military and educational, 12 whose primary fuel burning capacity is for comfort heat, only those fuel burning indirect heat exchangers located in 13 the same power plant or building or otherwise physically interconnected, such as common flues, steam, or power 14 distribution line, shall be used to determine the total heat input. 15 (f) The emission limit for fuel burning equipment that burns both wood and other fuels in combination, or for wood 16 and other fuel burning equipment that is operated such that emissions are measured on a combined basis, shall be 17 calculated by the equation Ec = [(EW)(Qw) + (Eo)(Qo)] /Qt. 18 (1) Ec = the emission limit for combination or combined emission source(s) in lb/million Btu. 19 (2) Ew = plant site emission limit for wood only as determined pursuant to 15A NCAC 02D .0504 in 20 lb/million Btu. 21 (3) Eo = the plant site emission limit for other fuels only as determined by Paragraphs (a), (b) and (c) 22 of this Rule in lb/million Btu. 23 (4) Qw = the actual wood heat input to the combination or combined emission source(s) in Btu/hr. 24 (5) Qo = the actual other fuels heat input to the combination or combined emission source(s) in Btu/hr. 25 (6) Qt = Qw + Qo and is the actual total heat input to combination or combined emission source(s) in 26 Btu/hr. 27 28 History Note: Authority G.S. 143-215.3(a)(1); 143-215.107(a)(5); 29 Eff. November 1, 2020.2020; 34 Amended Eff. 35 36 37 1 of 1 15A NCAC 02D .0506 is proposed for amendment as follows: 1 2 15A NCAC 02D .0506 PARTICULATES FROM HOT MIX ASPHALT PLANTS 3 (a) The allowable emission rate for particulate matter resulting from the operation of a hot mix asphalt plant that are 4 discharged from any stack or chimney into the atmosphere shall not exceed the level calculated with the equation 5 E = 4.9445(P)0.4376 6 calculated to three significant figures, for process rates less than 300 tons per hour, where "E" equals the maximum 7 allowable emission rate for particulate matter in pounds per hour and "P" equals the process rate in tons per hour. The 8 allowable emission rate shall be 60.0 pounds per hour for process rates equal to or greater than 300 tons per hour. 9 (b) Visible emissions from stacks or vents at a hot mix asphalt plant shall not exceed 20 percent opacity when averaged 10 over a six-minute period. 11 (c) All hot mix asphalt batch plants shall be equipped with a scavenger process dust control system for the drying, 12 conveying, classifying, and mixing equipment. The scavenger process dust control system shall exhaust through a 13 stack or vent and shall be operated and maintained in such a manner as to comply with Paragraphs (a) and (b) of this 14 Rule. 15 (d) Fugitive non-process dust emissions shall be controlled by 15A NCAC 02D .0540. 16 (e) Fugitive emissions for sources at a hot mix asphalt plant not covered by Paragraphs (a) through (d) of this Rule 17 shall not exceed 20 percent opacity averaged over six minutes. 18 19 History Note: Authority G.S. 143-215.3(a)(1); 143-215.107(a)(5); 20 Eff. November 1, 2020.2020; 23 Amended Eff. 24 25 26 1 of 3 15A NCAC 02D .0532 is proposed for amendment as follows: 1 2 15A NCAC 02D .0532 SOURCES CONTRIBUTING TO AN AMBIENT VIOLATION 3 (a) This Rule applies to new major stationary sources and major modifications to which 15A NCAC 02D .0531 does 4 not apply and which would contribute to a violation of a national ambient air quality standard but which would not 5 cause a new violation. 6 (b) For the purpose of this Rule the definitions contained in Section II.A. of Appendix S of 40 CFR Part 51 shall 7 apply. 8 (c) The Rule is not applicable to: 9 (1) emission of pollutants for which the area in which the new or modified source is located is 10 designated as nonattainment; 11 (2) emission of pollutants for which the source or modification is not major; 12 (3) emission of pollutants other than sulfur dioxide, PM2.5, nitrogen oxides, and carbon monoxide; 13 monoxide, and PM10; 14 (4) a new or modified source whose impact will not increase more than: 15 (A) 1.0 µg/m3 of SO2 on an annual basis; 16 (B) 5 µg/m3 of SO2 on a 24-hour basis; 17 (C) 25 µg/m3 of SO2 on a 3-hour basis; 18 (D) 0.3 µg/m3 of PM2.5 on an annual basis; 19 (E) 1.2 µg/m3 of PM2.5 on a 24-hour basis; 20 (F) 1.0 µg/m3 of NO2 on an annual basis; 21 (G) 0.5 mg/m3 of carbon monoxide on an 8-hour basis; 22 (H) 2 mg/m3 of carbon monoxide on a one-hour basis; 23 (I) 1.0 µg/m3 of PM10 on an annual basis; or 24 (J) 5 µg/m3 of PM10 on a 24-hour basis 25 at any locality that does not meet a national ambient air quality standard; 26 (5) sources which are not major unless secondary emissions are included in calculating the potential to 27 emit; 28 (6) sources which are exempted by the provision in Section II.F. of Appendix S of 40 CFR Part 51; 29 (7) temporary emission sources which will be relocated within two years; and 30 (8) emissions resulting from the construction phase of the source. 31 (d) 15A NCAC 02Q .0102 is not applicable to any source to which this Rule applies. The owner or operator of the 32 source shall apply for and receive a permit as required in 15A NCAC 02Q .0300 or .0500. 33 (e) To issue a permit to a new or modified source to which this Rule applies, the Director shall determine that the 34 source will meet the following conditions: 35 (1) The sources will emit the nonattainment pollutant at a rate no more than the lowest achievable 36 emission rate; 37 2 of 3 (2) The owner or operator of the proposed new or modified source has demonstrated that all major 1 stationary sources in the State that are owned or operated by this person (or any entity controlling, 2 controlled by, or under common control with this person) are subject to emission limitations and are 3 in compliance, or on a schedule for compliance which is federally enforceable or contained in a 4 court decree, with all applicable emission limitations and standards of this Subchapter which EPA 5 has authority to approve as elements of the North Carolina State Implementation Plan for Air 6 Quality; and 7 (3) The source will satisfy one of the following conditions: 8 (A) The source will comply with 15A NCAC 02D .0531(i) when the source is evaluated as if 9 it were in the nonattainment area; or 10 (B) The source will have an air quality offset, i.e., the applicant will have caused an air quality 11 improvement in the locality where the national ambient air quality standard is not met by 12 causing reductions in impacts of other sources greater than any additional impact caused 13 by the source for which the application is being made. The emissions reductions creating 14 the air quality offset shall be placed as a condition in the permit for the source reducing 15 emissions. The requirements of this Part may be partially waived if the source is a resource 16 recovery facility burning municipal solid waste, the source must switch fuels due to lack 17 of adequate fuel supplies, or the source is required to be modified as a result of EPA 18 regulations and no exemption from such regulations is available and if: 19 (i) the permit applicant demonstrates that it made its best efforts to obtain sufficient 20 air quality offsets to comply with this Part; 21 (ii) the applicant has secured all available air quality offsets; and 22 (iii) the applicant will continue to seek the necessary air quality offsets and apply them 23 when they become available. 24 (f) At such time that a particular source or modification becomes a major stationary source or major modification 25 solely by virtue of a relaxation in any enforceable limitation established after August 7, 1980, on the capacity of the 26 source or modification to emit a pollutant, such as a restriction on hours of operation, then the provisions of this Rule 27 shall apply to the source or modification as though construction had not yet begun on the source or modification. 28 (g) The version of the Code of Federal Regulations incorporated in this Rule is that as of July 1, 2019, at 29 https://www.govinfo.gov/content/pkg/CFR-2019-title40-vol2/pdf/CFR-2019-title40-vol2-part51-appS.pdf and does 30 not include any subsequent amendments or editions to the referenced material. November 1, 2020.2020; 2 Amended Eff. 3 4 5 1 of 2 15A NCAC 02D .0613 is proposed for amendment as follows: 1 2 15A NCAC 02D .0613 QUALITY ASSURANCE PROGRAM 3 (a) Any owner or operator of a facility required to operate a monitoring device by this Subchapters 02D or 02Q of 4 this Chapter shall develop and implement a quality assurance program for the monitoring device. 5 (b) The Director shall require the owner or operator of a facility required to operate a monitoring device by 6 Subchapters 02D or 02Q of this Chapter to submit a description of the quality assurance program if: 7 (1) the maximum actual emission rate is more than 75 percent of the applicable emission standard; 8 (2) the facility has violated an emission standard or a permit condition; or 9 (3) the facility has failed to obtain quality assured data. 10 A description of the quality assurance program shall be submitted to the Director within 60 days upon receipt of 11 request. 12 (c) Except for gaseous continuous emission monitoring systems, the quality assurance program required by Paragraph 13 (a) or (b) of this Rule shall include, if applicable: 14 (1) procedures and frequencies for calibration; 15 (2) standards traceability; 16 (3) operational checks; 17 (4) maintenance; 18 (5) auditing; 19 (6) data validation; and 20 (7) a schedule for implementing the quality assurance program. 21 Continuous opacity monitoring systems may satisfy the requirements of Paragraph (a) of this Rule by complying with 22 40 CFR Part 51, Appendix M, Method 203, as proposed in 57 FR 46114, or 40 CFR Part 60, Appendix F, Procedure 23 3. Except for opacity monitors and gaseous continuous emission monitoring systems, a manufacturer's recommended 24 quality assurance procedure may be used as a quality assurance program if it includes the applicable requirements in 25 Subparagraphs (c)(1) through (c)(7) of this Paragraph. 26 (d) Owners or operators that operate continuous emission monitoring systems for a gaseous pollutant may satisfy the 27 requirements of Paragraphs (a) or (b) of this Rule by developing and implementing a written quality assurance program 28 containing information required by 40 CFR Part 60, Appendix F, Section 3, Quality Assurance Procedures. 29 (e) The owner or operator of a facility shall certify all opacity and gaseous continuous emission monitoring systems 30 following applicable performance specifications in 40 CFR Part 60, Appendix B, within 60 days of monitor installation 31 unless otherwise specified in permit or any other applicable rules. The owner or operator of a facility required to install 32 an opacity or gaseous continuous emission monitoring systemssystem shall notify the Director at least 60 days before 33 installation unless otherwise specified in permit or in 40 CFR Part 60, 61, 63, or 75. The notification shall include 34 plans or schematic diagrams of the proposed monitor location. 35 (f) Quality assurance programs for ambient monitors shall comply with the requirements in 40 CFR Part 58. 36 2 of 2 (g) A description of the quality assurance program shall be available on-site for inspection within 30 days of monitor 1 certification. 2 (h) The Director shall approve the quality assurance program within 30 days of submittal if he or she finds that the 3 quality assurance program will assure that the precision and accuracy of the data for the pollutants being measured 4 are within the design limits of the instruments being used. If the Director finds that the proposed quality assurance 5 program does not meet the requirements of this Paragraph, he or she shall notify the owner or operator of the facility 6 of any deficiencies in the proposed quality assurance program. November 1, 2019.2019; 12 Amended Eff. 13 14 15 1 of 3 15A NCAC 02D .0614 is proposed for amendment as follows: 1 2 15A NCAC 02D .0614 COMPLIANCE ASSURANCE MONITORING 3 (a) General Applicability. Except as set forth in Paragraph (b) of this Rule, the requirements of this Paragraph shall 4 apply to a pollutant-specific emissions unit at a facility required to obtain a permit pursuant to 15A NCAC 02Q 5 .0500 if the unit: 6 (1) is subject to an emission limitation or standard for the applicable regulated air pollutant, or a 7 surrogate thereof, other than an emission limitation or standard that is exempt pursuant to 8 Subparagraph (b)(1) of this Rule; 9 (2) uses a control device to achieve compliance with any such emission limitation or standard; and 10 (3) has potential pre-control device emissions of the applicable regulated air pollutant that are equal to 11 or greater than 100 percent of the amount, in tons per year, required for a source to be classified as 12 a major source. For purposes of this Subparagraph, Rule, "potential pre-control device emissions" 13 means the same as "potential to emit" as defined in 15A NCAC 02Q .0103, 40 CFR 64.1, except 14 that emission reductions achieved by the applicable control device shall not be taken into account. 15 (b) The following exemptions to this Rule shall apply. 16 (1) Exempt emission limitations or standards. The requirements of this Rule shall not apply to any of 17 the following emission limitations or standards: 18 (A) emission limitations or standards proposed by the Administrator of the Environmental 19 Protection Agency after November 15, 1990, pursuant to section 111 or 112 of the federal 20 Clean Air Act; 21 (B) stratospheric ozone protection requirements pursuant to Title VI of the federal Clean Air 22 Act; 23 (C) Acid Rain Program requirements pursuant to sections 404, 405, 406, 407(a), 407(b), or 24 410 of the federal Clean Air Act; 25 (D) emission limitations or standards or other applicable requirements that apply solely under 26 an emissions trading program approved under the rules of Subchapters 02D and 02Q of 27 this Chapter and that are incorporated in a permit issued pursuant to 15A NCAC 02Q 28 .0500; 29 (E) an emissions cap that is approved pursuant to the rules of Subchapters 02D and 02Q of 30 this Chapter and incorporated in a permit issued pursuant to 15A NCAC 02Q .0500; or 31 (F) emission limitations or standards for which a permit issued pursuant to 15A NCAC 02Q 32 .0500 specifies a continuous compliance determination method, as defined in 40 CFR 33 64.1. This exemption shall not apply if the applicable compliance method includes an 34 assumed control device emission reduction factor that could be affected by the actual 35 operation and maintenance of the control device, such as a surface coating line controlled 36 by an incinerator for which continuous compliance is determined by calculating 37 2 of 3 emissions on the basis of coating records and an assumed control device efficiency factor 1 based on an initial performance test. In this example, 15A NCAC 02D .0614 would apply 2 to the control device and capture system, but not to the remaining elements of the coating 3 line, such as raw material usage. 4 (2) Exemption for backup utility power emissions units. The requirements of this Rule shall not apply 5 to a utility unit, as defined in 40 CFR 72.2, that is municipally-owned if the owner or operator 6 provides documentation in a permit application submitted pursuant to 15A NCAC 02Q .0500 that: 7 (A) the utility unit is exempt from all monitoring requirements in 40 CFR Part 75, including 8 the appendices thereto; 9 (B) the utility unit is operated for the sole purpose of providing electricity during periods of 10 peak electrical demand or emergency situations and will be operated consistent with that 11 purpose throughout the permit term. The owner or operator shall provide historical 12 operating data and relevant contractual obligations to document that this criterion is 13 satisfied; and 14 (C) the actual emissions from the utility unit, based on the average annual emissions over the 15 last three calendar years of operation, or such shorter time period that is available for 16 units with fewer than three years of operation, are less than 50 tons per year and are 17 expected to remain so. 18 (c) For the purposes of this Rule, the definitions in 40 CFR 64.1 shall apply with the following exceptions: 19 (1) "Applicable requirement" and "regulated air pollutant" shall have the same definition as in 15A 20 NCAC 02Q .0103. 21 (2) "Part 70 or 71 permit application" means an application, or any supplement to a previously 22 submitted application, submitted by the owner or operator to obtain a permit under 15A NCAC 23 02Q .0500. 24 (3) "Part 70 or 71 permit" means a permit issued under 15A NCAC 02Q .0500. 25 (4) "Permitting authority" means the Division of Air Quality. 26 (d) The owner or operator subject to the requirements of this rule shall comply with these requirements: 27 (1) 40 CFR 64.3, Monitoring Design Criteria; 28 (2) 40 CFR 64.4, Submittal Requirements; 29 (3) 40 CFR 64.5, Deadlines for Submittals; 30 (4) 40 CFR 64.7, Operation of Approved Monitoring; and 31 (5) 40 CFR 64.9, Reporting and Recordkeeping Requirements. 32 (e) The Division shall follow the procedures and requirements in 40 CFR Part 64.6, Approval of Monitoring, in 33 reviewing and approving or disapproving monitoring plans and programs submitted under this Rule. 34 (f) Based on the result of a determination made pursuant to 40 CFR 64.7(d)(2), the Director may require the owner 35 or operator to develop and implement a quality improvement plan. November 1, 2019.2019; 7 Amended Eff. 8 9 10 1 of 2 15A NCAC 02D .0918 is proposed for amendment as follows: 1 2 15A NCAC 02D .0918 CAN COATING 3 (a) For the purpose of this Rule, the following definitions shall apply: 4 (1) "End sealing compound" means a synthetic rubber compound that is coated onto can ends and 5 functions as a gasket when the end is assembled on the can. 6 (2) "Exterior base coating" means a coating applied to the exterior of a can to provide exterior protection 7 to the metal and to provide background for the lithographic or printing operation. 8 (3) "Interior base coating" means a coating applied by roller coater or spray to the interior of a can to 9 provide a protective lining between the can metal and product. 10 (4) "Interior body spray" means a coating sprayed on the interior of the can body to provide a protective 11 film between the product and the can. 12 (5) "Overvarnish" means a coating applied directly over ink to reduce the coefficient of friction, to 13 provide gloss, and to protect the finish against abrasion and corrosion. 14 (6) "Three-piece can side-seam spray" means a coating sprayed on the exterior and interior of a welded, 15 cemented, or soldered seam to protect the exposed metal. 16 (7) "Two-piece can exterior end coating" means a coating applied by roller coating or spraying to the 17 exterior end of a can to provide protection to the metal. 18 (b) This Rule applies to volatile organic compound emissions from coating applicators and ovens of sheet, can, or 19 end coating lines involved in sheet exterior and interior basecoat and overvarnish; two-piece can interior body spray; 20 two-piece spray or roll coat can exterior; and three-piece can side-seam spray and end sealing compound operations. 21 (c) Unless the exception in Paragraph (d) of this Rule applies, emissions of volatile organic compounds from any can 22 coating line subject to this Rule shall not exceed: 23 (1) 4.5 pounds of volatile organic compounds per gallon of solids delivered to the coating applicator 24 from sheet exterior and interior basecoat and overvarnish or two-piece can exterior basecoat and 25 overvarnish operations; 26 (2) 9.8 pounds of volatile organic compounds per gallon of solids delivered to the coating applicator 27 from two and three-piece can interior body spray and two-piece spray or roll coat can exterior end 28 operations; 29 (3) 21.8 pounds of volatile organic compounds per gallon of solids delivered to the coating applicator 30 from a three-piece applicator from a three-piece can side-seam spray operations;from either a three 31 piece applicator or a three piece can side seam spray operations; or 32 (4) 7.4 pounds of volatile organic compounds per gallon of solids delivered to the coating applicator 33 from end sealing compound operations. 34 (d) Any source that has controlled emissions pursuant to 15A NCAC 02D .0518(e) prior to July 1, 2000 and that has 35 installed air pollution control equipment in accordance with an air quality permit in order to comply with this Rule 36 before December 1, 1989 may comply with the limits contained in this Paragraph instead of those contained in 37 2 of 2 Paragraph (c) of this Rule. Emissions of volatile organic compounds from any can coating line subject to this Rule 1 shall not exceed: 2 (1) 2.8 pounds of volatile organic compounds per gallon of coating, excluding water and exempt 3 compounds, delivered to the coating applicator from sheet exterior and interior basecoat and 4 overvarnish or two-piece can exterior basecoat and overvarnish operations; 5 (2) 4.2 pounds of volatile organic compounds per gallon of coating, excluding water and exempt 6 compounds, delivered to the coating applicator from two and three-piece can interior body spray 7 and two-piece can spray or roll coat exterior end operations; 8 (3) 5.5 pounds of volatile organic compounds per gallon of coating, excluding water and exempt 9 compounds, delivered to the coating applicator from a three-piece applicator from a three-piece can 10 side-seam spray operations; or 11 (4) 3.7 pounds of volatile organic compounds per gallon of coating, excluding water and exempt 12 compounds, delivered to the coating applicator from end sealing compound operations. 13 14 History Note: Authority G.S. 143-215.3(a)(1); 143-215.107(a)(5); 15 Eff. November 1, 2020.2020; 18 Amended Eff. 19 20 21 1 of 3 15A NCAC 02D .0926 is proposed for amendment as follows: 1 2 15A NCAC 02D .0926 BULK GASOLINE PLANTS 3 (a) For the purpose of this Rule, the following definitions apply: 4 (1) "Average daily throughput" means annual throughput of gasoline divided by 312 days per year. 5 (2) "Bottom filling" means the filling of a cargo tank or stationary storage tank through an opening flush 6 with the tank bottom. 7 (3) "Bulk gasoline plant" means a gasoline storage and distribution facility with an average daily 8 throughput of less than 20,000 gallons of gasoline and that typically receives gasoline from bulk 9 terminals by cargo tank transport, stores it in tanks, and subsequently dispenses it via account cargo 10 tanks to farms, businesses, and service stations. 11 (4) "Bulk gasoline terminal" means a gasoline storage facility that typically receives gasoline from 12 refineries primarily by pipeline, ship, or barge; delivers gasoline to bulk gasoline plants or to 13 commercial or retail accounts primarily by cargo tank; and has an average daily throughput of 14 greater than or equal to 20,000 gallons of gasoline. 15 (5) "Cargo tank" means the storage vessels of freight trucks or trailers used to transport gasoline from 16 sources of supply to stationary storage tanks of bulk gasoline terminals, bulk gasoline plants, 17 gasoline dispensing facilities, and gasoline service stations. 18 (6) "Gasoline" means any petroleum distillate having a Reid Vapor Pressure (RVP) of 4.0 psi or greater. 19 (7) "Incoming vapor balance system" means a combination of pipes or hoses that create a closed system 20 between the vapor spaces of an unloading cargo tank and a receiving stationary storage tank such 21 that vapors displaced from the receiving stationary storage tank are transferred to the cargo tank 22 being unloaded. 23 (8) "Outgoing vapor balance system" means a combination of pipes or hoses that create a closed system 24 between the vapor spaces of an unloading stationary storage tank and a receiving cargo tank such 25 that vapors displaced from the receiving cargo tank are transferred to the stationary storage tank 26 being unloaded. 27 (9) "Splash filling" means the filling of a cargo tank or stationary storage tank through a pipe or hose 28 whose discharge opening is above the surface level of the liquid in the tank being filled. 29 (10) "Submerged filling" means the filling of a cargo tank or stationary tank through a pipe or hose whose 30 discharge opening is entirely submerged when the pipe normally used to withdraw liquid from the 31 tank can no longer withdraw any liquid, or whose discharge opening is entirely submerged when 32 the liquid level is six inches above the bottom of the tank. 33 (b) This Rule applies to the unloading, loading, and storage facilities of all bulk gasoline plants, and of all cargo tanks 34 delivering or receiving gasoline at bulk gasoline plants except stationary storage tanks with capacities less than 528 35 gallons. 36 2 of 3 (c) The owner or operator of a bulk gasoline plant shall not transfer gasoline to any stationary storage tanks unless 1 the unloading cargo tank and the receiving stationary storage tank are equipped with an incoming vapor balance system 2 as described in Paragraph (i) of this Rule and the receiving stationary storage tank is equipped with a fill line whose 3 discharge opening is flush with the bottom of the tank. 4 (d) The owner or operator of a bulk gasoline plant with an average daily gasoline throughput of 4,000 gallons or more 5 shall not load cargo tank at such plant unless the unloading stationary storage tank and the receiving cargo tank are 6 equipped with an outgoing vapor balance system as described in Paragraph (i) of this Rule and the receiving cargo 7 tank is equipped for bottom filling. 8 (e) The owner or operator of a bulk gasoline plant with an average daily throughput of more than 2,500 gallons but 9 less than 4,000 gallons located in an area with a housing density exceeding the limits in this Paragraph shall not load 10 any cargo tank at such bulk gasoline plant unless the unloading stationary storage tank and receiving cargo tank are 11 equipped with an outgoing vapor balance system as described in Paragraph (i) of this Rule and the receiving cargo 12 tank is equipped for bottom filling. In the counties of Alamance, Buncombe, Cabarrus, Catawba, Cumberland, 13 Davidson, Durham, Forsyth, Gaston, Guilford, Mecklenburg, New Hanover, Orange, Rowan, and Wake, the specified 14 limit on housing density is 50 residences in a square one mile on a side with the square centered on the loading rack 15 at the bulk gasoline plant and with one side oriented in a true North-South direction. In all other counties the specified 16 limit on housing density is 100 residences per square mile. The housing density shall be determined by counting the 17 number of residences using aerial photographs or other methods approved by the Director to provide equivalent 18 accuracy. 19 (f) The owner or operator of a bulk gasoline plant not subject to the outgoing vapor balance system requirements of 20 Paragraph (d) or (e) of this Rule shall not load cargo tanks at such plants unless: 21 (1) equipment is available at the bulk gasoline plant to provide for submerged filling of each cargo tank; 22 or 23 (2) each receiving cargo tank is equipped for bottom filling. 24 (g) For gasoline bulk plants located in a nonattainment area for ozone, the owner or operator shall continue to comply 25 with Paragraph (d) or (e) of this Rule even if the average daily throughput falls below the applicable threshold if ever 26 the facility throughput triggered compliance. 27 (h) The owner or operator of a bulk gasoline plant shall ensure a cargo tank that is required to be equipped with a 28 vapor balance system pursuant to Paragraphs (c), (d), or (e) of this Rule shall not transfer gasoline between the cargo 29 tank and the stationary storage tank unless: 30 (1) the vapor balance system is in good working order and is connected and operating; 31 (2) cargo tank hatches are closed at all times during loading and unloading operations; and 32 (3) the cargo tank's pressure/vacuum relief valves, hatch covers, and the cargo tank's and storage tank's 33 associated vapor and liquid lines are vapor tight during loading or unloading. 34 (i) Vapor balance systems required under Paragraphs (c), (d), and (e) of this Rule shall consist of the following major 35 components: 36 3 of 3 (1) a vapor space connection on the stationary storage tank equipped with fittings that are vapor tight 1 and will be automatically and immediately closed upon disconnection to prevent release of volatile 2 organic material; 3 (2) a connecting pipe or hose equipped with fittings that are vapor tight and will be automatically and 4 immediately closed upon disconnection to prevent release of volatile organic material; and 5 (3) a vapor space connection on the cargo tank equipped with fittings that are vapor tight and will be 6 automatically and immediately closed upon disconnection to prevent release of volatile organic 7 material. 8 (j) The owner or operator of a bulk gasoline plant shall paint all tanks used for gasoline storage white or silver. 9 (k) The pressure relief valves on cargo tanks loading or unloading at bulk gasoline plants shall be set to release at the 10 highest possible pressure in accordance with State or local fire codes or the National Fire Prevention Association 11 Guidelines. The pressure relief valves on stationary storage tanks shall be set at 0.5 psi for storage tanks placed in 12 service on or after November 1, 1992, and 0.25 psi for storage tanks existing before November 1, 1992. 13 (l) No owner or operator of a bulk gasoline plant may permit gasoline to be spilled, discarded in sewers, stored in 14 open containers, or handled in any other manner that would result in evaporation. 15 (m) The owner or operator of a bulk gasoline plant shall observe loading and unloading operations and shall 16 discontinue the transfer of gasoline: 17 (1) if any liquid leaks are observed; or 18 (2) if any vapor leaks are observed where a vapor balance system is required under Paragraphs (c), (d), 19 or (e) of this Rule. 20 (n) The owner or operator of a bulk gasoline plant shall not load, or allow to be loaded, gasoline into any cargo tank 21 unless the cargo tank has been certified leak tight in accordance with 15A NCAC 02D .0932, .0960, and .2615..0932. 22 23 History Note: Authority G.S. 143-215.3(a)(1); 143-215.107(a)(5); 24 Eff. November 1, 2020.2020; 27 Amended Eff. 28 29 30 1 of 4 15A NCAC 02D .0927 is proposed for amendment as follows: 1 2 15A NCAC 02D .0927 BULK GASOLINE TERMINALS 3 (a) For the purpose of this Rule, the following definitions apply: 4 (1) "Bulk gasoline terminal" means: 5 (A) a pipeline breakout station of an interstate oil pipeline facility; or 6 (B) a gasoline storage facility that typically receives gasoline from refineries primarily by 7 pipeline, ship, or barge; delivers gasoline to bulk gasoline plants or to commercial or retail 8 accounts primarily by cargo tank; and has an average daily throughput of more than 20,000 9 gallons of gasoline. 10 (2) "Cargo tank" means the storage vessels of freight trucks or trailers used to transport gasoline from 11 sources of supply to stationary storage tanks of bulk gasoline terminals, bulk gasoline plants, 12 gasoline dispensing facilities, and gasoline service stations. 13 (3) "Contact deck" means a deck in an internal floating roof tank that rises and falls with the liquid level 14 and floats in direct contact with the liquid surface. 15 (4) "Degassing" means the process by which a tank's interior vapor space is decreased to below the 16 lower explosive limit for the purpose of cleaning, inspection, or repair. 17 (5) "Gasoline" means a petroleum distillate having a Reid Vapor Pressure (RVP) of 4.0 psi or greater. 18 (6) "Leak" means a crack or hole letting petroleum product vapor or liquid escape that is identifiable 19 through sight, sound, smell, an explosimeter, or the use of a meter that measures volatile organic 20 compounds. When an explosimeter or meter is used to detect a leak, a leak is a measurement that 21 is equal to or greater than 100 percent of the lower explosive limit, as detected by a combustible 22 gas detector using the test procedure described in Appendix B of EPA-450/2-78-051. This test 23 procedure is incorporated by reference, including any subsequent amendments and editions. A 24 copy of this test procedure may be obtained free of charge at 25 https://nepis.epa.gov/Exe/ZyPDF.cgi/2000M9RD.PDF?Dockey=2000M9RD.PDF. 26 (7) "Liquid balancing" means a process used to degas floating roof gasoline storage tanks with a liquid 27 whose vapor pressure is below 1.52 psi. This is done by removing as much gasoline as possible 28 without landing the roof on its internal supports, pumping in the replacement fluid, allowing mixing, 29 remove as much mixture as possible without landing the roof, and repeating these steps until the 30 vapor pressure of the mixture is below 1.52 psi. 31 (8) "Liquid displacement" means a process by which gasoline vapors, remaining in an empty tank, are 32 displaced by a liquid with a vapor pressure below 1.52 psi. 33 (9) "Pipeline breakout station" means a facility along a pipeline containing storage tanks used to: 34 (A) relieve surges in a hazardous liquid pipeline system; or 35 (B) receive and store hazardous liquids transported by pipeline for reinjection and continued 36 transport by pipeline. 37 2 of 4 (b) This Rule applies to bulk gasoline terminals and the appurtenant equipment necessary to load the cargo tank 1 compartments. 2 (c) Gasoline shall not be loaded into any cargo tank from any bulk gasoline terminal unless: 3 (1) the bulk gasoline terminal is equipped with a vapor control system that prevents the emissions of 4 volatile organic compounds from exceeding 35 milligrams per liter. The owner or operator shall 5 obtain from the manufacturer and maintain in the cargo tank's records a pre-installation certification 6 stating the vapor control efficiency of the system in use; 7 (2) displaced vapors and gases are vented only to the vapor control system or to a flare; 8 (3) a means is provided to prevent liquid drainage from the loading device when it is not in use or to 9 accomplish complete drainage before the loading device is disconnected; and 10 (4) all loading and vapor lines are equipped with fittings that make vapor-tight connections and that are 11 automatically and immediately closed upon disconnection. 12 (d) Sources regulated by this Rule shall not: 13 (1) allow gasoline to be discarded in sewers or stored in open containers or handled in any manner that 14 would result in evaporation; or 15 (2) allow the pressure in the vapor collection system to exceed the cargo tank pressure relief settings. 16 (e) The owner or operator of a bulk gasoline terminal shall paint all tanks used for gasoline storage white or silver. 17 (f) The owner or operator of a bulk gasoline terminal shall install on each external floating roof tank with an inside 18 diameter of 100 feet or less used to store gasoline a self-supporting roof, such as a geodesic dome. 19 (g) The following equipment shall be required on all tanks storing gasoline at a bulk gasoline terminal: 20 (1) rim-mounted secondary seals on all external and internal floating roof tanks; 21 (2) gaskets on deck fittings; and 22 (3) floats in the slotted guide poles with a gasket around the cover of the poles. 23 (h) Decks shall be required on all above ground tanks with a capacity greater than 19,800 gallons storing gasoline at 24 a bulk gasoline terminal. All decks installed after June 30, 1998 shall comply with the following requirements: 25 (1) deck seams shall be welded, bolted, or riveted; and 26 (2) seams on bolted contact decks and on riveted contact decks shall be gasketed. 27 (i) If, upon facility or operational modification of a bulk gasoline terminal that existed before December 1, 1992, an 28 increase in benzene emissions results such that: 29 (1) emissions of volatile organic compounds increase by more than 25 tons cumulative at any time 30 during the five years following modifications; and 31 (2) annual emissions of benzene from the cluster where the bulk gasoline terminal is located (including 32 the pipeline and marketing terminals served by the pipeline) exceed benzene emissions from that 33 cluster based upon calendar year 1991 gasoline throughput and application of the requirements of 34 this Subchapter, 35 then, the annual increase in benzene emissions due to the modification shall be offset within the cluster by reduction 36 in benzene emissions beyond that otherwise achieved from compliance with this Rule, in the ratio of at least 1.3 to 1. 37 3 of 4 (j) The owner or operators of a bulk gasoline terminal that received an air permit before December 1, 1992 to emit 1 toxic air pollutants under 15A NCAC 02Q .0700 to comply with 15A NCAC 02D .1100 shall continue to follow all 2 terms and conditions of the permit issued under 15A NCAC 02Q .0700 and to bring the terminal into compliance with 3 15A NCAC 02D .1100 according to the terms and conditions of the permit, in which case the bulk gasoline terminal 4 shall continue to need a permit to emit toxic air pollutants and shall be exempted from Paragraphs (e) through (i) of 5 this Rule. 6 (k) The owner or operator of a bulk gasoline terminal shall not load, or allow to be loaded, gasoline into any cargo 7 tank unless the cargo tank has been certified leak tight according to 15A NCAC 02D .0932, .0960, and .2615..0932. 8 (l) The owner or operator of a bulk gasoline terminal shall have on file at the terminal a copy of the certification test 9 conducted according to 15A NCAC 02D .0932 for each gasoline cargo tank loaded at the terminal. 10 (m) Emissions of gasoline from degassing of external or internal floating roof tanks at a bulk gasoline terminal shall 11 be collected and controlled by at least 90 percent by weight. Liquid balancing shall not be used to degas gasoline 12 storage tanks at bulk gasoline terminals. Bulk gasoline storage tanks containing not more than 138 gallons of liquid 13 gasoline or the equivalent of gasoline vapor and gasoline liquid are exempted from the degassing requirements if 14 gasoline vapors are vented for at least 24 hours. Documentation of degassing external or internal floating roof tanks 15 shall be made according to 15A NCAC 02D .0903. 16 (n) According to 15A NCAC 02D .0903, the owner or operator of a bulk gasoline terminal shall visually inspect the 17 following for leaks each day that the terminal is both manned and open for business: 18 (1) the vapor collection system; 19 (2) the vapor control system; and 20 (3) each lane of the loading rack while a gasoline cargo tank is being loaded. 21 If no leaks are found, the owner or operator shall record that no leaks were found. If a leak is found, the owner or 22 operator shall record the information specified in Paragraph (p) of this Rule. The owner or operator shall repair all 23 leaks found according to Paragraph (q) of this Rule. 24 (o) The owner or operator of a bulk gasoline terminal shall inspect weekly for leaks: 25 (1) the vapor collection system; 26 (2) the vapor control system; and 27 (3) each lane of the loading rack while a gasoline cargo tank is being loaded. 28 The weekly inspection shall be done using sight, sound, or smell; a meter used to measure volatile organic compounds; 29 or an explosimeter. An inspection using either a meter used to measure volatile organic compounds or an explosimeter 30 shall be conducted every month. If no leaks are found, the owner or operator shall record the date that the inspection 31 was done and that no leaks were found. If a leak is found, the owner or operator shall record the information specified 32 in Paragraph (p) of this Rule. The owner or operator shall repair all leaks found according to Paragraph (q) of this 33 Rule. 34 (p) For each leak found under Paragraph (n) or (o) of this Rule, the owner or operator of a bulk gasoline terminal 35 shall record: 36 (1) the date of the inspection; 37 4 of 4 (2) the findings detailing the location, nature, and severity of each leak; 1 (3) the corrective action taken; 2 (4) the date when corrective action was completed; and 3 (5) any other information that the terminal deems necessary to demonstrate compliance. 4 (q) The owner or operator of a bulk gasoline terminal shall repair all leaks as follows: 5 (1) The vapor collection hose that connects to the cargo tank shall be repaired or replaced before another 6 cargo tank is loaded at that rack after a leak has been detected originating with the terminal's 7 equipment rather than from the gasoline cargo tank. 8 (2) All other leaks shall be repaired as expeditiously as possible but no later than 15 days from their 9 detection. If more than 15 days are required to make the repair, the reasons that the repair cannot be 10 made shall be documented, and the leaking equipment shall not be used after the fifteenth day from 11 when the leak detection was found until the repair is made. 12 13 History Note: Authority G.S. 143-215.3(a)(1); 143-215.107(a)(5); 14 Eff. November 1, 2020.2020; 18 Amended Eff. 19 20 21 1 of 3 15A NCAC 02D .0928 is proposed for amendment as follows: 1 2 15A NCAC 02D .0928 GASOLINE SERVICE STATIONS STAGE I 3 (a) Definitions. For the purpose of this Rule, the following definitions apply: 4 (1) "Coaxial vapor recovery system" means the delivery of the gasoline and recovery of vapors 5 occurring through a single coaxial fill tube, which is a tube within a tube. Gasoline is delivered 6 through the inner tube, and vapor is recovered through the annular space between the walls of the 7 inner tube and outer tube. 8 (2) "Delivery vessel" means cargo tanks used for the transport of gasoline from sources or supply to 9 stationary storage tanks of gasoline dispensing facilities. 10 (3) "Dual point vapor recovery system" means the delivery of the product to the stationary storage tank 11 and the recovery of vapors from the stationary storage tank occurring through two separate openings 12 in the storage tank and two separate hoses between the cargo tank and the stationary storage tank. 13 (4) "Gasoline" means a petroleum distillate having a Reid vapor pressure of four psi or greater. 14 (5) "Gasoline dispensing facility" means any site where gasoline is dispensed to motor vehicle gasoline 15 tanks from stationary storage tanks. 16 (6) "Gasoline service station" means any gasoline dispensing facility where gasoline is sold to the 17 motoring public from stationary storage tanks. 18 (7) "Line" means any pipe suitable for transferring gasoline. 19 (8) “Motor Vehicle” means every vehicle which is self-propelled and every vehicle designed to run 20 upon the highways which is pulled by a self-propelled vehicle not including mopeds or electric 21 assisted bicycles in accordance with N.C. Gen. Stat. 20-4.01. 22 (8)(9) "Operator" means any person who leases, operates, controls, or supervises a facility at which 23 gasoline is dispensed. 24 (9)(10) "Owner" means any person who has legal or equitable title to the gasoline storage tank at a facility. 25 (10)(11) "Poppeted vapor recovery adaptor" means a vapor recovery adaptor that automatically and 26 immediately closes itself when the vapor return line is disconnected and maintains a tight seal when 27 the vapor return line is not connected. 28 (11)(12) "Stationary storage tank" means a gasoline storage container that is a permanent fixture. 29 (12)(13) "Submerged fill pipe" means any fill pipe with a discharge opening that is entirely submerged when 30 the pipe normally used to withdraw liquid from the tank can no longer withdraw any liquid, or that 31 is entirely submerged when the level of the liquid is: 32 (A) six inches above the bottom of the tank if the tank does not have a vapor recovery adaptor; 33 or 34 (B) 12 inches above the bottom of the tank if the tank has a vapor recovery adaptor. If the 35 opening of the submerged fill pipe is cut at a slant, the distance is measured from the top 36 of the slanted cut to the bottom of the tank. 37 2 of 3 (13)(14) "Throughput" means the amount of gasoline dispensed at a facility during a calendar month after 1 November 15, 1990. 2 (b) Applicability. This Rule applies to all gasoline dispensing facilities and gasoline service stations, and to delivery 3 vessels delivering gasoline to a gasoline dispensing facility or gasoline service station. 4 (c) Exemptions. This Rule does not apply to: 5 (1) transfers made to storage tanks at gasoline dispensing facilities or gasoline service stations equipped 6 with floating roofs or their equivalent; 7 (2) stationary tanks with a capacity of not more than 2,000 gallons that are in place before July 1, 1979, 8 if the tanks are equipped with a permanent or portable submerged fill pipe; 9 (3) stationary storage tanks with a capacity of not more than 550 gallons that are installed after June 30, 10 1979, if tanks are equipped with a permanent or portable submerged fill pipe; 11 (4) stationary storage tanks with a capacity of not more than 2,000 gallons located on a farm or a 12 residence and used to store gasoline for farm equipment or residential use if gasoline is delivered to 13 the tank through a permanent or portable submerged fill pipe. This exemption does not apply in 14 ozone non-attainment areas; 15 (5) stationary storage tanks at a gasoline dispensing facility or gasoline service station where the 16 combined annual throughput of gasoline at the facility or station does not exceed 50,000 gallons, if 17 the tanks are permanently equipped with submerged fill pipes; or 18 (6) any tanks used exclusively to test the fuel dispensing meters. 19 (d) With exceptions stated in Paragraph (c) of this Rule, gasoline shall not be transferred from any delivery vessel 20 into any stationary storage tank unless: 21 (1) the tank is equipped with a submerged fill pipe, and the vapors displaced from the storage tank 22 during filling are controlled by a vapor control system as described in Paragraph (e) of this Rule; 23 (2) the vapor control system is in good working order and is connected and operating with a vapor tight 24 connection; 25 (3) the vapor control system is properly maintained and all damaged or malfunctioning components or 26 elements of design are repaired, replaced, or modified; 27 (4) the gauges, meters, or other specified testing devices are maintained in proper working order; 28 (5) the delivery vessel and vapor collection system compliescomply with 15A NCAC 02D .0932; and 29 (6) the following records are kept in accordance with 15A NCAC 02D .0903: 30 (A) the scheduled date for maintenance or the date that a malfunction was detected; 31 (B) the date the maintenance was performed or the malfunction corrected; and 32 (C) the component or element of design of the control system repaired, replaced, or modified. 33 (e) The vapor control system required by Paragraph (d) of this Rule shall include one or more of the following: 34 (1) a vapor-tight line from the storage tank to the delivery vessel, and: 35 (A) for a coaxial vapor recovery system, either a poppeted or unpoppeted vapor recovery 36 adaptor; 37 3 of 3 (B) for a dual point vapor recovery system, a poppeted vapor recovery adaptor; or 1 (2) a refrigeration-condensation system or equivalent designed to recover at least 90 percent by weight 2 of the volatile organic compounds in the displaced vapor. 3 (f) If an unpoppeted vapor recovery adaptor is used pursuant to Part (e)(1)(A) of this Rule, the tank liquid fill 4 connection shall remain covered either with a vapor-tight cap or a vapor return line, except when the vapor return line 5 is being connected or disconnected. 6 (g) If an unpoppeted vapor recovery adaptor is used pursuant to Part (e)(1)(A) of this Rule, the unpoppeted vapor 7 recovery adaptor shall be replaced with a poppeted vapor recovery adaptor when the tank is replaced or is removed 8 and upgraded. 9 (h) Where vapor lines from the storage tanks are manifolded, poppeted vapor recovery adapters shall be used. No 10 more than one tank is to be loaded at a time if the manifold vapor lines are size 2.5 inches and smaller. If the manifold 11 vapor lines are 3.0 inches and larger, then two tanks at a time may be loaded. 12 (i) Vent lines on tanks with Stage I controls shall have pressure release valves or restrictors. 13 (j) The vapor-laden delivery vessel: 14 (1) shall be designed and maintained to be vapor-tight during loading and unloading operations and 15 during transport with the exception of normal pressure/vacuum venting as required by the 16 Department of Transportation; and 17 (2) if it is refilled in North Carolina, shall be refilled only at: 18 (A) bulk gasoline plants complying with 15A NCAC 02D .0926; or 19 (B) bulk gasoline terminals complying with 15A NCAC 02D .0927 or .0524. 20 21 History Note: Authority G.S. 143-215.3(a)(1); 143-215.107(a)(5); 22 Eff. November 1, 2020.2020; 25 Amended Eff. 26 27 28 1 of 3 15A NCAC 02D .0932 is proposed for amendment as follows: 1 2 15A NCAC 02D .0932 GASOLINE CARGO TANKS AND VAPOR COLLECTION SYSTEMS 3 (a) For the purposes of this Rule, the following definitions apply: 4 (1) "Bottom filling" means the filling of a cargo tank or stationary storage tank through an opening flush 5 with the tank bottom. 6 (2) "Bulk gasoline plant" means a gasoline storage and distribution facility with an average daily 7 throughput of less than 20,000 gallons of gasoline and that typically receives gasoline from bulk 8 terminals by trailer transport, stores it in tanks, and subsequently dispenses it via account cargo tanks 9 to local farms, businesses, and service stations. 10 (3) "Bulk gasoline terminal" means: 11 (A) a pipeline breakout station of an interstate oil pipeline facility; or 12 (B) a gasoline storage facility that typically receives gasoline from refineries primarily by 13 pipeline, ship, or barge; delivers gasoline to bulk gasoline plants or to commercial or retail 14 accounts primarily by cargo tank; and has an average daily throughput of more than 20,000 15 gallons of gasoline. 16 (4) "Cargo tank" means the storage vessels of freight trucks or trailers used to transport gasoline from 17 sources of supply to stationary storage tanks of bulk gasoline terminals, bulk gasoline plants, 18 gasoline dispensing facilities, and gasoline service stations. 19 (5) "Cargo tank testing facility" means any facility complying with registration in 49 CFR Part 107, 20 Subpart F. 21 (6) "Cargo tank vapor collection equipment" means any piping, hoses, and devices on the cargo tank 22 used to collect and route gasoline vapors in the tank to or from the bulk gasoline terminal, bulk 23 gasoline plant, gasoline dispensing facility, or gasoline service station vapor control system or vapor 24 balance system. 25 (7) "Gasoline" means any petroleum distillate having a Reid Vapor Pressure (RVP) of 4.0 psi or greater. 26 (8) "Gasoline dispensing facility" means any site where gasoline is dispensed to motor vehicle gasoline 27 tanks from stationary storage tanks. 28 (9) "Gasoline service station" means any gasoline dispensing facility where gasoline is sold to the 29 motoring public from stationary storage tanks. 30 (10) "Vapor balance system" means a combination of pipes or hoses that create a closed system between 31 the vapor spaces of an unloading tank and a receiving tank such that vapors displaced from the 32 receiving tank are transferred to the tank being unloaded. 33 (11) "Vapor collection system" means a vapor balance system or any other system used to collect and 34 control emissions of volatile organic compounds. 35 2 of 3 (b) This Rule applies to gasoline cargo tanks that are equipped for vapor collection and to vapor control systems at 1 bulk gasoline terminals, bulk gasoline plants, gasoline dispensing facilities, and gasoline service stations equipped 2 with vapor balance or vapor control systems. 3 (c) For cargo tanks, the following requirements shall apply: 4 (1) Gasoline cargo tanks and their vapor collection systems shall be tested annually by a cargo tank 5 testing facility. The facility shall follow the test procedure as defined by 15A NCAC 02D .2615 to 6 certify the gasoline cargo tank leak tight. The gasoline cargo tank shall not be used unless it is 7 certified leak tight. 8 (2) Each gasoline cargo tank that has been certified leak tight according to Subparagraph (1) of this 9 Paragraph(c)(1) of this Rule shall display a sticker near the Department of Transportation 10 certification plate required by 49 CFR 180.415. 11 (3) There shall be no liquid leaks from any gasoline cargo tank. 12 (4) Any cargo tank with a leak equal to or greater than 100 percent of the lower explosive limit, as 13 detected by a combustible gas detector using the test procedure described in 15A NCAC 02D .2615 14 shall not be used beyond 15 days after the leak has been discovered, unless the leak has been repaired 15 and the cargo tank has been certified to be leak tight according to Subparagraph (1) of this Paragraph. 16 (c)(1) of this Rule. 17 (5) The owner or operator of a gasoline cargo tank with a vapor collection system shall maintain records 18 of all leak testing and repairs. The records shall identify the gasoline cargo tank, the date of the test 19 or repair, and, if applicable, the type of repair and the date of retest. The records of leak tests shall 20 include: 21 (A) the name, address, and telephone number of cargo tank testing facility performing the leak 22 test; 23 (B) the name and signature of the individual performing the leak test; 24 (C) the name and address of the owner of the tank; 25 (D) the identification number of the tank; 26 (E) the documentation of tests performed including the date and summary of results; 27 (F) the continued qualification statement and returned to service status; and 28 (G) a list or description of identified corrective repairs to the tank. If none are performed then 29 the report shall state "no corrective repairs performed." 30 (6) A copy of the most recent leak testing report shall be kept with the cargo tank. The owner or operator 31 of the cargo tank shall also file a copy of the most recent leak testing report with each bulk gasoline 32 terminal that loads the cargo tank. The records shall be maintained for at least two years after the 33 date of the testing or repair, and copies of such records shall be made available within a reasonable 34 time to the Director upon written request. 35 (d) For bulk gasoline terminals and bulk gasoline plants equipped with vapor balance or vapor control systems, the 36 following requirements shall apply: 37 3 of 3 (1) The vapor collection system and vapor control system shall be designed and operated to prevent 1 gauge pressure in the cargo tank from exceeding 18 inches of water and to prevent a vacuum of 2 greater than six inches of water. 3 (2) During loading and unloading operations there shall be: 4 (A) no vapor leakage from the vapor collection system such that a reading equal to or greater 5 than 100 percent of the lower explosive limit at one inch around the perimeter of each 6 potential leak source as detected by a combustible gas detector using the test procedure 7 described in 15A NCAC 02D .2615; and 8 (B) no liquid leaks. 9 (3) If a leak is discovered that exceeds the limit in Subparagraph (2) of this Paragraph:(d)(2) of this 10 Rule: 11 (A) For bulk gasoline plants, the vapor collection system or vapor control system shall not be 12 used beyond 15 days after the leak has been discovered, unless the leak has been repaired 13 and the system has been retested and found to comply with Subparagraph (2) of this 14 Paragraph;(d)(2) of this Rule; 15 (B) For bulk gasoline terminals, the vapor collection system or vapor control system shall be 16 repaired following the procedures in 15A NCAC 02D .0927. 17 (4) The owner or operator of a vapor collection system at a bulk gasoline plant or a bulk gasoline 18 terminal shall test, according to Rule 15A NCAC 02D .0912, the vapor collection system at least 19 once per year. If after two complete annual checks no more than 10 leaks are found, the Director 20 shall allow less frequent monitoring. If more than 20 leaks are found, the Director shall require the 21 frequency of monitoring be increased. 22 (5) The owner or operator of vapor control systems at bulk gasoline terminals, bulk gasoline plants, 23 gasoline dispensing facilities, and gasoline service stations equipped with vapor balance or vapor 24 control systems shall maintain records of all certification testing and repairs. The purpose of this Rule is to establish procedures for cargo tank testing facilities to perform leak 4 tightness tests on gasoline cargo tanks as defined in 15A NCAC 02D .0932. 5 (b) Leak testing report. The certified facility performing the test shall give a copy of the leak testing report to the 6 cargo tank owner and shall retain a copy of the leak testing report. The leak testing report shall contain the following 7 information: 8 (1) the name, address, and telephone number of cargo tank testing facility performing the leak test; 9 (2) the name and signature of the individual performing the leak test; 10 (3) the name and address of the owner of the tank; 11 (4) the identification number of the tank; 12 (5) documentation of tests performed including the date and summary or results; 13 (6) continued qualification statement and returned to service status; and 14 (7) a list or description of identified corrective repairs to the tank. If none are performed then the report 15 shall state "no corrective repairs performed." 16 (c) Record retention. The cargo tank testing facility performing the test and the owner of the cargo tank shall keep 17 the leak testing report for at least two years. Leak testing reports shall be made available to the Division upon request. 18 (d) Verification of leak tightness. This 21 date does not change if the control device is later redirected to a new press. 22 (3) "Fountain solution" means water-based solution that applies to lithographic plate to render the non-23 image areas unreceptive to the ink. 24 (4) "Heatset" means any operation in which heat is required to evaporate ink oils from the printing ink, 25 excluding ultraviolet (UV) curing, electron beam curing, and infrared drying. 26 (5) "Letterpress printing" means a printing process in which the image area is raised relative to the non-27 image area and the paste ink is transferred to the substrate directly from the image surface. 28 (6) "Non-heatset" means a lithographic printing process where the printing inks are set by absorption 29 or oxidation of the ink oil, not by evaporation of the ink oils in a dryer. For the purposes of this 30 Rule, use of an infrared heater or printing conducted using ultraviolet-cured or electron beam-cured 31 inks is considered non-heatset. 32 (7) "Offset lithography" means a printing process that uses sheet-fed or web method of press feeding 33 and transfers ink from the lithographic plate to a rubber-covered intermediate "blanket" cylinder and 34 then from the blanket cylinder to the substrate. 35 2 of 5 (8) "Press" means a printing production assembly composed of one or more units used to produce a 1 printed substrate including any associated coating, spray powder application, heatset web dryer, 2 ultraviolet or electron beam curing units, or infrared heating units. 3 (9) "Sheet-fed printing" means offset lithographic printing when individual sheets of paper or other 4 substrate are fed to the press. 5 (10) "Web printing" means offset lithographic printing when continuous rolls of substrate material are 6 fed to the press and rewound or cut to size after printing. 7 (b) This Rule applies to any offset lithographic and any letterpress printing operations sources that are not covered 8 by 15A NCAC 02D .0966(c)(1) and whose emissions of volatile organic compounds exceed: 9 (1) the threshold established in 15A NCAC 02D .0902(b) and (f); or 10 (2) an equivalent level of three tons per 12-consecutive month rolling period. 11 (c) Volatile organic compounds content in the fountain solution for on-press (as-applied) heatset web offset 12 lithographic printing shall meet one of the following requirements or equivalent level of control as determined in 13 permit conditions: 14 (1) contain 1.6 percent alcohol or less, by weight, as applied, in the fountain solution: 15 (2) contain three percent alcohol or less, by weight, on-press (as-applied) in the fountain solution if the 16 fountain solution is refrigerated to below 60 degrees Fahrenheit; or 17 (3) contain five percent alcohol substitute or less, by weight, on-press (as-applied) and no alcohol in the 18 fountain solution. 19 (d) Volatile organic compounds content in the fountain solution for on-press (as-applied) sheet-fed lithographic 20 printing shall meet one of the following requirements or equivalent level of control as determined in permit conditions: 21 (1) contain five percent alcohol or less, by weight, on-press (as-applied) in the fountain solution; 22 (2) contain 8.5 percent alcohol or less, by weight, on-press (as-applied) in the fountain solution if the 23 fountain solution is refrigerated to below 60 degrees Fahrenheit; or 24 (3) contain five percent alcohol substitute or less, by weight, on-press (as-applied) and no alcohol in the 25 fountain solution. 26 (e) Volatile organic compounds content in emissions from fountain solution from non-heatset web offset lithographic 27 printing shall not exceed five percent alcohol substitute (by weight) on-press (as-applied) and contain no alcohol in 28 the fountain solution. 29 (f) An owner or operator of an individual web offset lithographic printing press dryer or letterpress-printing heatset 30 press subject to this Rule that emits 25 or more tons per year potential emissions of volatile organic compounds shall: 31 (1) use an enforceable limitation on potential emissions to keep individual heatset press below 25 tons 32 per year potential to emit volatile organic compounds (petroleum ink oil) threshold, which can be 33 achieved by using inks and coatings that contain less than 31.25 tons per year volatile organic 34 compound (petroleum ink oil) where 20 percent retention factor of petroleum ink oil applies, or by 35 using other methods established by permit conditions; or 36 (2) use an add-on control system that meets one of the following requirements: 37 3 of 5 (A) reduces volatile organic compounds emissions from each dryer by at least 90 percent 1 volatile organic compounds emissions control efficiency established by procedures defined 2 in Paragraph (h) of this Rule for a control device from heatset dryers whose first installation 3 date was prior to July 1, 2010, at facilities with potential to emit 100 tons or more of volatile 4 organic compounds per year; 5 (B) reduces volatile organic compounds emissions from each dryer by at least 90 percent 6 volatile organic compounds emissions control efficiency established by procedures defined 7 in Paragraph (h) of this Rule for a control device from heatset dryers whose first installation 8 date was prior to May 1, 2013, at facilities with potential to emit less than 100 tons of 9 volatile organic compounds per year; 10 (C) reduces volatile organic compounds emissions from each dryer by at least 95 percent 11 volatile organic compounds emissions control efficiency established by procedures defined 12 in Paragraph (h) of this Rule for a control device from heatset dryers whose first installation 13 date was on or after July 1, 2010, at facilities with potential to emit 100 tons or more of 14 volatile organic compounds per year; 15 (D) reduces volatile organic compounds emissions from each dryer by at least 95 percent 16 volatile organic compounds emissions control efficiency established by procedures defined 17 in Paragraph (h) of this Rule for a control device from heatset dryers whose first installation 18 date was on or after May 1, 2013, at facilities with potential to emit less than 100 tons of 19 volatile organic compounds per year; or 20 (E) maintains a maximum volatile organic compounds outlet concentration of 20 parts per 21 million by volume (ppmv), as hexane (C6H14) on a dry basis. 22 (g) The control limits established in: 23 (1) Paragraphs (c), (d), and (e) of this Rule shall not be applied to any press with total fountain solution 24 reservoir of less than one gallon; 25 (2) Paragraph (d) of this Rule shall not be applied to sheet-fed presses with maximum sheet size 11x 17 26 inches or smaller; and 27 (3) Subparagraph (f)(2) of this Rule shall not be applied to a heatset press used for book printing, or to 28 a heatset press with maximum web width of 22 inches or less. 29 (h) If the owner or operator of a printing press is required by permit conditions to determine: 30 (1) the volatile organic compounds content, Method 24 of Appendix A to 40 CFR Part 60 or approved 31 alternative methods pursuant to 15A NCAC 02D .2602(h) shall be used; and 32 (2) the control efficiency by measuring volatile organic compounds at the control device inlet and outlet, 33 Methods 18, 25, or 25A of Appendix A to 40 CFR Part 60, or approved alternative methods pursuant 34 to 15A NCAC 02D .2602(h) shall be used. 35 (i) All test methods defined in Paragraph (h) of this Rule shall be conducted at typical operating conditions and flow 36 rates. 37 4 of 5 (j) The owner or operator of any facility subject to this Rule shall demonstrate compliance with RACT applicability 1 requirements by calculating volatile organic compounds emissions and keep records of the basis of the calculations 2 required by 15A NCAC 02D .0605 and .0903. Volatile organic compounds emissions from offset lithographic printing 3 and letterpress printing shall be determined by permit condition requirements or by using the following retention and 4 capture efficiency factors: 5 (1) the retention factors are: 6 (A) 20 percent for heatset petroleum ink oils; 7 (B) 100 percent for heatset vegetable ink oils; 8 (C) 95 percent for sheet-fed and coldset web petroleum ink oils; and 9 (D) 100 percent for sheet-fed and coldset web vegetable ink oils. 10 (2) the retention factor is 50 percent for low volatile organic compounds composite vapor pressure 11 cleaning materials in shop towels where: 12 (A) volatile organic compounds composite vapor pressure of the cleaning material is less than 13 10 mm Hg at 20ºC; 20 degrees Celsius; and 14 (B) cleaning materials and used shop towels are kept in closed containers. 15 (3) carryover (capture) factors of volatile organic compounds from automatic blanket wash and fountain 16 solution to offset lithographic heatset dryers are: 17 (A) 40 percent VOC carryover (capture) factor for automatic blanket washing when the volatile 18 organic compounds composite vapor pressure of the cleaning material is less than 10mm 19 Hg at 20ºC. 20 degrees Celsius. 20 (B) 70 percent VOC carryover (capture) factor for alcohol substitutes in fountain solution. 21 (4) capture efficiency for volatile organic compounds (petroleum ink oils) from oil-based paste inks and 22 oil-based paste varnishes (coatings) in heatset web offset lithographic presses and heatset web 23 letterpress presses shall be demonstrated by showing that the dryer is operating at negative pressure 24 relative to the surrounding pressroom. As long as the dryer is operated at negative pressure, the 25 capture efficiency for VOC from the heatset lithographic inks and varnishes (coatings) formulated 26 with low volatility ink oils is 100 percent of the VOC (ink oils) volatilized in the dryer. Capture 27 efficiency test is not required in this situation. 28 (k) Except as specified in this Paragraph, all cleaning materials used for cleaning a press, press parts, or to remove 29 dried ink from areas around the press shall meet one of the following requirements: 30 (1) the volatile organic compounds content shall be less than 70 percent by weight; or 31 (2) composite partial vapor pressure of volatile organic compounds shall be less than 10 mm Hg at 20 32 degrees Celsius. 33 No more than 110 gallons per year of cleaning materials that do not meet the requirements of Subparagraph (1) or (2) 34 of this Paragraph (k)(1) or (k)(2) of this Rule shall be used during any 12 consecutive months. 35 (l) The owner or operator of any facility subject to this Rule shall maintain the following records for a minimum of 36 five years: 37 5 of 5 (1) parametric monitoring for processes and control devices as determined and at the frequency 1 specified in the permit or by Paragraph (f) of this Rule; 2 (2) the total amount of each individual or class of fountain solution and ink used monthly for the printing 3 operations and the percentage of volatile organic compounds, alcohol, and alcohol substitute as 4 applied in it; 5 (3) the total amount of each individual or class of cleaning solutions used monthly with vapor pressure 6 and the percentage of volatile organic compounds as applied in it; 7 (4) the total amount of cleaning solutions used monthly with the vapor pressure and the percentage of 8 volatile organic compounds as applied that does not meetnot meeting the vapor pressure or 9 percentage of volatile organic compounds requirements ofas required in Paragraph (k) of this Rule; 10 (5) the temperature of fountain solutions for lithographic printing presses using alcohol at the frequency 11 specified in the permit; and 12 (6) any other parameters required by the permit in accordance with 15A NCAC 02D .0605 and .0903. 13 (m) The owner or operator of any source subject to this Rule shall comply with 15A NCAC 02D .0903 and .0958. 14 15 History Note: Authority G.S. 143-215.3(a)(1); 143-215.107(a)(5); 16 Eff. November 1, 2020.2020; 19 Amended Eff. 20 21 1 of 3 15A NCAC 02D .0964 is proposed for amendment as follows: 1 2 15A NCAC 02D .0964 MISCELLANEOUS INDUSTRIAL ADHESIVES 3 (a) For the purpose of this Rule, the following definitions apply: 4 (1) "Air-assisted airless spray" means a system that consists of an airless spray gun with a compressed 5 air jet at the gun tip to atomize the adhesive. 6 (2) "Airless spray" means the application ofusing a pump forcing an adhesive through an atomizing 7 nozzle at high pressure of 1,000 to 6,000 pounds per square inch by a pump forces.inch. 8 (3) "Application process" means a process that consists of a series of one or more adhesive applicators 9 and any associated drying area or oven where an adhesive is applied, dried, and cured. 10 (4) "Dip coating" means application where substrates are dipped into a tank containing the adhesive. 11 The substrates are then withdrawn from the tank and any excess adhesive is allowed to drain. 12 (5) "Electrocoating" means a specialized form of dip coating where opposite electric charges are applied 13 to the waterborne adhesive and the substrate. 14 (6) "Electrostatic spray" means application where the adhesive and substrate are oppositely charged. 15 (7) "Flow coating" means conveying the substrate over an enclosed sink where the adhesive is applied 16 at low pressure as the item passes under a series of nozzles. 17 (8) "HVLP" means a system with specialized nozzles that provide better air and fluid flow than 18 conventional air atomized spray systems at low air pressure, shape spray pattern, and guide high 19 volumes of atomized adhesive particles to the substrate using lower air pressure of 10 pounds per 20 square inch or less at the spray cap. 21 (9) "Miscellaneous industrial adhesives" means adhesives, including adhesive primers used in 22 conjunction with certain types of adhesives used at industrial manufacturing and repair facilities for 23 a wide variety of products and equipment that operate adhesives application processes. 24 (10) "Roll coating," "brush coating," and "hand application" means application of high viscosity 25 adhesives onto small surface area. 26 (b) Control of volatile organic compounds emissions from miscellaneous industrial adhesives product categories 27 covered by 15A NCAC 02D .0923, .0935, .0961, .0962, .0963, .0965, .0966, .0967, and .0968 are exempted from the 28 requirements of this Rule. 29 (c) This Rule applies to miscellaneous industrial adhesive application sources whose volatile organic compounds 30 emissions meet the threshold established in 15A NCAC 02D .0902(b). 31 (d) With the exception established in Paragraph (b) of this Rule, all volatile organic compounds containing materials 32 applied by each miscellaneous industrial adhesive application processes before control shall: 33 (1) not exceed limits established in Table 1 of this Rule; and 34 (2) be used in one of the following application methods in conjunction with using low volatile organic 35 compounds adhesives or adhesive primers: 36 (A) electrostatic spray; 37 2 of 3 (B) HVLP spray; 1 (C) flow coat; 2 (D) roll coat or hand application, including non-spray application methods similar to hand or 3 mechanically powered caulking gun, brush, or direct hand application; 4 (E) dip coat including electrodesposition; 5 (F) airless spray; 6 (G) air-assisted airless spray; or 7 (H) any other adhesive application method capable of achieving a transfer efficiency equivalent 8 to or better than that achieved by HVLP spraying. 9 (e) Emission limits established in Subparagraph (d)(1) of this Rule shall be: 10 (1) met by averaging the volatile organic compounds content of materials used on a single application 11 unit for each day; and 12 (2) calculated as mass of volatile organic compounds per volume of adhesive primer, excluding water 13 and exempt compounds, as applied. 14 (f) If an adhesive is used to bond dissimilar substrates together in general adhesive application process as set forth in 15 Table 1, then the applicable substrate category with the highest volatile organic compounds emission limit shall be 16 established as the limit for such application. 17 18 Table 1. The owner or operator of a source 5 subject to this Rule because of the applicability of 15A NCAC 02D .1402(d), (e), (f), or (g) shall adhere to the 6 following increments of progress and schedules: 7 (1) If compliance with this Section is to be achieved through a demonstration to certify compliance 8 without source modification: 9 (A) The owner or operator shall notify the Director in writing within six months after the 10 Director's notice in the North Carolina Register that the source is in compliance with the 11 applicable limitation or standard; 12 (B) The owner or operator shall perform any required testing, pursuant to 15A NCAC 02D 13 .1415, within 12 months after the Director's notice in the North Carolina Register to 14 demonstrate compliance with the applicable limitation; and 15 (C) The owner or operator shall implement any required recordkeeping and reporting 16 requirements pursuant to 15A NCAC 02D .1404, within 12 months after the Director's 17 notice in the North Carolina Register to demonstrate compliance with the applicable 18 limitation. 19 (2) If compliance with this Section is to be achieved through the installation of combustion modification 20 technology or other source modification: 21 (A) The owner or operator shall submit a permit application and a compliance schedule within 22 six months after the Director's notice in the North Carolina Register. 23 (B) The compliance schedule shall contain the following increments of progress: 24 (i) a date by which contracts for installation of the modification shall be awarded or 25 orders shall be issued for purchase of component parts; 26 (ii) a date by which installation of the modification shall begin; 27 (iii) a date by which installation of the modification shall be completed; and 28 (iv) if the source is subject to a limitation, a date by which compliance testing shall be 29 completed. 30 (C) Final compliance shall be achieved within three years after the Director's notice in the 31 North Carolina Register unless the owner or operator of the source petitions the Director 32 for an alternative limitation pursuant to 15A NCAC 02D .1412. If a petition has been 33 submitted and approved, final compliance shall be achieved within four years after the 34 Director's notice in the North Carolina Register. 35 (3) If compliance with this Section is to be achieved through the implementation of an emissions 36 averaging plan pursuant to 15A NCAC 02D .1410; 37 2 of 4 (A) The owner or operator shall abide by the applicable requirements of Subparagraphs (1) or 1 (2) of this ParagraphSubparagraphs (b)(1) or (b)(2) of this Rule for certification or 2 modification of each source to be included under the averaging plan. 3 (B) The owner or operator shall submit a plan to implement an emissions averaging plan 4 pursuant to 15A NCAC 02D .1410 within six months after the Director's notice in the North 5 Carolina Register. 6 (C) Final compliance shall be achieved within one year after the Director's notice in the North 7 Carolina Register unless implementation of the emissions averaging plan requires the 8 modification of one or more of the averaging sources. If modification of one or more of 9 the averaging sources is required, final compliance shall be achieved within three years. 10 (4) If compliance with this Section is to be achieved through the implementation of a seasonal fuel 11 switching program pursuant to 15A NCAC 02D .1411: 12 (A) The owner or operator shall make all necessary modifications according to Subparagraph 13 (2) of this Paragraph.Subparagraph (b)(2) of this Rule. 14 (B) The owner or operator shall include a plan for complying with the requirements of 15A 15 NCAC 02D .1411 with the permit application required under Part (2)(A) of this 16 Subparagraph.in Subparagraph (b)(2) of this Rule. 17 (C) Final compliance shall be achieved within three years after the Director's notice in the 18 North Carolina Register. 19 (5) Increments of progress certification. The owner or operator shall certify to the Director, within five 20 days after each increment deadline of progress in this Paragraph, whether the required increment of 21 progress has been met. 22 (c) Nonattainment areas. The owner or operator of a source subject to this Rule because of the applicability of 15A 23 NCAC 02D .1402(d), shall adhere to the following: 24 (1) If compliance with this Section is to be achieved through a demonstration to certify compliance 25 without source modification: 26 (A) The owner or operator shall notify the Director in writing by August 1, 2007; 27 (B) The owner or operator shall perform any required testing, according to 15A NCAC 02D 28 .1415, by January 1, 2008; and 29 (C) The owner or operator shall implement any required recordkeeping and reporting 30 requirements, according to 15A NCAC 02D .1404, by January 1, 2008. 31 (2) If compliance with this Section is to be achieved through the installation of combustion modification 32 technology or other source modification: 33 (A) The owner or operator shall submit a permit application and a compliance schedule by 34 August 1, 2007. 35 (B) The compliance schedule shall contain a date by which contracts for installation of the 36 modification shall be awarded or orders shall be issued for purchase of component parts. 37 3 of 4 (C) The compliance schedule shall contain a date by which installation of the modification 1 shall begin. 2 (D) The compliance schedule shall contain a date by which installation of the modification 3 shall be completed. 4 (E) If the source is subject to a limitation, the compliance schedule shall contain, a date by 5 which compliance testing shall be completed. 6 (F) Final compliance shall be achieved no later than April 1, 2009. 7 (3) If compliance with this Section is to be achieved through the implementation of an emissions 8 averaging plan as provided for in 15A NCAC 02D .1410: 9 (A) The owner or operator shall abide by the applicable requirements of Subparagraph (1) or 10 (2) of this ParagraphSubparagraphs (c)(1) or (c)(2) of this Rule for certification or 11 modification of each source to be included under the averaging plan. 12 (B) The owner or operator shall submit a plan to implement an emissions averaging plan 13 according to 15A NCAC 02D .1410 by August 1, 2007. 14 (C) Final compliance shall be achieved within one year no later than January 1, 2008. 15 (4) If compliance with this Section is to be achieved through the implementation of a seasonal fuel 16 switching program as provided for in 15A NCAC 02D .1411: 17 (A) The owner or operator shall make all necessary modifications according to Subparagraph 18 (2) of this Paragraph.Subparagraph (c)(2) of this Rule. 19 (B) The owner or operator shall include a plan for complying with the requirements of 15A 20 NCAC 02D .1411 with the permit application required under Part (2)(A) of this 21 Subparagraph.in Subparagraph (c)(2) of this Rule. 22 (C) Final compliance shall be achieved no later than April 1, 2009. 23 (5) Increments of progress certification. The owner or operator shall certify to the Director, within five 24 days after the deadline for each increment of progress in this Paragraph, whether the required 25 increment of progress has been met. 26 (d) Sources already in compliance. 27 (1) Maintenance area and Charlotte ozone nonattainment area contingency plan. Paragraph (b) of this 28 Rule shall not apply to sources thatthat: 29 (A) are in compliance with the applicable rules of this Section when the Director notices in the 30 North Carolina Register the implementation of rules in the North Carolina Register that resolves a 31 violation of the ambient air quality standard for ozoneozone; and 32 (B) that hashave determined and certified compliance to the Director within six months after 33 the Director notices in the North Carolina Register the implementation of rules in the North Carolina 34 Register that resolves a violation of the ambient air quality standard for ozone. 35 (2) Nonattainment areas. Paragraph (c) of this Rule shall not apply to sources in an area named in 15A 36 NCAC 02D .1402(d) that are in compliance with applicable rules of this Section on March 1, 2007. 37 4 of 4 (e) New sources. 1 (1) Maintenance area and Charlotte ozone nonattainment area contingency plan. The owner or operator 2 of any new source of nitrogen oxides not permitted before the date the Director notices in the North 3 Carolina Register according to 15A NCAC 02D .1402(e), (f), or (g) shall comply with all applicable 4 rules in this Section upon start-up of the source. The owner or operator of any new source covered 5 by 15A NCAC 02D .1407, .1408, .1409, .1413, or .1418 shall comply with all applicable rules in 6 this Section upon start-up of the source. 7 (2) Nonattainment areas. October 1, 2020.2020; 20 Amended Eff. 21 22 23 1 of 3 15A NCAC 02D .1708 is proposed for amendment as follows: 1 2 15A NCAC 02D .1708 REPORTING REQUIREMENTS 3 (a) The owner or operator of an existing MSW landfill subject to this Rule according to 15A NCAC 02D .1702 shall 4 submit a design capacity report to the Director as follows: 5 (1) The initial design capacity report shall be submitted no later than 90 days after the effective date of 6 the EPA approval of the State Plan pursuant to Section 111(d) of the Clean Air Act. 7 (2) The initial design capacity report shall contain the information given in 40 CFR 60.38f(a)(1) and 40 8 CFR 60.38f(a)(2). 9 (b) The owner or operator of an existing MSW landfill subject to this Section shall submit an amended design capacity 10 report providing notification of an increase in the design capacity of the landfill, within 90 days of an increase in the 11 maximum design capacity of the landfill to meet or exceed 2.5 million megagrams and 2.5 million cubic meters. An 12 increase in design capacity may result from an increase in the permitted volume of the landfill or an increase in the 13 density as documented in the annual recalculation required in 15A NCAC 02D .1709(j). 14 (c) The owner or operator of an existing MSW landfill subject to this Rule shall submit a NMOC emission report to 15 the Director no later than 90 days after the effective date of EPA approval of the State plan pursuant to Section 111(d) 16 of the Clean Air Act and annually thereafter, except as provided for in 40 CFR 60.38f(c). The NMOC emission rate 17 report shall: 18 (1) contain an annual or five-year estimate of the NMOC emission rate calculated using the formula 19 and procedures provided in 40 CFR 60.35f(a) or (b), as applicable; 20 (2) include all the data, calculations, sample reports, and measurements used to estimate the annual or 21 five-year emissions; and 22 (3) if the estimated NMOC emission rate as reported in the annual report is less than 34 megagrams per 23 year in each of the next five consecutive years, the owner or operator may elect to submit an estimate 24 of the NMOC emission rate for the next five-year period in lieu of the annual report. This estimate 25 shall include the current amount of solid waste-in-place and the estimate waste acceptance rate for 26 each year of the five years for which an NMOC emission rate is estimated. All data and calculations 27 shall be provided. This estimate shall be revised at least once every five years. If the actual waste 28 acceptance rate exceeds the estimated waste acceptance rate in any year reported in the five-year 29 estimate, a revised five-year estimate shall be submitted. The revised estimate shall cover the five-30 year period beginning with the year in which the actual waste acceptance rate exceeded the estimated 31 waste acceptance rate. 32 Each owner and operator subject to the requirements of this Rule shall be exempted from the requirements to submit 33 an NMOC emission rate report, after installing a compliant collection and control system, during such time as the 34 collection and control system is in operation and in compliance with 15A NCAC 02D .1705 and .1706. 35 (d) The owner or operator of an existing MSW landfill subject to 15A NCAC 02D .1703(b) shall submit a collection 36 and control system design plan to the Director within one year of the first NMOC emission rate report, required under 37 2 of 3 Paragraph (c) of this Rule, in which the emission rate equals or exceeds 34 megagrams per year, except as provided 1 for in 40 CFR 60.38f(d)(4)(i), 60.38f(d)(4)(ii), and 60.38f(d)(4)(iii). The collection and control system design plan 2 shall include: 3 (1) a description of the collection and control system; 4 (2) a description of any alternatives to the operational standards, test methods, procedures, compliance 5 measures, monitoring, recordkeeping, or reporting provisions provided in this Rule; and 6 (3) a description indicating how the plan conforms to specifications for active collection systems or a 7 demonstration of sufficient alternative provisions as given in 40 CFR 60.40f. 8 (e) The owner or operator of an existing MSW landfill who has already previously submitted a design plan pursuant 9 to Paragraph (d) of this Rule, pursuant to 40 CFR Part 60, Subpart WWW, or a State plan implementing 40 CFR Part 10 60, Subpart Cc, shall submit a revised design plan that includes the information in Subparagraphs (d)(1) through 11 (d)(3).(d)(3) of this Rule. The revised design plan shall be submitted to the Director as follows: 12 (1) at least 90 days before expanding operations to an area no covered by the previously approved 13 design plan; and 14 (2) prior to installing or expanding the gas collection system in a way that is not consistent with the 15 design plan that was submitted to the Director in Paragraph (d) of this Rule. 16 (f) The owner or operator of a controlled landfill shall submit a closure report to the Director within 30 days of 17 cessation of waste acceptance. If a closure report has been submitted to the Director, no additional waste shall be 18 placed into the landfill without first filing a notification of modification as described pursuant to 40 CFR 60.7(a)(4). 19 The Director may request such additional information to verify that permanent closure of the MSW landfill has taken 20 place pursuant to the requirements of 40 CFR 258.60. 21 (g) The owner or operator of a controlled MSW landfill shall submit an equipment removal report 30 days prior to 22 removal or cessation of operation of the control equipment according to 15A NCAC 02D .1703(f). The report shall 23 contain the items listed in 40 CFR 60.38f(g). The Director may request such additional information to verify that all 24 the conditions for removal in 40 CFR 60.33f(f) have been met. 25 (h) The owner or operator of a MSW landfill seeking to comply with 15A NCAC 02D .1703(b) using an active 26 collection system designed in accordance with 40 CFR 60.33f(b) shall submit, following the procedures pursuant to 27 60.38f(j)(2), annual reports of the recorded information in 40 CFR 60.38f(h)(1) through (h)(7). The initial annual 28 report shall be submitted within 180 days of installation and start-up of the collection and control system, and shall 29 include the initial performance test report required under 40 CFR 60.8. The initial performance test report shall be 30 submitted by following the procedures pursuant to 60.38f(j)(1). Each owner or operator that chooses to comply with 31 the operational provisions of 40 CFR 63.1958, 63.1960, and 63.1961, as allowed by 15A NCAC 02D .1705, .1706, 32 and .1707 the owner or operator shall follow the semi-annual reporting requirements in 40 CFR 63.1981(h) in lieu of 33 this Paragraph. 34 (i) The owner or operator of an existing MSW landfill required to comply with 15A NCAC 02D .1703(b) shall include 35 the information given in 40 CFR 60.38f(i)(1) through (i)(6) with the initial performance test report required pursuant 36 to 40 CFR 60.8. 37 3 of 3 (j) The owner or operator of an existing MSW landfill shall submit a report within 60 days after the date of completing 1 each performance test pursuant to 40 CFR 60.38f(j). 2 (k) The owner or operator of an existing MSW landfill required to implement corrective active,action, shall submit 3 reports to the Director pursuant to 40 CFR 60.38f(k)(1) and (k)(2). Each owner or operator that chooses to comply 4 with the operational provisions of 40 CFR 63.1958, 63.1960, and 63.1961, as allowed by 15A NCAC 02D .1705, 5 .1706, and .1707 shall follow the corrective action and the corresponding timeline reporting requirements in 40 CFR 6 63.1981(j) in lieu of this Paragraph. 7 (l) The owner or operator of an affected landfill with a design capacity equal to or greater than 2.5 million megagrams 8 and 2.5 million cubic meters that has employed leachate recirculation or added liquids based on a Research, 9 Development, and Demonstration permit within the last 10 years shall submit an annual report to the Director that 10 includes the information pursuant to 40 CFR 60.38f(l)(1) through (l)(10). The annual report shall be submitted by 11 following the procedures pursuant to 60.38f(j)(2). 12 (m) The owner or operator of an affected landfill with a design capacity equal to or greater than 2.5 million megagrams 13 and 2.5 million cubic meters that intends to demonstrate site-specific surface methane emissions are below 500 parts 14 per million methane, based on Tier 4 provisions of 40 CFR 60.35f(a)(6), shall provide notifications to the Director in 15 accordance with 40 CFR 60.38f(m)(1) and (m)(2). 16 (n) Each owner or operator that chooses to comply with the operational provisions of 40 CFR 63.1958, 63.1960, and 17 63.1961, as allowed by 15A NCAC 02D .1705, .1706, and .1707, shall submit the 24-hour high temperature report 18 according to 40 CFR 63.1981(k). 19 20 History Note: Authority G.S. 143-215.3(a)(1); 143-215.65; 143-215.66; 143-215.107(a)(5); 143-215.107(a)(10); 21 Eff. July 1, 2021.2021; 25 Amended Eff. 26 27 28 1 of 5 15A NCAC 02Q .0102 is proposed for amendment as follows: 1 2 15A NCAC 02Q .0102 ACTIVITIES EXEMPTED FROM PERMIT REQUIREMENTS 3 (a) For the purposes of this Rule, the definitions listed in 15A NCAC 02D .0101 and 15A NCAC 02Q .0103 shall 4 apply. 5 (b) This Rule shall not apply to: 6 (1) facilities whose potential emissions require a permit pursuant to 15A NCAC 02Q .0500 (Title V 7 Procedures); or 8 (2) a source emitting a pollutant that is part of the facility's 15A NCAC 02D .1100 (Control of Toxic 9 Air Pollutants) modeling demonstration if that source is not exempted pursuant to 15A NCAC 02Q 10 .0702. 11 (c) The owner or operator of an activity exempt from permitting pursuant to this Rule shall not be exempt from 12 demonstrating compliance with any other applicable State or federal requirement. 13 (d) Any facility whose actual emissions of particulate matter (PM10), sulfur dioxide, nitrogen oxides, volatile organic 14 compounds, carbon monoxide, hazardous air pollutants, and toxic air pollutants are each less than five tons per year 15 and whose actual total aggregate emissions are less than 10 tons per year shall not be required to obtain a permit 16 pursuant to 15A NCAC 02Q .0300. This Paragraph shall not apply to synthetic minor facilities that are regulated 17 pursuant to 15A NCAC 02Q .0315. 18 (e) Any facility that is not exempted from permitting pursuant to Paragraph (d) of this Rule and whose actual total 19 aggregate emissions of particulate matter (PM10), sulfur dioxide, nitrogen oxides, volatile organic compounds, carbon 20 monoxide, hazardous air pollutants, and toxic air pollutants are greater than or equal to five tons per year and less than 21 25 tons per year may register their facility pursuant to 15A NCAC 02D .0202 instead of obtaining a permit pursuant 22 to 15A NCAC 02Q .0300. This Paragraph shall not apply to: 23 (1) synthetic minor facilities that are regulated pursuant to 15A NCAC 02Q .0315; 24 (2) facilities with a source subject to maximum achievable control technology pursuant to 40 CFR Part 25 63; 26 (3) facilities with sources of volatile organic compounds or nitrogen oxides that are located in a 27 nonattainment area; or 28 (4) facilities with a source regulated pursuant to New Source Performance Standards (NSPS), unless 29 the source is exempted pursuant to Paragraph (g) or (h) of this Rule. 30 (f) The Director may require the owner or operator of a facility to register such facility pursuant to 15A NCAC 02D 31 .0200 or obtain a permit pursuant to 15A NCAC 02Q .0300, if necessary to obtain compliance with any other 32 applicable State or federal requirement. 33 (g) The following activities shall not require a permit or permit modification pursuant to 15A NCAC 02Q .0300: 34 (1) maintenance, upkeep, and replacement: 35 2 of 5 (A) maintenance, structural changes, or repair activities that do not increase the capacity of 1 such process and do not cause any change in the quality or nature or an increase in quantity 2 of an emission of any regulated air pollutant; 3 (B) housekeeping activities or building maintenance procedures, including painting buildings, 4 paving parking lots, resurfacing floors, repairing roofs, washing, using portable vacuum 5 cleaners, sweeping, using and associated storing of janitorial products, or removing 6 insulation; 7 (C) using office supplies, supplies to maintain copying equipment, or blueprint machines; 8 (D) using firefighting equipment (excluding engines regulated pursuant to 40 CFR 63, Subpart 9 ZZZZ); or 10 (E) replacing existing equipment with equipment of the same size (or smaller), type, and 11 function that does not result in an increase to the actual or potential emission of regulated 12 air pollutants, does not affect the facility's compliance with any other applicable State or 13 federal requirements, and that fits the description of the existing equipment in the permit, 14 including the application, such that the replacement equipment can be lawfully operated 15 pursuant to that permit without modifying the permit; 16 (2) air conditioning or ventilation: comfort air conditioning or comfort ventilating systems that do not 17 transport, remove, or exhaust regulated air pollutants to the atmosphere; 18 (3) laboratory or classroom activities: 19 (A) bench-scale, on-site equipment used for experimentation, chemical or physical analysis for 20 quality control purposes or for diagnosis of illness, training, or instructional purposes; 21 (B) research and development activities that produce no commercial product or feedstock 22 material; or 23 (C) educational activities, including wood working, welding, and automotive repair; 24 (4) storage tanks with no applicable requirements other than Stage I controls pursuant to 15A NCAC 25 02D .0928, Gasoline Service Stations Stage I; 26 (5) combustion and heat transfer equipment: 27 (A) heating units used for human comfort, excluding space heaters burning used oil, that have 28 a heat input of less than 10 million Btu per hour and that do not provide heat for any 29 manufacturing or other industrial process; 30 (B) residential wood stoves, heaters, or fireplaces; or 31 (C) water heaters that are used for domestic purposes only and are not used to heat process 32 water; 33 (6) wastewater treatment processes: industrial wastewater treatment processes or municipal wastewater 34 treatment processes for which there are no state or federal air requirements; 35 (7) dispensing equipment: equipment used solely to dispense gasoline, diesel fuel, kerosene, lubricants, 36 or cooling oils; 37 3 of 5 (8) electric motor burn-out ovens with secondary combustion chambers or afterburners; 1 (9) electric motor bake-on ovens; 2 (10) burn-off ovens with afterburners for paint-line hangers; 3 (11) hosiery knitting machines and associated lint screens, hosiery dryers and associated lint screens, and 4 hosiery dyeing processes that do not use bleach or solvent dyes; 5 (12) woodworking operations processing only green wood; 6 (13) solid waste landfills: This does not apply to flares and other sources of combustion at solid waste 7 landfills. These flares and other combustion sources shall obtain a permit pursuant to 15A NCAC 8 02Q .0300 unless they qualify for another exemption pursuant to this Paragraph; or 9 (14) miscellaneous: 10 (A) equipment that does not emit any regulated air pollutants; 11 (B) sources for which there are no applicable requirements; 12 (C) motor vehicles, aircraft, marine vessels, locomotives, tractors, or other self-propelled 13 vehicles with internal combustion engines; 14 (D) engines regulated pursuant to Title II of the Federal Clean Air Act (Emission Standards for 15 Moving Sources); 16 (E) equipment used for preparing food for direct on-site human consumption; 17 (F) a source whose emissions are regulated only pursuant to Section 112(r) or Title VI of the 18 Federal Clean Air Act; 19 (G) exit gases from in-line process analyzers; 20 (H) stacks and vents that prevent the escape of sewer gases from domestic waste through 21 plumbing traps; 22 (I) refrigeration equipment that complies with the regulations set forth in Sections 601 through 23 618 of Title VI (Stratospheric Ozone Protection) of the Federal Clean Air Act, 40 CFR Part 24 82, and any other regulations promulgated by EPA pursuant to Title VI for stratospheric 25 ozone protection, except refrigeration equipment used as or in conjunction with air 26 pollution control equipment. Refrigeration equipment used as or in conjunction with air 27 pollution control equipment shall obtain a permit pursuant to 15A NCAC 02Q .0300 unless 28 it qualifies for another exemption pursuant to this Paragraph; 29 (J) equipment not vented to the outdoor atmosphere, with the exception of equipment that 30 emits volatile organic compounds. Equipment that emits volatile organic compounds shall 31 obtain a permit pursuant to 15A NCAC 02Q .0300 unless it qualifies for another exemption 32 pursuant to this Paragraph; 33 (K) animal operations not required to have control technology pursuant to 15A NCAC 02D 34 .1800. If an animal operation is required to have control technology, it shall obtain a permit 35 pursuant to this Subchapter; 36 (L) any incinerator that meets the requirements set forth in 15A NCAC 02D .1201(c)(4); or 37 4 of 5 (M) dry cleaning operations, regardless of NSPS or NESHAP applicability. 1 (h) The following activities shall not require a permit or permit modification pursuant to 15A NCAC 02Q .0300. 2 These activities shall be included in determining applicability of any rule or standard that requires facility-wide 3 aggregation of source emissions, including activities regulated by 15A NCAC 02D .0530, 15A NCAC 02D .0531, 4 15A NCAC 02Q .0500, and 15A NCAC 02Q .0700: 5 (1) combustion and heat transfer equipment (including direct-fired equipment that only emit regulated 6 pollutants from fuel combustion): 7 (A) fuel combustion equipment (excluding internal combustion engines) not regulated pursuant 8 to 40 CFR Part 60, NSPS, firing exclusively unadulterated liquid fossil fuel, wood, or an 9 approved equivalent unadulterated fuel as defined in 15A NCAC 02Q .0103; 10 (B) fuel combustion equipment (excluding internal combustion engines) firing exclusively 11 natural gas or liquefied petroleum gas or a mixture of these fuels; or 12 (C) space heaters burning waste oil if: 13 (i) the heater burns only oil that the owner or operator generates or used oil from do-14 it-yourself oil changers who generate used oil as household wastes; and 15 (ii) the heater is designed to have a maximum heat input of not more than 500,000 16 Btu per hour; 17 (2) gasoline distribution: bulk gasoline plants, as defined in 15A NCAC 02D .0926(a)(3), with an 18 average daily throughput of less than 4,000 gallons; 19 (3) paint spray booths or graphic arts operations, coating operations, and solvent cleaning operations, 20 as defined in 15A NCAC 02Q .0803, located at a facility whose facility-wide actual uncontrolled 21 emissions of volatile organic compounds are less than five tons per year, except that such emission 22 sources whose actual uncontrolled emissions of volatile organic compounds are less than 100 23 pounds per year shall qualify for this exemption regardless of the facility-wide emissions. For the 24 purpose of this exemption, water wash and filters that are an integral part of the paint spray booth 25 shall not be considered air pollution control devices; 26 (4) electrostatic dry powder coating operations with filters or powder recovery systems; 27 (5) miscellaneous: any source whose potential uncontrolled emissions of particulate matter (PM10), 28 sulfur dioxide, nitrogen oxides, volatile organic compounds, and carbon monoxide shall each be no 29 more than five tons per year; or 30 (6) case-by-case exemption: activities that the applicant demonstrates to the Director do not violate any 31 applicable emission control standard. 32 (i) The owner or operator of a facility or source claiming that an activity is exempt pursuant to Paragraphs (d), (e), 33 (g) or (h) of this Rule shall submit emissions data, documentation of equipment type, or other supporting documents 34 to the Director upon request that the facility or source is qualified for that exemption. 35 36 History Note: Authority G.S. 143-215.3(a)(1); 143-215.107(a)(4); 143-215.108; 37 5 of 5 Temporary Adoption Eff. April 1, 2018.2018; 8 Amended Eff. 9 10 11 1 of 1 15A NCAC 02Q .0706 is proposed for amendment as follows: 1 2 15A NCAC 02Q .0706 MODIFICATIONS 3 (a) The owner or operator shall comply with Paragraphs (b) and (c) of this Rule for a modification that is subject to a 4 Section in 15A NCAC 02D other than 15A NCAC 02D .1100 and that: 5 (1) requires a permit pursuant to 15A NCAC 02Q .0300;.0300 or .0500; or 6 (2) occurs at a facility with a permit pursuant to 15A NCAC 02Q .0500 and emits a pollutant that is part 7 of the facility's previous modeling demonstration conducted pursuant to 15A NCAC 02D .1104 and 8 15A NCAC 02Q .0709, if that modification is not exempted pursuant to 15A NCAC 02Q .0702. 9 This Rule shall not apply to facilities whose emissions of toxic air pollutants result only from insignificant activities, 10 as defined in 15A NCAC 02Q .0103(20), or result only from sources exempted pursuant to 15A NCAC 02Q .0102. 11 (b) The owner or operator of the facility shall submit a permit application to that complies with 15A NCAC 02D 12 .1100 if the modification results in: 13 (1) a net increase in emissions or ambient concentration as previously determined pursuant to 15A 14 NCAC 02D .1106 and 15A NCAC 02Q .0709 of any toxic air pollutant that the facility was emitting 15 before the modification; or 16 (2) emissions of any toxic air pollutant that the facility was not emitting before the modification if such 17 emissions exceed the levels set forth in 15A NCAC 02Q .0711. 18 (c) The permit application filed pursuant to this Rule shall include an evaluation for all toxic air pollutants identified 19 pursuant to Paragraph (b) of this Rule. 20 All sources at the facility, excluding sources exempt from evaluation pursuant to 15A NCAC 02Q .0702, emitting 21 these toxic air pollutants shall be included in the evaluation. Sources meeting the exemption set forth in 15A NCAC 22 02Q .0702(a)(27) shall be reviewed by the Division pursuant to G.S. 143-215.107(a)(5)b. 23 (d) If a source is included in an air toxic evaluation but is not the source that is being added or modified at the facility, 24 and if the emissions from this source must be reduced in order for the facility to comply with the rules in this Section 25 and 15A NCAC 02D .1100, the emissions from this source shall be reduced by the time the new or modified source 26 begins operating such that the facility shall be in compliance with the rules of this Section and 15A NCAC 02D .1100. 27 28 History Note: Authority G.S. 143-215.3(a)(1); 143-215.107; 143-215.108; 143B-282; 29 Rule originally codified as part of 15A NCAC 2H .0610; 30 Eff.
